Christopher Dwyer on behalf of CEDARS GOLF CLUB, LLC, c/o PAUL PAWLOWSKI requests a
Wetland Permit to rehabilitate and make improvements to an existing dike system which is
approximately 175 linear feet long and currently between 4 and 5 feet high by re-engineering the
slopes using approximately 210 cubic yards of structural fill and various plantings; replace existing
pipe with new 12" diameter PVC pipe and replace one-way valve; remains of existing boardwalk to
be removed; and implement a maintenance program to remove large woody vegetation that has
contributed to previous dike failures. Located: 305 Cases Lane, Cutchogue. SCTM# 109-5-16.3
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS items "B" and which states:
B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site
(inplace), including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced,
rehabilitated or reconstructed without a permit and shoreline erosion control structures (including,
but not limited to, groins, jetties, bulkheads, filled piers) located within Great Peconic Bay,
Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island
Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and
Block Island Sound (excluding all creeks);
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A Qroposed action will be evaluated. as to its sigWficant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
31 If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non -
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

permits necessary to rehabilitate and make improvements to an existi dike syste The Cedars
Golf Club dike system is approximately 175 linear feet long and current 4 and 5 feet
high. We are proposing to rehabilitate the areas damaged by storms with engineered slopes and
implement a maintenance program to remove large woody vegetation that has contributed to
previous failures. The project will require approximately 210 cy of structural fill and various
plantings. This dike system provides the sole source of protection from flooding to this golf
course and prevents floods from affecting homes nearby. The current elevation of the dike allows
the water to travel around the Salt Air Dike system (similar project previously permitted) and
"flank" the homes that system is protecting.
The Salt Air Dike System has permits issued and listed below:

G. THE CONTRACTOR IS RESPONSIBLE TO IMPLEMENT ALL PRACTICAL SOIL EROSION CONTROL METHODS TO CONTAIN ALL SEDIMENT ON SITE AND WITHIN THE PROJECT LIMITS. IF ADDITIONAL MEASURES ARE FOUND TO BE NECESSARY AND ARE NOT OUTLINED ON THE PLANS, THE CONTRACTOR SHALL

7. IN THE CASE THAT.A STORM 1S PREDICTED DURING THE COURSE OF CONSTRUCTION. THE CONTRACTOR SHALL ENSURE THAT NO PART OF THE DIKE SYSTEM IS LEFT OPEN OR EXCAVATED. THE CONTRACTOR IS RESPONSIBLE FOR MAINTAINING THE DIKE SYSTEM'S FUNCTIONALITY THROUGHOUT THE
DURATION OF CONSTRUCTION.
8. ALL STRUCTURAL FILL AND TOPSOIL MATERIALS SHALL CONFORM TO THE SPECIFICATIONS. THE CONTRACTOR SHALL HAVE ALL SOILS TESTED AND APPROVED PRIOR TO DELIVERY TO THE SITE. ALL DELIVERIES SHALL HAVE INVOICES WITH REFERENCE TO THE STOCKPILE SOURCE. ALL ASSOCIATED
COSTS SHALL BE INCLUDED IN THE UNIT COST FOR STRUCTURAL FILL AND'OR TOPSOIL. IT IS THE RESPONSIBILITY OF THE CONTRACTOR TO PERFORM QUALITY CONTROL TESTING ACCORDING TO INTERVALS APPROVED BY THE ENGINEER-

1. SEE GENERAL PLANS AND MISCELLANEOUS TABLES FOR SPECIFIC AREAS OF EROSION AND
SEDIMENT CONTROL.
2. EROSION BLANKET SHALL BE INSTALLED AS SHOWN IN DETAILS. LOCATION OF EROSION
BLANKET IS SHOWN ON THE GENERAL PLANS AND TABLE OF EROSION AND SEDIMENT
CONTROL.
3. THE COST OF EXCAVATION IS INCLUDED IN PRICE BID FOR SEEDING.
4. THE UNDERLYING SOIL SHALL BE PREPARED BY PINNING THE REQUIRED AMOUNTS OF LIME,
FERTILIZER, AND SEED AS SPECIFIED UNDER SEEDING.
5. THE CONTRACTOR SHALL BEGIN AT THE TOP OF THE SLOPE BYANCHORING THE BLANKET IN A
'FT DEEP X 1 FT WIDE TRENCH. THE CONTRACTOR SHALL BACKFILL AND COMPACT THE
TRENCH AFTER STAPLING. SEE DETAIL B "2 BELOW AND A.O.B.E.
6. THE CONTRACTOR SHALL ROLL THE BLANKETS DOWN THE SLOPE IN THE DIRECTION OF THE
WATER FLOW.
7. THE EDGES OF PARALLEL BLANKETS SHALL BE STAPLED WITH A MINIMUM OF A 0.16 FT
OVERLAP.
8. WHEN THE BLANKETS MUST BE SPLICED DOWN THE SLOPE. THE CONTRACTOR SHALL PLACE
THE BLANKETS. END OVER END (SHINGLE STYLE), WITH A MINIMUM OVERLAP OF 0.5 FT
OVERLAP. THE CONTRACTOR SHALL STAPLE THROUGH THE OVERLAPPED AREA 0.98 FT ON
CENTER WITH THE REQUIRED STAPLES. SEE DETAIL B - "5 A.O.B.E.
9. FOR STAPLING PATTERN SEE DETAIL "STAPLE PATTERN GUIDE" BELOW
10. ALL WORK REQUIRED TO INSTALL THE BLANKETS, INCLUDING THE EXCAVATION, PINNING,
BACKFILL, AND MAINTENANCE SHALL BE INCLUDED IN THE SEEDING SPECIFICATION.
