Dear Mr. Boutis:
The following action was taken by the Board of Trustees during
their recent meeting held on February 26, 1987 regarding the above
referenced Hroperty.
Moved by Trustee Bredemeyer seconded by Trustee Goubeaud
WHEREAS, the Board has carefully considered all the documentation
submitted concerning this request, and
WHEREAS, the Board members have personally viewed and are familiar with
the premises in question, and the surrounding area, and
WHEREAS, the Board made the following findings of fact.
1. By this request appellant requests a WAIVER of the Wetland
Ordinance in accordance with Article II, Section 97-22 to
construct a basement under an existing dwelling approximately
40' x 27'.
2. The property in question is located on Ruch Lane, Southold,
New York; more particularly known on the Suffolk County Tax
Map as: 1000-52-2-33.
In considering this request the Board also finds and determines:
1. The project will not adversely affect the wetlands of the Town.
2.The project will not weaken or undermine the lateral support
of other lands in the vicinity.
3. The project will not otherwise adversely affect the health, safety
and general welfare of the people of the Town.
NOW, THEREFORE BE IT
RESOLVED that Ed Boutis BE AND HEREBY IS GRANTED A WAIVER OF THE WETLAND
ORDINANCE AS REQUESTED TO CONSTRUCT A BASEMZNT UNDER AN EXISTING RESIDENCE
SUBJECT TO THE FOLLOWING PROVISIONS:
1. Care is to be taken so as to preclude the entry of any construction
material into the adjacent water.
2. Immediately following construction, all areas of exposed soil shall
be vegetated to prevent entry of eroded soil into the waters.
Please take further notice that this determination is not a declaration
Gentlemen:
On December 16, 1986, I purchased a waterside cottage
built on oak posts on Ruth ~ne (four%h house from the
end of block) in Soathold. The Northfolk Bank and Trust
Oorp. gave me a constru~on loan which will convert to a
regular home mortgage when certain conditions are met. I
must winterize the cottage by putting a full-basement un-
der the existing cottage. I must put in an oil-fired hot
water heating system. I also must upgrade the electical
system which currently brings in only 60 amps.
Many other ~omeowners on Ruch Lane have full-basements.
The next-door neighbors, ~r. & ~rs. Brown have a full-
basement and they are the same distance from the high
water mark-about 66 feet.
I am acting as my o~ contractor. ~r. Gene Mazzafero
will do the mason work on the basement. ~ickey Dawson
will be the plumber and Paul Burns will do the electmical
worK.
I am anxious to have the work begin as soon as possible, so
my family and I can use the home. I am also operating under
a time constraint from the bank. I would like the building
loan to convert to a regular mortgagee soon, to take advantage
of the current favorable interest rate.
I am asking Southold To~ Trustees for a waiver spproval~
since the work will be under and inside of the existing
cottage. Thank you,
