With regard to Bingham, we received the attached from the Health Dept. It is a preliminary approval. It reads at the bottom, "Your residential construction proposal.... appears acceptable pending review of your Town of Southold Trustees approval. Please submit a copy of your entire Trustees permit for review by this office." So it looks like the health dept. has approved the septic, but they need a copy of Trustees permit? (We're back to the same catch-22!). Is this enough of an approval from the health dept. to get us over that hurdle? Thanks very much for your help with this. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may berequired supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. Fitzgerald on behalf of W. RICHARD & WENDY BINGHAM applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 17, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the permit is to not to be issued until Town Engineering Department submits an approval on the proposed drainage and sanitary system; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 17, 2014, at which time all interested persons were given an opportunity to be heard, and, • WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of W. PROPERTY FACTS/DESCRIPTION: The applicant's property is an irregularly shaped, .58+/- acre waterfront parcel in the R-80 zone. The northerly lot line borders Fishers Island Sound. Page 2 of 3 — November 20, 2014 ZBA#6802 — Bingham SCTM# 1000-6-4-2 BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and Article XXII Section 280-116A(1) and the Building Inspector's September 17, 2014 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling, at; 1) less than the code required front yard setback of 40 feet, 2) more than the code permitted maximum lot coverage of 20%, 3) less than the code required bluff setback of 100 feet. RELIEF REQUESTED: The applicants requests variances to construct a proposed addition with a front yard setback of 1 foot where 40 feet is required by Code, lot coverage of 22.2% where 20% is allowed, and setback from the bluff of 54.8 feet where 100 feet is required. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on Nov. 6, 2014 submitted a site plan reducing the proposed lot coverage from 24.4% to 22.2% and increasing the bluff setback to 54.8 feet from the 41.5 feet as originally proposed, bringing the plan into more conformity with the codes. On Nov. 17, 2014 the applicant's architect submitted another revision to the site plan, as shown on site plan dated 14 October 2014 and stamped REVISED 11/13/14 that increased the proposed front yard setback from one (1) to two (2) feet at the closest point and three (3) feet at the next closest point, thereby bringing the plan into more conformity with the codes. The applicant's revised site plan also shows a new design for the proposed addition that presents a profile that has less visual impact and more front yard setback in relation to Central Ave. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This single family dwelling was constructed in 1903, before the introducton of zoning code, as one of three almost identical dwellings known as the "three sisters". Additions and alterations have been made to the other two "sisters." The closest neighboring dwelling in view of the proposed new addition is located approximately 175 feet away, diagonally across Central Ave. A second neighboring dwelling with a possible view of the applicant's new addition is located approximately 200 feet away, also diagonally across Central Ave. The waterfront views of these neighboring properties are not impacted by the applicant's proposed construction. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's dwelling was constructed before zoning code, with an existing front yard setback of approximated 10 feet, and a bluff setback of approximately 30 feet. The proposed addition cannot be built without the grant of variances. 3. Town Law 1267-b(3)(b)(3). The variance granted herein for a front yard setback is mathematically substantial, representing +/- 95% relief from the code. However, dwelling was built prior to zoning code with an existing front yard setback of 10 feet, and because of the irregular shape of the applicant's parcel, and the proximity to Central Ave., the proposed addition cannot be constructed without a further reduction to the front yard setback. There is an approximate 7-8 feet of existing hedgerow providing a vegetative buffer between the property line and the asphalt of Central Ave. The variance granted herein for lot coverage of 22.2% is not mathematically substantial, representing approximately 11% relief from the 20% allowed by code. The variance granted herein for setback from the top of the bluff of 80 feet for the proposed addition is substantial representing 20% reduction from the 100 feet required by code. However the existing dwelling has a 55 feet bluff setback, and the proposed addition is setback another 25 feet further from the bluff. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and all other applicable regulations. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267 -b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
