OSBORN #6773 - Request for Variances from Articles XXIII, XXII and III, Sections 280-124, 280-116B and 280-14 (Bulk Schedule) and the Building Inspector's August 7, 2013, amended and renewed May 19, 2014, amended June 2, 2014, amended July 14, 2014 Notice of Disapproval based on an application for building permit for partial demolition, reconstruction, additions and alterations of an existing single family dwelling, at; 1) less than the code required front yard setback of 35 feet, 2) less than the code required rear yard setback of 35 feet, 3) less than the code required single side yard setback of 10 feet, 4) less than the code required combined side yard setback of 25 feet, 5) more than the code permitted maximum lot coverage of 20%, 6) less than the code required bulkhead setback of 75 feet, 7) more than the code permitted 2.5 stories, located at: 1200 First Street (adj. to Great Peconic Bay) New Suffolk, NY. SCTM#1000-117-7-30 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that; The proposed 1) less than the code required front yard setback of 35 feet, 2) less than the code required rear yard setback of 35 feet, 3) less than the code required single side yard setback of 10 feet, 4) less than the code required combined side yard setback of 25 feet are EXEMPT from LWRP Coastal Consistency Review. The proposed construction more than the code permitted 2.5 stories is proposed to render the structure flood zone complaint and is therefore CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. In regard to the proposed construction of the structure more that the code permitted 2.5 stories Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards; applies. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: d. sites where relocation of an existing structure is not practical. The subject parcel is located within the FEMA flood zone VE el 8 (velocity hazard) and the remainder area is located within the flood zone AE el 6 (see Figure 1. below). Both flood zones pose a high flood risk. The VE flood zone is an area inundated by 1% annual chance flooding with velocity hazard (wave action). AE mapped properties have a 1 percent annual chance of flooding and a 26 percent chance of flooding over the life of a 30 year mortgage. Figure 1. Subject structure shown in the VE and AE Flood Zones. Based on the location and size of the parcel, there is no ability to relocate the structure outside of the flood zones. The applicant is requesting a variance for 65% lot coverage, more than the code permitted maximum lot coverage of 20%. Due to the risk of flood hazards and repetitive loss in these areas, the construction of non -water dependent, structures in these areas is not supported by the LWRP and therefore is INCONSISTENT with the policy standards and therefore INCONSISTENT with the LWRP. Further the less than the code required bulkhead setback of 75 feet is also INCONSISTENT with the LWRP. The less than 75' distance from the bulkhead places the structure in flood hazard areas, however, as indicated above the relocation of the existing structure is not practical and therefore to further the policies the structure will be reconstructed to meet FEMA regulations. In the event that the actions are approved, it is recommended that the Board determine the specifications of the three drywells shown, the purpose of the drywells, depth to groundwater in the vicinity and if the drywells will be removed/relocated as a part of this application. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
