Box 1179 Southold, NY 11971 Telephone: 631765-1938 Fax: 631765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinato Date: July 21, 2014 Re: Proposed Wetland Permit for ROBERT PELLEGRINI SCTM# 1000-137-3-4 Samuels & Steelman Architects on behalf of ROBERT PELLEGRINI requests a Wetland Permit for the existing two-story (2,250sq.ft.) residence with three attached (180sq.ft.) covered porches to remain; existing glass enclosed structure attached to residence to be removed and replaced with a new wood framed (118sq.ft.) structure with gutters to leaders to a drywell; existing (790sq.ft.) decks attached to waterside of residence to remain and reconstruct in-place as required a +/-13' area adjacent to the new construction; existing driveway, parking areas, and 4' wide walkway to remain; reconstruct in-place existing 4'x24' stairs and walkway connected to deck at top of bank leading to a 4'x9' platform and 4'x8' stairs; reconstruct in-place existing 12'x16' elevated deck at bottom of bank; existing 4'x43' elevated wood walkway leading from elevated deck to 3'x12' adjustable ramp and 6'x20' floating dock are to be reconstructed in-place; and a line of hay bales with silt fencing to be installed prior to construction along top of bank. Located: 4515 Stillwater Avenue, Cutchogue. SCTM# 137-3-4 It is recommended that the Board clarify the regulated feature. Setbacks are proposed from the approximate high water mark, however, a top of bank is also shown on the survey. It is my recommendation that the proposed actions are INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The below structures described were not constructed pursuant Board of Trustee review or a Chapter 275 Wetland Permit. In 1984 the Board of Trustees issued a "grandfather" permit (1892) for a stair and 68' long dock structure. The steps and dock are not in compliance with the 1984 permit. The steps are configured differently and are attached to a deck. The dock is also now 76' long; 8' longer than the permitted structure (with estimated original float dimensions of 6'x20'). 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: Pursuant to Chapter 275 Wetlands and Shorelines, the proposal to re -construct the 192 square foot deck seaward of the bottom of the bank is not a permissible action. If the deck is determined to be a platform associated with stairs it may not be larger than 100 square feet. If it is determined not to be associated with stairs it must be landward of the top of bluff. Further. I could not locate Chapter 275 Wetland Permits for the glass enclosed structure etc... Construction plans for the steps and dock have not been provided and should be submitted for review. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. N/A POLLUTION CONTROL MEASURES In accordance with the provisions of the Town of Southold, chapter 236, storm water management and erosion and sediment control measures including, but not limited to, the following shall be employed during construction: A. Existing vegetation to remain shall be protected (by installation of construction fence or other approved means) and shall remain undisturbed. B. Clearing and Grading shall be scheduled so as to minimize the extent of exposed areas and the length of time that areas are exposed. A maximum of 1 acre shall be disturbed at one time unless written permission is granted by the NYSDEC. Graded and stripped areas shall be kept stabilized through the use of temporary seeding as required. Seed mixtures shall be in accordance with the soil conversation service recommendations. C. Bare soils shall be seeded within 14 days of exposure, unless construction will begin within 21 days as sections are completed, or if construciton on an area is suspended, the area shall be seeded immediately. a. Seed preparation - scarify soil if compacted, remove debris and obsticiles such as roots and stumps. b. Soil Amendments 1. Lime to ph 6.0 2. Fertilize with 6600 lbs of 5-10-10 or equivalent per acre (14 lbs/100 sq. ft.) c. Seed Mixtures 1. Temporary seedlings a. Ryegrass (annual or perennial) @ 30 lbs. per acre (0.7 lbs per 1,000 sq. ft.) b. Certified "Aroostook" winter rye (cereal rye) @ 100 lbs. per acre (2.5 lbs per 1,000 sq. ft.) use winter rye if seeding in October/November. 2. Permanent seedlings - See Landscaping plans D. The length and steepness of Cleared slopes shall be minimized to reduce runoff velocities. Runoff shall be diverted away from cleared slopes. E. Sediment shall be trapped on the site and not permitted to enter adjacent properties or public roads or drainage systems. Sediment barriers shall be installed along the limits of disturbance prior to the start of construction and shall be maintained until construction is complete. F. A stabilized construction entrance shall be maintained to prevent soil and loose debris from being tracked onto local roads. The construction entrance shall be maintained until the site is permanently stabilized. Any sediment tracked onto public roads to be removed or cleaned on a daily basis. G. All runoff shall be retained on site in accordance with local regulations and approvals. Drainage inlets installed on site shall be protected from sediment buildup through the use of appropriate inlet protection. H. Appropriate means shall be used to control dust during construction. I. Following permanent stabilization, paved area shall be cleaned of soil and debris and drainage systems shall be cleaned and flushed as necessary. J. The contractor is responsible for inspection and proper maintenance of erosion control measures. Inspections must be performed every seven calendar days and immediately after periods of rainfall greater than one half inch. Maintenance measures are to include, but are not limited to, cleaning of recharge basins, sediment traps and drywelis, cleaning and repair of sediment barriers, repair of berms and runoff diverters, and cleaning and repair of inlet protection devices. K. During construction, the contractor will comply with all local regulations concerning the disposal of solid waste and debris and toxic and hazardous waste, as well as sanitary sewer and septic system regulations. Temporary fencing shall be erected as shown on Site Plan along with the placement of dumpsters to control the buildup of debris. The contractor shall periodically dean up any debris accumulated along the temporary fence and empty the dumpsters regularly. The contractor will report any required modifications to the SWPPP necessitated by field conditions or construction activities to the Engineer/Architect for revision of the SWPPP where appropriate. DESCRIPTION OF CONSTRUCTION AND WASTE MATERIALS STORED ON SITE Construction materials shall include concrete wood forms, building lumber and associated metal attachments, precast concrete septic/drainage structures, prefabricated building components (windows, doors, cabinets, flooring materials, finished roofing and siding materials, lighting fixtures, plumbing fixtures), gypsum wall board, batt and rigid insulation, piping for plumbing, outdoor paving materials. p [ ( Waste materials shall include demolition materials from the existing building structure, unused building materials and products, trash from construction workers meals and drinks.
