SCTM#1000-51-4-13 Records show that a Wetland Permit (7410) was issued in 2010 for the property to stabilize the bluff through armoring fol lowing.severe erosion during 2010 storms. An Amendment to the permit was issued in 2011. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policy standards and therefore CONSISTENT with the LWRP. The recommendation was made with the following assessment and recommendations: 1. The bluff on the property has been stabilized to the greatest extent practicable with shoreline armoring. 2. The seaward addition of the stone and stair landing is de -minimus. The existing setback from the top of bluff is shown as 51.3', the proposed setback is 41.9', indicating a 3.3' further encroachment into the 100' setback from the top of bluff. 3. It is recommended that: a. The Board determines what the 'existing concrete cover" is as shown on the plans seaward of the residence and if it needs to be addressed (abandoned and filled). b. Although not a structure addressed in the notice of disapproval the stone pavers (patio) will affect surface drainage patterns. It is recommended that the Board determine the pitch of the stone patio and if necessary require drainage designs that would prevent storm water surface flow towards the bluff. One foot contours shown in figure 1 indicate that the property slopes towards the bluff and adjacent property. c. The Board requires that a 15' wide vegetated buffer be located landward of the top -of bluff to mitigate storm water surface runoff towards the bluff. Figure 1. Subject site showing 1' contours. The addition to the existing building, on the water side of the building, will be built on the location of an existing concrete terrace, filling in the corner of the existing building. The addition to the road side of the building will also be built on the location of an existing concrete terrace, filling in the corner of the existing building. The addition of the covered porch is planned on the road side of the building further away to the bluff than the existing building is. The second floor addition keeps the construction within the footprint of the existing building. The only area on the property thats meets the setbacks would then require a new building structure which would be a major financial hardship rather than what the current project would cost. 3. The amount of relief requested is not substantial because the proposed addition will be built over an existing structure which is in a non -conforming location. The house will be reconstructed within the existing footprint, with modest and appropriate expansions intended to square off the irregular shape and rationalize the interior layouts. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because it is mostly within the existing footprint of the building. The proposed construction will retain all rain water on site via new drywells and comply with all best management practices for storm water run off during construction. In keeping with requirements of the Southold Trustees, State DEC and County Health Department, it will include a new updated conforming sanitary system. 5. The alleged difficulty has NOT been self created because it is the result of a pre-existing situation where the existing house was located within the setback prior to zoning. There are no Covenants or Restrictions concerning this land. Prior to construction, the project must also be approved by The Southold Town Trustees and Suffolk County Department of Health Services. This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood, and the health, safety, and welfare of the community. The variance requested is the minimum relief practicable given the personal benefits anticipated by the applicant. The reconstruction is needed to maintain the investment and the proposed expansion is modest in scope and scale. We respectfully request that the appeal be granted, together with any further relief that is deemed necessary and reasonable.
