That the said Board of TrUStees and the Town of Southold are released from any and all damages, or c/alm~ for damages, of suits arising directly or indirectly as a result of any oper. ation performed pursuant to this permit, and the said Permittee will, at his or- her own expense, defend any and all guch suits initiated by third parties, and the said Pe~ngttee assmms full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit should be retained indefinitely, or as long as the said Pe~aiittee wishes :to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained. 4. That .the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstrocnon to tree navigation, the said Perm;tree will be requlred~ upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. 8. On behalf of Mr. Braider, it is respectfully requested that the hearing be re-opened to permit Mr. Braider, or his representative, to be heard, as provided for in Section 97-32 of the Code of the Town of Southold (hereafter, "Town Code"). Briefly, Mr. Braider was served with a Notice of Violation dated April 24, 1992 and filed on April 27, 1992 with your office. Within 10 days of that Notice's filing, Mr. Braider sought permission from this Board for the boat cover. Based upon review of this Board's file, Mr. Braider's letter was filed directly after the filing of the Notice of Violation, which was prepared by Bay Constable Dzenkowski. · The letter of Mr. Braider should have been treated as a request for a hearing, as outlined in Section 97-32 of the Town Code. Pursuant to that section, the applicant or his representative must be given an opportunity to be heard. This procedure was not adhered to by this Board. It is respectfully requested that this Board grant the applicant an opportunity to show cause why such notice should be modified or rescInded. The reasons for this denial discussed at the meeting were: I. Our permission for you to construct a dock in the first instance was a liberal interpretation by this Board of the zoning Code in that the Town Code re,aires a principle residence on your property before you are granted a dock approval. We believe you donot have a principle residence on your property. 2. The recently approved ~mendment permitting you to enlarge your dock places it among one of the largest structures ever approved in Southold for over public land. Much discussion was had whe~ we recently approved this exp~nsion~ we didso reluctantly and modified your request reducing the: size of the structure from what was pro~osedo 3. The Trustees know of no other boat houses in Southold Town and do not wish to establish a precedent for such structures which we believe excessively cover our property and may diminish marine productivity of the waterways we steward for the people of the Town. As the Board has properly concluded its consideration of you~ request for this structure, we must now request that you remove this structure within 30 days of this letter. Absent voluntary removal of this structure we will be left no alternative but to proceed with legal action in this matter. May we suggest you~ check with the building department such that you might be able to continue use of this structure as an attack~ent to you existing land based boat house~ If you should have any ~aestions surrounding this matter~ please do not hesitate to call. It never occured to me that this cover would require a permit. Z understand after visiting your office on Friday that an amendment to my permit is necessary to include this cover~ Please consider this letter a request for that amendment, since i would like to continue using the cover during the summer. I plan to leave the top on during the summer and roll up the sides. During the winter, of course, the sides will come down. I have enclosed the necessary $35 fee as instructed. The permittee is to move the crescent shaped northerly e e section of the retaining section approximately ten feet (10') landward so it is placed at the edge of the lawn at the topographical crest of the bluff and not in the vegetated wetlands below. There shall be NO injury to high tide bush or Spartina species in that section. The remaining structure shall be built as per plan of J.M.O. Consultant. The applicant is to install a drywell(s) for roof runoff from the storage building as discussed with Mr. Braider. Ail un-vegetated sections of the beach except for twenty feet (20') of the applicants choice shall be replanted with Spartina alterniflora in a five foot (5') wide swath starting at M.H.W. Plants shall be on 12" centers maximum spacing. There shall be an additional inspection of the revegetation and aforementioned amendments with a fee of thirty-five ($35.00) due now. This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid, if applicable, and pezmit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. AUGUST 23, 1990 The North Fork Environmental Council requests that the application be denied and that the applicant follow the recommendations of the Conservation Advisory Council. We are concerned that this application received a negative declaration Under SEQRA. Due to the potential for distUrbance to threatened or non-threatened species on site, and due to the potential for cumulative impac~t on Gull Pond generally, we believe'that either a positive declaration or a conditioned negative declaration should have been issued. Gull Pond is a sheltered body 'of water and normally does not · experience wave/tidal action necessitating such a large str'ucture as proposed. Indeed, it is our understanding that if Gull Pond were to experience a storm surge, wave energy would "bounce" off the retaining wall and damage other beach and marsh areas. It therefore makes more sense to re-vegetate currently eroded areas belongiing to the applicant in order to absorb intermittent storm surges. We believe erosion Control for this situation can be more effectively achieved through the use of plantings of spartina and other salt-tolerant vegetation native to the North Fork. Additionally, the upland portion of the applicant's property should be thoroughly evaluated to determine possible origins of erosion. If erosion is originating on the upland portion of the property, a planting scheme should be developed and implemented there also. We believe that this technique would not. only be a benefit to the natural environment of Gull Pond but would also be much less expensive for the applicant.
