construct a 16'x32' in -ground swimming pool and install pool enclosure fencing along landward limit
of 15' wide non -turf buffer adjacent to bluff crest and along the side yards. Located: 18915

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT
with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
1. All applicants for perm its* including Town of Southold agencies, shall com plete this CCAF for
proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law. This
assessor ent is intended to supplem ent other inform ation used by a Town of Southold agency in
m a k in g a d e t e r m i n a ti o n o f c o n s i s t e n c y. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
scant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non -
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

The proposed swimming pool is part of an overall site redevelopment, which includes the removal of the existing dwelling located 48
feet from the bluff crest and construction of a new dwelling located 52' farther landward and 100' from the bluff, which is consistent
with Policy 3 to the extent that the overall separation between the building areas and the bluff will be increased, thus increasing the
visual buffer between developed portion of the property and Long Island Sound. The proposed non -turf buffer to be established in place
of existing lawn will also further the policy objective of enhancing the scenic quality of the site adjacent to the bluff.

A permanent, dedicated drywell would be installed to contain pool backwash; and a 15' wide, approximately 1,500 sf non -turf buffer
will be established adjacent to the bluff, which can serve both as a sink and filter for stormwater runoff and contaminants. By thus
reducing lawn areas, and increasing the setback of lawn areas from the bluff and surface waters of Long Island Sound, the potential
quantity of site runoff reaching surface waters will be decreased; and the quality of runoff will be improved through a reduced
concentration of potential fertilizers, pesticides, and insecticides.

Policy6
The proposed swimming pool is part of a larger site redevelopment design that will
provide an improvement to the environmental condition of the site, including the adjacent
bluff, beach, and tidal waters, through an increase in the property's bluff setbacks and the
project's incorporated mitigation measures. Specifically, the site is presently
characterized by a single family dwelling located 48 feet from the bluff crest with no
drainage system to collect roof runoff; an antiquated septic system located 36 feet from
the bluff; and a lawn that extends to the edge of the bluff. The proposed project seeks to
remove these existing structures and situate all new construction at or beyond the limit of
Chapter 275 jurisdiction and thus out of Trustees' jurisdiction or as already approved by
the Trustees pursuant to Administrative Wetlands Permit No. 34, except for the proposed
swimming pool. The proposed swimming pool, however, would significantly exceed
(50%) the 50' bluff setback for swimming pools required by §275-3(D)(1)(b)(4), as it
would be located 75' from the bluff crest and more than 150 feet from the surface waters
and littoral zone wetlands of Long Island Sound. As mitigation for the project, a
temporary project limiting fence and staked haybales would be set in place to control and
contain site disturbance during construction; a permanent, dedicated drywell would be
installed to contain pool backwash; and a 15' wide, approximately 1,500 sf non -turf
buffer will be established adjacent to the bluff, which can serve both as a sink and filter
for stormwater runoff and contaminants. Therefore, the proposed landward relocation of
structures and additional mitigation measures will result in a substantial improvement to
the environmental conditions on the property. Due to its location landward of the bluff
crest, the project is exempt from the NYSDEC's permitting requirements pursuant to
Article 25 of the New York State Tidal Wetlands Land Use Regulations; and the
proposed swimming pool is consistent with the 50' bluff setback for swimming pools
required by §275-3(D)(1)(b)(4). Therefore, the project is consistent with Policy 6.
