SCTM#1000-53-4-8 The less than the code required single side yard setback of 15 feet is EXEMPT from LWRP coastal consistency review pursuant to § 268-3. Definitions Minor Actions (F) which states: F. Granting of individual setback, lot line and lot area variances, except in relation to a regulated natural feature or a bulkhead or other shoreline defense structure or any activity within the CEHA; It is my determination that the proposed action is to extend the existing deck is CONSISTENT with the below listed LWRP polices and therefore CONSISTENT with the LWRP provided that the Board consider requiring the following: The recommendation was made based on the following: 1. The 6' wide (seaward) expansion of the deck will not encroach into a mapped FEMA Flood Zone (Figure 1). Figure 1 Subject parcel (White Arrow) In the event that the action is approved, it is recommended that a perpetual 10 foot wide LANDSCAPED BUFFER be established landward from the top of sea wall. Chapter 268 defines a Landscaped Buffer as - A land area of a certain length and width which is planted with indigenous, drought -tolerant vegetation similar to that found within the immediate proximity of the parcel. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four -foot -wide access path constructed of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009] It is further recommended that the two large trees on the north and south property boundaries be preserved into perpetuity. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
