THIS INDENTURE, made the 4 day of January, 2015
BETWEEN
CAROLYN R. AMEEN, residing at 755 Lupton's Point Road, Mattituck, New York 11952,
party of the first part, and
CAROLYN R. AMEEN, residing at 755 Lupton's Point Road, Mattituck, New York 11952 as to
an undivided seventy (70%) percent interest, and DEANEAL CARLTONY FORBES, residing at
755 Lupton's Point Road, Mattituck, New York 11952, as to an undivided thirty (30%) percent
interest, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100—($10.) --Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being on Lupton's Point in Mattituck, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the northerly side of a 20 foot right of way distant 720 feet easterly as
measured along the northerly side of said right of way from the corner formed by the intersection
of said northerly side of right of way with the easterly side of Marratooka Road;
RUNNING THENCE along the land now or formerly of Hanus, North 4 degrees 03 minutes 40
seconds West, 208.48 feet to the southerly side of a 15 foot right of way;
THENCE along the southerly side of said right of way and through a monument North 78 degrees f
47 minutes 10 seconds East 110.79 feet to the mean high water line of Deep Hole Creek;
THENCE southeasterly along Deep Hole Creek measured on a tie line bearing South 49 degrees
00 minutes 57 seconds East, 44.78 feet to land now or formerly of Kreiling;
THENCE along said land now or formerly of Kreiling the following two (2) courses and distances:
(1) South 28 degrees 44 minutes 00 seconds West, 98.24 feet;
(2) South 10 degrees 14 minutes 50 seconds East, 100.00 feet to the northerly side of the
said 20 foot right of way;
THENCE along the northerly side of said 20 foot right of way the following two (2) courses and
distances:
(1) South 79 degrees 45 minutes 10 seconds West, 95.24 feet;
(2) Thence North 73 degrees 28 minutes 50 seconds West, 4.76 feet to the point or place of
BEGINNING.
TOGETHER WITH a right of way over the 20 foot wide private road to and from the premises
hereby conveyed to Marratooka Road, and to and from Deep Hole Creek at the end of said 20
foot private road where it adjoins Deep Hole Creek on the easterly end of Lupton's Point.
Subject to the terms of an Agreement between the parties of even date herewith.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated April 9, 2013 recorded May 13, 2013 in Liber 12729 page 472.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or.
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
