William Garbarino, Esq. on behalf of MORANDINA LIVING TRUST requests an Amendment to
Wetland Permit #1859 for the as -built 2.5'x89.5' fixed dock with a 3.5'x6.5' wooden locker and a
1.5'x4.1' wooden bench at landward end; a 2.5'x12' ramp; an 8'x20' floating dock; and two piles
located in the wetlands; and to Transfer Wetland Permit #1859 from Almaron F. Bennett to
Morandina Living Trust, as issued on August 31, 1984. Located: 3715 Stillwater Avenue,
Cutchogue. SCTM# 136-2-12
It is my recommendation that the proposed actions are INCONSISTENT with LWRP Policy 6:
protect and restore the quality and function of the Town of Southold ecosystem and Policy 9:
provide for public access to, and recreational use of, coastal waters, public lands, and public
resources of the Town of Southold and therefore are, INCONSISTENT with the LWRP.
A "grandfather' Wetland Permit for _ C1 dock structure was issued on August 31, 1984
(1859) authorizing access to public waters. The applicant.is seeking authorization of an expansion
(seaward projection) of a 'as built" locker, bench and dock structure that extends further (315) into
public waters.
The applicant fails to prove that the action meets the following requirements as outlined in § 275-11
Construction and operation standards C. 2 (d) of the Southold Town Code:
(d) Review and approval of dock applications. Before issuing a permit for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic
or vessel congestion.
(21 Whether the dock will unduly interfere with the public use of waterways for swimming,
boating, fishing, shellfishing, waterskiing and other water -dependent activities,
(51_ Whether the dock will cause degradation of surface water quality and natural resources;
[117 Whether the cumulative impacts of a residential and commercial dock will change the
waterway or the environment and whether alternate design, construction, and location of the
dock will minimize cumulative impacts, and
Whether adequate facilities are available to boat owners and/or operators for fueling,
discharge of waste and rubbish, electrical service and water service.
In addition, Chapter 275 requires that the determination of the length of the dock must include the
dimensions of the vessel. The dimensions of a vessel are not specified.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action tiA policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated. as to its - si iii
beneficial and adverse effects upon the coastal area (which includes all of Southold Town/.
3: If any question in Section C on this foam is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supportiing and non-
supportin¢facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southbld's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the Town Clerk's office.
