Dear Sir;
In response to your visit to my home tcday and the questions
~aised, I distinctly remember visiting your prg~erty on the South
s~d eef Bay Ave ( generaly kno~ as Sk..nk La~e") with the Board of
Appeals on several occasions.
One of the visits - I am not shuts of the wxact date- we looked
at the two lots you proposed to set off and the "Marina" which you
proposed to keep. 9he Board a='reed that there was land enough to
make two legal building lots, an -6~'~ar na~a~ .~t 'w~s.
Some time later I remember advislug you to get Heslth Dept.
approval for wells and cesspool~ on each lot as there we?e some chang~es
being proposed in both Health Dept and environmental requirements~
Further I remember seeing these a..~pro'vals for both lots, and
walking over them and measuring them to check out the survey dimentions.
I believe that I wrote yo~ a letter thereafter - ~.~a~n [ am
not shur~ of the exact date- stating these were two legal and 'usable
lots under our r~quirements,, you could sell either one or bo~h and
get building per,~lts for one £a~lly dwellings.
There should be ooples of the le%te~ and board ,' ~'~'

Dear Mr. Petrucci:
As you know, your business on the south side .of Bay Avenue, Cutchogue,
New York, is classified as a non-conforming marina or boat basin.
According to our present zoning ordinance, a non-conforming use is any
ese, wheLher of a building or tract of land, or both, existing on the
effective date of the zoning ordinance, which does not conform to the
use regulations of the district in which it is located. The definition
of a marina is any premises containing one (1) or more piers, wharves,
docks, moorings, bulkheads, bulxd~ng , slips, basins or lands under
water, designed, used or intended to be used primarily for the docking
or mooring of boats, for or without compensation.
Using your letter of May 17, 1978, and the above definitions as a gui~e,
it seems to us 5hat your non-conforming marina includes the following:
The seasonal operation of a marina or boat basin with docks or slips for
not more than thirty-five (35) non-commercial boats not more than 24 feet
In length. Special services for owners such as fresh water, electricity,
cil and gasoline are also permitted. We think that this serv~,ce barge
is an integral part of your marina operation and may be stored on your
?roperuy when not in .use.
You are not permitted to store boats, build boats or conduct the retail
sale of boats on your premises.
Ho~efuily, this clearly defines all permitted uses for your property. If
there are any other questions~ please bring them to our attention.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter~ permission from the owner of the property if-not
the same as the applicant.
B. Pilot Plan must be drawn to scale on the reverse ~_ide of this application showing the location
of property, the names and locations of owners of adjoining properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
lo the Permit Application.)
C. No operation shall be initiated by the applicant until oJJ permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the'
work is completed must be given, including a survey if required.
E. If permit is being sought.for a more sizeable excavation l'han the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
.Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits hove been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revoked or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection.
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request~. ~/e applicant for a permit, may waive in whole or in part.
