BOMBARA #6758 SCTM#1000-54-4-19 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards and was recommended as INCONSISTENT to the Board of Trustees and Town Board. Both boards ultimately issued conditional approvals for the action; The Town Board issued a variance from Chapter 111 (Coastal Erosion Hazard Area) requirements on January 4, 2011 following a Board of Trustee denial of the original action. The Board of Trustees, issued a Chapter 275 (Wetland Permit) and Coastal Erosion Permit on October 17, 2012 for the action. The issuance of the Town Board Chapter 111 variance and Board of Trustees Chapter 275 and Chapter 111 permits required that the action be rendered as consistent with the Town of Southold Local Waterfront Revitalization Program. Consequently, the policies listed to recommend the action as inconsistent were addressed in each approval. Since the approvals include the natural protective features identified in the Chapter 280 definitions of "buildable lands", it is recommended that this board refer to the coastal consistency determinations in the past decisions. As discussed above, Exhibit A in the Board of Trustees Chapter 111 permit outlines six conditions that are included below: 1. All structures and construction occur a minimum of 8 feet from the landward toe of the primary dune depicted on the site plan prepared by Young & Young dated September 21, 2010 2. The erection of a project limiting fence and staked hay bales along the limits of clearing, grading and ground disturbance prior to the commencement of construction and maintained until completion of construction. 3. The undisturbed portion of the site shall be maintained as a non -disturbance buffer. 4. All cleared areas not built upon must be restored with native, non -fertilizer -dependent vegetation and maintained as a landscape buffer. 5. No pesticides, fertilizers, or similar chemicals shall be permitted on site. 6. The installation of leaders, gutters, and drywells to control runoff from the proposed structures. Conditions one through three are included on the site plan dated as last revised April 23, 2013, however, the site plan only references the non -disturbance buffer in writing and does not show the limits of the buffer. Conditions four through six are not referenced on the site plan. It is recommended that the Board consider requiring: 1. That the non -disturbance buffer be delineated and labelled on the site plan. 2. That all permit conditions be filed in a covenant and restriction and recorded with the Office of the Suffolk County Clerk. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Danowski, Jr., Esq. on behalf of ROBERT & MARGARET BOMBARA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated September 18, 2012, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and specifically inconsistent with the following coastal policies: Policy 4.1 - Minimize losses of human life and structures from flooding and erosion hazards, 4.2 - Protect and restore natural protective features, Policy 6 — Protect and restore the quality and function of the Town of Southold ecosystem, and Policy 6.3 — Protect and restore tidal and freshwater wetlands, and, WHEREAS, the Board of Trustees has furthered the Policies of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the closest part of the structure is ±180' landward of the approximate high water mark; the New York State Department of 2 Environmental Conservation has already reviewed and issued a permit for the proposed project; the possibility of flooding in the area of the proposed project is minimal; the applicant was granted relief by the Southold Town Board under the Coastal Erosion Hazard Area regulations; the undisturbed portion of the site shall be maintained as a Non -Disturbance Buffer, there shall be no structures beyond the project limiting line located eight (8) feet landward of the landward tow of the most landward beach ridge, as shown on the survey; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 17, 2012, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not detrimentally affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of ROBERT & MARGARET BOMBARA to construct one single-family residence, pool, and associated water supply, sewage disposal facilities, and a 4' wide access path to the water, with the condition that there be no structures beyond the project limiting line located eight (8) feet landward of the landward toe of the most landward beach ridge, as shown on the survey; and as depicted on the survey prepared by Young & Young, last dated August 23, 2012, and stamped approved on October 17, 2012. With over 100 road ends terminating at creeks, bays, inlets, or Long Island Sound, as well as all of the lawns and homes lining our miles of shoreline, 100's of thousands of gallons of storm water runoff enters our wetlands every year. Carrying sediment that prevents sunlight from reaching aquatic plants, nutrients from animal waste and lawn fertilizers that promote algae blooms detrimental to shellfish, and bacteria and other biologicals that in high doses can be harmful to swimmers, storm water runoff is one of the Trustees main public safety concerns. So important, in fact, that Southold has a Storm Water Management Code. Southold Town's Chapter 236 provides an outline for how people need to deal with storm water runoff from their properties. For example, new construction or renovation is required to contain any potential runoff to the wetlands from the construction by installing hay bales and silt fencing. This acts as a barrier and keeps our wetlands clean. Another example in Chapter 236 is that every building must, have provisions to collect and disperse, ON-SITE, at least a 2 inch rainfall. This is usually handled by installing gutters; leaders and drywells to the home. The Trustees also have a standing policy of requiring pervious non -turf buffers along bulkheads and at tops of bluffs that help keep run off from entering themetlands and prevents erosion to bluffs. These are important measures to keep our wetlands safe.and clean! I also provide a copy of the definition of "open space" contained in the definition section as well. I would also point out that the issuance of the Coastal Zone Erosion Permit, the concomitant "Tidal Wetlands Permit", CAC recommendation of approval, NYS DEC permit and the Health Department stamp of approval allow the issuance of the permit despite any suggestion. of inconsistent other definitions in the Town code. Certainly until the Coastal Erosion permit issued, the Building Department could take the position, as it had, that it could not process the building permit application. The fact that the Coastal 0 Erosion permit has issued makes the lot buildable in the area proposed on the building permit survey plans. As discussed, a chronological history of my client's application began with the preparation of building permit survey plans prepared consistent with zoning set back provisions. My client, upon being advised that he needed to file an application with the Town Trustees, began that application process in October of 2006. have provided a thumbnail sketch of the history on this project. You will note the Town Trustees as well as the Town Board were involved in the application and approval process, which resulted in the issuance of the Tidal Wetlands and Coastal Erosion permits.
