Dear Mr. Vandenburgh:
It has been brought to the attention of this office that on July 4, 2014, during a special
event that was held on your property under Special Event Permit #WP 271, a violation occurred
to condition number 6 as stipulated in that permit, specifically the occupancy by guests attending
the event of a building for which no CO had been issued. We understand that a meeting between
you and Fire Marshall Bob Fisher took place and an agreement was reached to ensure your future
compliance with this and all the other required conditions listed on the Special Event Permit.
Be advised that this violation is sufficient cause for revocation and denial of future
Special Event applications. However, personal inspections of the events on your property that
took place this past weekend confirmed that the events were well organized and orderly and the
terms of the conditions imposed were adhered to. As a result I am issuing your Special Event
Permit request for the events planned for July 18, 19, 20 and 25, 26, 27, 2014. A duplicate of this
permit must be continuously posted during each of the events. This permit is conditionally
granted, based on information supplied in the application. Although we are accepting 6 dates on
one application form, since these dates all occur within three months of your previous multiple
dates application, the required fee will be $150 per date, pursuant to Chapter 205 "Public
Entertainment and Special Events" of the Town Code. After the July 27"' date, additional Special
Event Permits can only be issued when a site plan of your property has been approved by the
Town Planning Board.
There are several conditions written into the permit that must be observed. Please be
aware that under the State Fire Code, the number of persons occupying the building and/or tent
area is limited. The use of a tent will require an application and approvals at least three days
before the event, from the Building Department. A Town Building Inspector must inspect the
tent, before occupancy. They can be reached at 765-1802 between the hours of 8 a.m. and 4 p.m.
All parking and traffic controls are the responsibilities of the event operators, and their
agents. Note that parking on any County or State Roads are not authorized under this permit.

Any violations of this permit can be cause for revocation. The Town also reserves the right to
revoke any permit or deny future permits if the event(s) generates unforeseen impacts to the
health, safety or welfare of residents and guests of the Town.

A Parking/Event Plan may be a survey, site plan and/or aerial view (for example Google Earth) of
the subject property. INDICATE ON THE PLAN ALL of the following information:
A parking/event plan showing:
(1) The size of the property and its location in relation to abutting streets or highways.
(2) The size and location of any existing building(s) or structure(s) that will be in operation
during the course of the event and any proposed building, structure, or signs to be erected
temporarily for the event.
(3) The location of the stage or tents, if any.
(4) The designated areas of use for spectators, exhibitors, vendors, employees and
organizers.
(5) Location of all exits.
(6) The location of all fire extinguishers and other fire safety equipment.
(7) The location of all temporary utilities to be installed for the event, if any.
(8) The layout of any parking area for automobiles and other vehicles and the means of
ingress and egress for such parking areas. The parking spaces must allow for 300 sq. ft.
per car.
(9) A traffic control plan for vehicles entering and leaving the site for the proposed event.
(10) Plan for the use of live outdoor music, loudspeakers and other sounds which will be used,
if any, and the type and location of speakers and other audio equipment.
(11) A description of emergency access and facilities related to the event.
(12) Provisions to dispose of any garbage, trash, rubbish or other refuse.
(13) Location and description of any additional lighting to be utilized in conjunction with the
event.
(14) Location of sanitary facilities on site.
Traffic Control Plan
Events for three hundred (300) or more people also require submission and approval of a traffic control plan,
acceptable to the Town of Southold, AND a qualified traffic controller must be provided. Please attached a written
description and/or notate on the parking event plan the following: 1. who will be conducting traffic, 2. where they
will be stationed on site, 3. how they will direct the entrance, circulation, parking, and exiting of cars on site, and
4. contact information for use by Southold Town Police.

PERMISSION IS HEREBY GRANTED, SUBJECT TO THE FOLLOWING CONDITIONS:
1. By acceptance of this permit, applicant agrees to adequately supervise and direct all parking to be on the
premises or at another site, and to provide parking assistants and any additional traffic controls necessary for this
event. Parking is strictly prohibited on ANY Town, County or State Roads or Rights of Way.
2. Traffic control at events for three hundred (300) or more people shall be provided by a qualified traffic controller
in accordance with the attached, approved traffic control plan.
3. One "on -premises" sign not larger than six (6) square feet in size may be displayed not lcVgCEDfAXhirty (30)
days before this event, and removed immediately after the event. Directional parking signs shall be adequately

4 Applicant indemnifies and holds harmless the Town of Southold from all claims, damages, expenses, suits and
losses including but not limited to attorney's fees arising from activities under this permit.
5. Tent proposals must receive permit approval from the Southold Town Building Inspector before placement on
the property and must meet all fire and safety codes.
6. This permit is valid only for the time, date, place and use specified above, and for the designated event. Each
additional day will require a separate permit application, fee, and related documents for review, etc. at least 60
business days prior to the scheduled event.
7. Adequate temporary sanitary facilities must be provided by applicant for this event and applicant agrees to
remove the temporary facilities from the premises within 48 hours after the day of the event.
8. On-site food preparation is NOT permitted, although food may be catered subject to all Suffolk County
Department of Health regulations.
9. NO activities associated with this event including but not limited to parking ingress/egress/access,tent(s) or
temporary structures) or temporary sanitary facilities shall be conducted on Town of Southold Purchase of
Development Rights land.
10. NO activities associated with this event including but not limited to parking ingress/egress/access tent(s) or
temporary structures or temporary sanitary facilities shall be conducted on Suffolk County Purchase of
Development Rights land without a permit issued by the Suffolk County Farmland Committee.
11. Issuance of this permit does not authorize in any manner the occupancy of any building exceeding the legal
limitations under the fire code or other codes which would prohibit such increased occupancy.
12. Access shall be provided for emergency vehicles, to all public assembly areas, all buildings, all work areas and
any additional area where emergencies may occur. Two emergency -fire exits and exit paths from the building(s) on
the property, to a public way or remote safe area, shall remain open and unobstructed at all times.
13. Owner assures that all fire, safety, building, and other laws will be complied with.
14. Music, when outdoors, is required to stop at the time specified in the permit. Placement of the speakers must be
in a location that affords the greatest protection from noise intrusion upon adjacent properties.
15. ADDITIONAL CONDITIONS:
1. No offsite parking is permitted. All event parking must be on site. Parking along Peconic Lane or Rt. 25 for
this event is not allowed
2. Parking attendants must be stationed at each driveway entrance to the subject property during event hours
to guide cars to parking areas.
2. No left turns onto Rt. 25 from the subject property are permitted (Right Turn only). The parking attendant
stationed at the Rt. 25 driveway entrance/exit shall inform existing event patrons that they cannot make a
left turn. A sign stating RIGHT TURN ONLY shall be visibly posted at the Rt. 25 exit.
4. No public access to buildings on site that do not have a certificate of occupancy is permitted.
5. Noise generated onsite must conform to the Southold Town noise code.
6. This permit is granted only for the dates requested herein. Consideration of requests for other dates prior to
site plan approval of the subject property by the Planning Board will be based upon the applicant's ability
to demonstrate successful compliance with the conditions imposed herein.
7. The Town reserves the right to revoke this permit or deny future permits if the event(s) g0eFItE01y
unforeseen impacts to the health, safety or welfare of residents and guests of the Town.

Dear Ms. Weisman:
I am respectfully requesting an expedited review of our enclosed Special Event
Permit application. I was hoping that we would have an agreement for final site plan
approval before we reached July 18, 2014, however, the Planning Board has asked for
additional revisions to our plan and a change in our driveway entrance that we are working
to resolve. In addition, I realize that the timing of our request would normally create a late
fee, however, with the good faith efforts we are trying to pursue with all agencies, I am
asking for a waiver of that late fee, as I did not know until earlier this month that these
applications would be necessary.
While we continue to address the changes most recently asked for by the Planning
Board, we are also faced with the critical reality that the summer season is quickly passing
us by and we are not poised to withstand the significant financial detriment that the
lengthy and protracted planning process has taken. As I am sure you can understand, my
partner John Liegey and I have invested every penny we have in this project and are in dire
need to open for some limited periods of time to allow us to capture some portion of the
summer season that is now upon us. We are hopeful that we will have a final approval for
the next Planning Board meeting in August.
We had a low key and well mannered holiday weekend over the 4th of July and there
were no issues with parking, ingress or egress of vehicles or unruly behavior.
The nature of the requested events is to simply to celebrate the third and fourth
weekend of our new location. It does also happen to be an Asteroid-Occulation weekend

starting on the through the 20th of July where there are certain astrological highlights
in the evening sky. The weekend of July 25, 26 and 27 is significant because we will be
releasing our first Peconic made beer for tastings and purchase.
We would continue to endeavor to follow all of the same conditions and
requirements that are imposed with an eye to ensure the safety, well being and orderly
behavior of our guests for that weekend.

PARKING PLAN / EVENT PLAN
In connection with our application for a Special Event permit, please refer to the attached satellite
image of the property for further reference. The address of the property is 42155 Main Road, Peconic.
Our property is 2.89 acres in size. It abuts both the Main Road (Rt 25) and Peconic Lane. We plan to
hold the event outdoors in the rear grassy area of our property and under tents that have been rented for
the purpose of this event schedule.
We will have signs directing traffic flow as well as restroom location. There will be a perimeter
fence erected on the North and Eastern portions of the property that will attempt to restrict attendees from
moving onto our adjoining vineyard property. The location of the tents are depicted on the attached
image and will be open sided tents with egress from all sides. The purpose of the tents is to provide
shelter and shade from sun or weather. The main location designated for attendees will be in the grassy
area located on the north-east portion of the property.
We anticipate that we will never have more than 300 guests in attendance at any one time.
Security will be provided by Platinum Executive Security (PES) and Wayne Sailor on all dates. Platinum
Executive Security is a duly licensed Watch Guard and Patrol agency in the State of New York (License
#11000141500), and is duly insured with the Mechanic Group, Inc. Wayne Sailer 631-300-8745 is the
main contact for PES.
PES will provide (1) Supervisor and up to (4) security/parking personnel on each date. They will
insure that all traffic arriving from the Peconic Lane and Main Road entrances will be moved quickly and
safely into the designated parking areas. A clear fire lane will also be established at both the Peconic
Lane and Main Road entrances from those roads with a free run to the event tenting area. In the event of
an emergency situation, personnel will contact the proper agency and direct them to that location.
INGRESS Traffic: Guests arriving from Peconic Lane and the Main Road will be directed by PES
Parking Personnel in marked safety vests and radio communication and will direct arriving guests to the
parking area via the 35 foot wide entrances at each parking lot location. All vehicles will be self parked
in a neat and organized row by row fashion.
EGRESS Traffic: All departing guests will be guided by PES Parking Personnel onto Peconic and
Main Road in an orderly and controlled fashion so as not to create a traffic congestion situation. PES
Parking Personnel will have safety vests, lights and radio communication directing departing guests. The
Southold Police will maintain full traffic control of the Public roadways, and PES will assist but will not
be working on any public streets or roadways.

I stopped at Greenport Brewery in Peconic, I believe on Saturday July 5, and spoke to Mr. Vandenburgh about the use of
the building. I reminded him that without a Certificate of Occupancy the building was not to be used. He replied that he
anticipated moving serving tables to the front, by the overhead doors, so the public would not have access to the
interior. I drove by later and he had indeed done what he had said he would do. I will continue to watch the future
activities on this site.
