Chairman Wilcenski: Good afternoon ladies and gentlemen and welcome to the
regularly scheduled Southold Town Planning Board meeting for February 9, 2015. The
first order of business is to set Monday, March 9, 2015 at 6:00 p.m. at the Southold
Town Hall, Main Road, Southold, as the time and place for the next regular Planning
Board Meeting.

Final Plat Extensions:
Chairman Wilcenski: Josephson, Zapf & Dow - This proposed Lot Line Modification
transfers 0.01 acre from SCTM#1000-17-2-6.1 to SCTM#1000-17-2-1.9. Lot 6.1 will
decrease in size from 2.68 acres to 2.67 acres, Lot 1.9 will increase from 2.02 acres to

WHEREAS, a copy of the recorded deeds must be submitted to the Southold Town
Planning Department within 62 days of the date of Final Approval, or such approval

WHEREAS, on January 4, 2015, the approval expired; and
WHEREAS, on January 6, 2015, the agent submitted a request for a 62 day extension

WHEREAS, on July 7, 2014, the Southold Town Planning Board granted Conditional
Preliminary Plat Approval upon the map entitled "Preliminary Plat for the Clustered
Standard Subdivision", dated February 8, 2002 and last revised March 17, 2014,
prepared by Martin Donald Hand, Licensed Land Surveyor, with ten (10) conditions; and
WHEREAS, on January 7, 2015 Conditional Preliminary Plat Approval expired; and
WHEREAS, on January 12, 2015, the agent requested an Extension of Conditional
Preliminary Approval due to additional time needed to complete the requested legal
documents; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grants a 90 day
Extension of Conditional Preliminary Plat Approval upon the map entitled

SITE PLANS
Determinations:
Chairman Wilcenski: 170 Moores Lane Realty Corp. - This Site Plan is for a
proposed 60'x 19'(1,140 sq. ft.) office addition to an existing 129' x 125' warehouse
building on 1.2 acres in the Light Industrial Zoning District. The property is located at
170 Moores Lane, ±130' n/w/o Moores Lane & NYS Route 25, Greenport. SCTM#1000-
45-7-3

WHEREAS, this Site Plan is for a proposed 60'x 19'(1,140 sq. ft.) office addition to an
existing 129'x 125' warehouse building on 1.2 acres in the Light Industrial Zoning
District, Greenport; and
WHEREAS, on September 30, 2014, the agent for the applicant, Colin Ratsey,
submitted an application for Site Plan review; and
WHEREAS, on October 1, 2014, a revised Notice of Disapproval was issued by the
Building Department noting the proposed relocation of the office addition, effectively re-
classifying the required Variances for the application; and
WHEREAS, on October 15, 2014, the agent for the applicant, Colin Ratsey, submitted
revised Site Plans for review; and
WHEREAS, at a Work Session held on October 20, 2014, the Planning Board formally
accepted the application for review with revisions and information to be submitted
immediately; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), has determined that the
proposed action is a Type II Action as it falls within the following description for 6
NYCRR, Part 617.5(c)(7): construction or expansion of a primary or
accessory/appurtenant, non-residential structure or facility involving less than 4,000
square feet of gross floor area and not involving a change in zoning or a use variance
and consistent with local land use controls, but not radio communication or microwave
transmission facilities. The action is to construct a 1,140 sq. ft. building in the location of
an existing concrete pad; and
WHEREAS, on November 6, 2014, the agent for the applicant, Colin Ratsey, submitted
the remaining application materials to the Planning Board; and
WHEREAS, on November 14, 2014, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and

WHEREAS, on November 20, 2014, the Zoning Board of Appeals issued a decision for
File #6801, granting a non -conforming front yard variance of 26'6" and a lot coverage
percentage of 33.4% (LI = 30% max) with no conditions; and
WHEREAS, on December 10, 2014, the Southold Town Engineering Inspector reviewed
the above -referenced application and determined that the proposed drainage meets the
minimum requirements of Chapter 236 for Storm Water Management and required
revisions to the Site Plan so the drainage calculations and drainage depictions on the
Site Plan are consistent; and
WHEREAS, on December 15, 2014, a public hearing was held and closed for the
above -referenced application; and
WHEREAS, on December 18, 2014, the Southold Town Fire Inspector reviewed the
proposed Site Plan and determined that there was adequate fire protection and
emergency access for the site; and
WHEREAS, on January 1, 2015, the Town of Southold LWRP Coordinator reviewed the
above -referenced project and determined the proposed project to be consistent with
Southold Town LWRP Policies with recommendations for additional landscaping and
the practices of on-site water quality controls; and
WHEREAS, on January 21, 2015, the agent to the applicant, Colin Ratsey, submitted
revised Site Plans sufficiently including the revisions required by the Southold Town
Engineering Inspector and the Planning Board; and
WHEREAS, pursuant to §280-133 C, the Planning Board has the discretion to waive
any or all of the requirements of § 280-133 by resolution at a duly noticed public
meeting, for those applications involving modifications to existing structures with no
substantial change to the existing footprint, where the Planning Board determines that
such modifications or any change in use will not require significant changes to existing
major site design features, as well as applications involving uses strictly related to
agriculture (but excepting retail winery operations), if it determines such requirements
are not necessary to protect and maintain the public health, safety, or welfare and to
further the objectives set forth in §280-129. The Planning Board has found that requiring
the entire set of Site Plan Application requirements for this site is not necessary to
further the objectives set forth in Town Code §280-129 and maintain public health,
safety, and welfare for the following reasons: the application is for a small office addition
(1,140 sq. ft.) being placed on an existing concrete pad; the office addition will not be
open to the public and will not increase the amount of employees on site; and
WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code
§280-131 B (5), has the discretion to vary or waive the parking requirements for Site
Plan Applications where doing so would not have a detrimental effect on the public
health, safety or general welfare, and will not have the effect of nullifying the intent and
provision of the Site Plan requirements chapter of the Town Code. The Planning Board
has found that this application is eligible for a waiver of parking requirements because
the office space and associated office employees are being moved from inside the

existing building to this new location to make more storage space inside the existing
building; and
WHEREAS, at their Work Session on January 28, 2014, the Southold Town Planning
Board determined that all applicable requirements of the Site Plan Regulations, Article
XXIV, §280 — 130 Site Plan Approval of the Town of Southold, have been met; and
WHEREAS, on February 6, 2015, the Southold Town Chief Building Inspector reviewed
and certified the proposed warehousing use as a permitted use in the Light Industrial
Zoning District pursuant to ZBA File #6801; therefore, be it
RESOLVED, that the Southold Town Planning Board hereby waives the following Site
Plan Application requirements:
§280-133 B(1)(f), B(1)(g) and B(1)(j); B(2)(d).

RESOLVED, that the Southold Town Planning Board grants Approval with One (1)
Condition to the survey for SCTM#1000-45-7-3, dated January 28, 2014, last revised
January 20, 2015, prepared by Nathan Taft Corwin III. The Chairman is hereby
authorized to endorse the Site Plan.
Condition:
1. To be fulfilled prior to the issuance of a Certificate of Occupancy: submit
an As -built Landscape Plan to be reviewed to the satisfaction of the
Planning Board. At a minimum, the Landscape Plan must include a
vegetated, landscaped buffer along Moores Lane to break up the mass of
the building. Native, drought tolerant plants are required and note that any
large trees planted within the buffer must be "wire -friendly" due to utility
poles and wires located in the Town of Southold right-of-way.

location (all concealed within the pole), along with 300 sq. ft. proposed within an existing
building for associated ground equipment on 6.9 acres in the Light Industrial Zoning

for the renovation and conversion of an existing 60' x 40' (2,400 sq. ft.) masonry
building, formerly a machine shop, to a 16 seat take-out restaurant with six (6) parking
stalls on .33 acres in the LB Zoning District. The property is located at 41150 CR 48,

and bathrooms to the existing farm stand on 27.5 acres (2 acre reserve; 25.5 acres
DRT) in the AC Zoning District. The property is located at 4735 Cox Lane, ±550' s/e/o

WHEREAS, this Amended Site Plan is for the proposed construction of a 24 x 42 (1,008
sq. ft.) steel building for cheese making to be connected to an existing agricultural
building by a 10 x 12 breezeway and add kitchen and bathrooms to the existing farm
stand on 27.5 acres (2 acre reserve; 25.5 acres DRT) in the AC Zoning District,
Cutchogue; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), has determined that the
proposed action is a Type II Action as it falls within the following description for 6
NYCRR, Part 617.5(c)(3) agricultural farm management practices, including
construction, maintenance and repair of farm buildings and structures, and land use
changes consistent with generally accepted principles of farming. The action is for the
construction of a 24' x 42' (1,008 sq. ft.) metal cheese making building accessory to an
existing farm operation including livestock production, general farming and a farm stand;
be it therefore
