THIS INDENTURE, made this ay of January, 2015 is by and between Kevin Scalia
residing at 2 Mountainview Road, Fort Solanga, New York 11786 and Robert Scalia residing
at 5405 Londonderry Road, Edina, Minnesota 55436 hereinafter Grantor and Kevin Scalia
residing at 2 Mountainview Road, Fort Solanga, New York 11786 and Robert Scalia residing
at5405 Londonderry Road, Edina, Minnesota 55436 hereinafter Grantee.
Whereas, Grantor owns real property located at 95 Mid Farm Road, Southold, New York
11971 SCTM # 1000-063.00-07.00-017.001, as more fully described in Schedule A, attached
hereto, and
Whereas, Grantee owns real property located at 125 Mid Farm Road, Southold, New York
11971, SCTM # 1000-063.00-07.00-019.000 as more fully described in Schedule B, attached
hereto, and
Whereas, Grantor wishes to grant and convey to Grantee a permanent and perpetual
easement over the portion of Grantor's Property as described in Schedule C, attached hereto, to
permit Grantee to install a subsurface water service line to be used solely for the purpose of
providing water service from the public water distribution system to the Grantee's Property and
across Grantor's Property.
The Grantor, in consideration of Ten Dollars ($10.00) and of other good and valuable
consideration, paid by the Grantee, does hereby grant and convey unto the Grantee, its heirs,
successors and assigns:
A permanent and perpetual easement, running with the land, consisting of the right to
install, operate, maintain, repair, remove and replace, at Grantee's cost and expense, a subsurface
water service line or lines and appurtenances within the portion of Grantor's Property described
in Schedule C attached and made a part hereof (hereinafter the "Easement Area").
The water service lines installed pursuant to this easement shall be used solely for the
purpose of transmitting water from the public water distribution system to Grantee's Property
across the Easement Area and shall be and remain the personal property of the Grantee, its
successors and assigns, forever.
Grantee shall promptly and at its own cost and expense restore the Easement Area to a
condition substantially similar to the condition which existed prior to the installation of service
line or lines and after each exercise of its right to maintain, repair, remove or replace the service
line or lines if activity disturbs the Easement Area.
This easement shall be forever binding upon Grantor, his heirs, successors, and assigns
for the benefit of Grantee, his heirs, successors, and assigns.
