The following action was taken by the Southold Town
Planning Board on Monday, November 20, 1989.
RESOLVED that the Southold Town Planning Board recommend to
the Town Board that they deny the request for the change of zone
from 11R-80" Residential Low Density (two acre) District to "B"
General Business District for the following reasons:
1. Changing the zone of this parcel would be spot zoning,
which is illegal. The petitioner has had a
non -conforming use on a non -conforming lot. Changing
the zone would not be in accordance with the Master
Plan which was adopted earlier this year. Further, the
proposed change could be construed as a benefit to the
petitioner at the expense of the surrounding property
owners.
2. During the drafting of the zoning map under the new
Master Plan, the Board considered changing the zone of
this property. However, the proximity of the church
and the residential and agricultural nature of the
surrounding land uses led the Board to keep the zone
"R-8011. The Board's position has not changed from that
time.

The following action was taken by the Southold Town

amend the Building Zone Ordinance of the Town of Southold, Suffolk County, New York,
including the Building Zone Maps heretofore made a part thereof, as follows:
Change the zoning of the above premises from its present R-80
zoning designation, with non -conforming use, to B - General Business.

3. Such request is made for the following reasons:
The land, buildings and uses of this property do not conform with
the present zoning ordinance and continue only by virtue of their
certified preexisting status.
Moreover, the main structure on this property is not designed for
use as a one -family dwelling in this residential zone. Further,
it is restricted to use as a dental, or other professional
office, pursuant to Pre-C.O. #Z-15832. If the applicant/owner is
unable to lease this property as a professional office it cannot,
presently, be used for any other purpose. In the past, this building has had
various non-residential uses, including: retail store and restaurant.
A change of zoning designation to B (General Business) will
relieve the property of the uncompromising restrictions under
which it presently exists and place it in a zoning district which
permits its potential uses.

1. The land, buildings and uses of this property are permitted as
preexisting and non -conforming within this R-80 Residential Zone
(see copy of Pre-C.O. #Z-15832 attached hereto).
2. The requested change of zone to B -General Business would place
this property in a zone within which its permitted uses are
compatible.
3. The principal structure on this property has had various
commercial uses in the past, including dental office, retail
store and restaurant. It was not built, nor is it suitable, for
use as a one -family dwelling.
4. The long-standing use of this property and its improvements
went unrecognized by the 1-10-89 zoning amendments to the
Southold Town Code, resulting in placement within an incompatible
zoning district.
