JOHN F. FICARA, residing at 1886 Noyac Path, Sag Harbor, New York 11963, and
ANNETTE CHANDLER, residing at 27 Goodwood Road, Sag Harbor, New York 11963, as Trustees
of THE SALVATORE D. FICARA REVOCABLE LIVING TRUST, originally dated April 26, 2001 and restated
May 2, 2006, July 29, 2008 and March 9, 2012,
party of the first part, and
MARY D. FICARA, residing at 1886 Noyac Path, Sag Harbor, New York 11963
party of the second part,
WITNESSETH, that the parry of the first part, in consideration of ten ($10.00) and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being in the Village of Greenport, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as follows:
BEGINNING at a point, said point being 206.00' northerly of the intersection of the northerly line of North Street and
the Westerly line of 2nd Street. And running thence from said point of beginning along the northerly line of the land
of Rhetta South 84° 25' 30" West, a distance of 150.90 feet, to the easterly line of the land of Butler and running
thence along the land of Butler North 06° 48'30" West, a distance of 50.00 feet to the southerly line of Lot 1 and
running thence along the southerly line of Lot 1 North 84° 25' 30" East, a distance of 150.92 feet to the westerly line
of 2nd Street, thence along the Westerly side of 2nd Street, South 06° 47' 00" East, a distance of 50.00 feet to the
point or place of beginning. Said lot containing 7,544 Square Feet.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
May 10, 2006 and recorded in the Suffolk County Clerk's Office on August 1, 2006 in Liber 12462 at Page 178.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights
of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be
construed as if it read "parties" when ever the sense of this indenture so requires.
