EASEMENT AGREEMENT
AGREEMENT, made this 1,7X) day of Haber, 201-3, between
Clifford Cornell and Ruth Cornell, his wife residing at P.O. Box 910, 10948
North Bayview, Southold, New York 11971, hereinafter referred to as
Cornell SR, and Clifford Cornell and Lorraine Cornell, his wife both
residing at 22 Wright Road, Rockville Centre, New York 11570, hereinafter
referred to as Cornell JR.
WHEREAS Cornell SR is the owner of lot 2 as shown on a certain
map entitled, "Map of Plock Shellfisher Preserve" and filed in the Office of
the Clerk of Suffolk County on June 14, 1995, as Map No. 9700 and further
described as SCTM No. 1000-079.00-05.00-020.009 containing an area of
1.8204 acres, hereinafter referred to as the Cornell SR property;
WHEREAS Cornell JR is the owner of lot I as shown on a certain
map entitled, "Map of Plock Shellfisher Preserve" and filed in the Office of
the Clerk of Suffolk County on June 14, 1995, as Map No. 9700 and further
described as SCTM No. 1000-079.00-05.00-020.008, hereinafter referred to
as the Cornell JR property;
WHEREAS, the parties desire to enter into an easement agreement
whereby Cornell SR shall provide an easement to Cornell JR for the purpose
of Cornell JR accessing the Shelter Island Sound across the Cornell SR
property;
NOW, THEREFORE, in consideration of ten ($10.00) dollars and
other valuable consideration paid by Cornell JR and received by Cornell SR,
the parties agree as follows:
1. BEACH EASEMENT- Cornell SR hereby grants a right of way
easement to Cornell JR permitting Cornell JR to traverse the Cornell SR
property to the beach of the Shelter Island Sound; use of the stairs to access
the beach; the right to apply to the municipality to construct stairs; and use
of the beach for any and all purposes.
2. TERM- The term of this easement shall run with the land for as
long as Cornell JR and his heirs own the Cornell JR property.
3. DESCRIPTION OF THE EASEMENT- The area of this right
of way for beach and use shall be reasonable to allow the Cornell JR his
family, invitees, and guests use and enjoyment of the beach. It shall not be
used for vehicular use, but may be used to tow watercraft and beach
accessory items. A copy of the description of the easement is attached
hereto and made apart hereof as Exhibit A.
4. BINDING: This agreement shall be binding upon Cornell Sr's
and Cornell JR's respective heirs, successors, and assigns.
S. LEGAL REPRESENTATION: Each party acknowledges and
represents that they have been fully and independently advised by legal
counsel of their own choosing or that they have had the opportunity to do so,
and further represent that they understand the nature and terms, of the within
agreement and are executing same freely and voluntarily and without any
force or coercion on the part of any person. William C. Goggins, Esq.
represented Cornell SR in the preparation of this document.
6. MODIFICATION: This agreement nor any provision hereof
may be amended or modified except by an agreement in writing duly
subscribed and acknowledged with the same formality as this agreement.
Any waiver by either party of any provision of this agreement or any right
hereunder shall not constitute or be deemed a continuing waiver and shall
not prevent or stop such party from thereafter enforcing such right, and the
failure or either party to insist in any one or more instance upon the strict
performance of any of the provisions of this agreement by the other party
shall not be construed as a waiver or relinquishment for the future of such
provision, by the same shall continue in full force and effect.
7. ENTIRE UNDERSTANDING: This Agreement contains the
entire understanding of the parties who hereby acknowledge that there have
been and are no representations, warranties, covenants, or undertakings other
than those expressly set of the herein. Neither party is relying on any other
representations, except the terms actually set forth in this Agreement.

Agreement the day and year first above written.

New York and further described as follows:
BEGINNING at a point located at the southeast comer of lot 2 (SCTM No.
1000-079.00-05.00-020.009) and the north comer of lot I (SCTM No. 1000-
079.00-05.00-020.008) as shown on a certain map entitled, "Map of Plock
Shellfisher Preserve" and filed in the Office of the Clerk of Suffolk County
on Jun 14, 1995, as Map No. 9700;
