Dear Mr. Vandenburgh:
Enclosed is the Special Permit for the event planned for July 3rd — July 6`h and July 11`h —
July 13, 2014. A duplicate of this permit must be continuously posted during the event. This
permit is granted as applied for, based on information supplied in the application.
There are several conditions written into the permit. Please be aware that under the State
Fire Code, the number of persons occupying the building and/or tent area is limited. The use of a
tent will require an application and approvals at least three days before the event, from the
Building Department. A Town Building Inspector must inspect the tent, before occupancy, they
can be reached at 765-1802 between the hours of 8 a.m. and 4 p.m.
This permit does not authorize parking on Suffolk County Right of Way located in front
of the property or any lands owned by County of Suffolk, Town of Southold or Peconic Land
Trust. All parking and traffic controls are the responsibilities of the event operators, and their
agents. Note that parking on any County or State Roads are not authorized under this permit.
Any violations of this permit can be cause for revocation. The Town also reserves the right to
revoke any permit or deny future permits if the event(s) generates unforeseen impacts to
the health, safety or welfare of residents and guests of the Town.

A Parkin2/Event Plan may A survey, site plan and/or aerial view (example Gooale Earth) of
the subiect property. INDICATE ON THE PLAN ALL of the following information:
A parking/event plan showing:
(1) The size of the property and its location in relation to abutting streets or highways.
(2) The size and location of any existing building(s) or structure(s) that will be in operation
during the course of the event and any proposed building, structure, or signs to be erected
temporarily for the event.
(3) The location of the stage or tents, if any.
(4) The designated areas of use for spectators, exhibitors, vendors, employees and
organizers.
(5) Location of all exits.
(6) The location of all fire extinguishers and other fire safety equipment.
(7) The location of all temporary utilities to be installed for the event, if any.
(8) The layout of any parking area for automobiles and other vehicles and the means of
ingress and egress for such parking areas. The parking spaces must allow for 300 sq. ft.
per car.
(9) A traffic control plan for vehicles entering and leaving the site for the proposed event.
(10) Plan for the use of live outdoor music, loudspeakers and other sounds which will be used,
if any, and the type and location of speakers and other audio equipment.
(11) A description of emergency access and facilities related to the event.
(12) Provisions to dispose of any garbage, trash, rubbish or other refuse.
(13) Location and description of any additional lighting to be utilized in conjunction with the
event.
(14) Location of sanitary facilities on site.
Traffic Control Plan
Events for three hundred (300) or more people also require submission and approval of a traffic control plan,
acceptable to the Town of Southold, AND a qualified traffic controller must be provided. Please attached a written
description and/or notate on the parking event plan the following: 1. who will be conducting traffic, 2. where they
will be stationed on site, 3. how they will direct the entrance, circulation, parking, and exiting of cars on site, and
4. contact information for use by Southold Town Police.

PERMISSION IS HEREBY GRANTED, SUBJECT TO THE FOLLOWING CONDITIONS:
1. By acceptance of this permit, applicant agrees to adequately supervise and direct all parking to be on the
premises or at another site, and to provide parking assistants and any additional traffic controls necessary for this
event. Parking is strictly prohibited on ANY Town County or State Roads or Rights of Way.
2. Traffic control at events for three hundred (300) or more people shall be provided by a qualified traffic controller
in accordance with the attached, approved traffic control plan.

4. Applicant indemnifies and holds harmless the Town of Southold from all claims, damages, expenses, suits and
losses including but not limited to attorney's fees arising from activities under this permit.
5. Tent proposals must receive permit approval from the Southold Town Building Inspector before placement on
the property and must meet all fire and safety codes.
6. This permit is valid only for the time, date, place and use specified above, and for the designated event. Each
additional day will require a separate permit application, fee, and related documents for review, etc. at least 60
business days prior to the scheduled event.
7. Adequate temporary sanitary facilities must be provided by applicant for this event and applicant agrees to
remove the temporary facilities from the premises within 48 hours after the day of the event.
8. On-site food preparation is NOT permitted, although food may be catered subject to all Suffolk County
Department of Health regulations.
9. NO activities associated with this event including but not limited to parking ingress/egress/access tent(s) or
temporary structures) or temporary sanitary facilities shall be conducted on Town of Southold Purchase of
Development Rights land.
10. NO activities associated with this event including but not limited to parking ingress/egress/access,tent(s) or
temporary structures) or temporary sanitary facilities shall be conducted on Suffolk County Purchase of
Development Rights land without a permit issued by the Suffolk County Farmland Committee.
11. Issuance of this permit does not authorize in any manner the occupancy of any building exceeding the legal
limitations under the fire code or other codes which would prohibit such increased occupancy.
12. Access shall be provided for emergency vehicles, to all public assembly areas, all buildings, all work areas and
any additional area where emergencies may occur. Two emergency -fire exits and exit paths from the building(s) on
the property, to a public way or remote safe area, shall remain open and unobstructed at all times.
13. Owner assures that all fire, safety, building, and other laws will be complied with.
14. Music, when outdoors, is required to stop at the time specified in the permit. Placement of the speakers must be
in a location that affords the greatest protection from noise intrusion upon adjacent properties.
15. ADDITIONAL CONDITIONS:
1. No offsite parking is permitted. All event parking must be on site. Parking along Peconic Lane or Rt. 25 for
this event is not allowed
2. Parking attendants must be stationed at each driveway entrance to the subject property during event hours
to guide cars to parking areas.
2. No left turns onto Rt. 25 from the subject property are permitted (Right Turn only). The parking attendant
stationed at the Rt. 25 driveway entrance/exit shall inform existing event patrons that they cannot make a
left turn. A sign stating RIGHT TURN ONLY shall be visibly posted at the Rt. 25 exit.
4. No public access to buildings on site that do not have a certificate of occupancy is permitted.
5. Noise generated onsite must conform to the Southold Town noise code.
6. This permit is granted only for the dates requested herein. Consideration of requests for other dates prior to
site plan approval of the subject property by the Planning Board will be based upon the applicant's ability
to demonstrate successful compliance with the conditions imposed herein.
7. The Town reserves the right to revoke this permit or deny future permits if the event(s) generate any

Re: Greenport Harbor Brewery — Peconic
Dear Ms. Weisman:
I am respectfully requesting an expedited review of our enclosed Special Event
Permit application. I apologize for the inconvenience of having to submit this request as a
late date, however, in our effort to try and move our re -vitalization project along in
Peconic, I wanted to meet with the Planning Board to make sure they were also aware of
what we are attempting to do and provide additional information about our parking
locations prior to submitting this application. To that end, I met with the Chairman of the
Planning Board yesterday and we reached an agreement with our proposed plan. I
understand you will verify that information directly.
As I am sure you can understand, my partner John Liegey and I have invested every
penny we have in this project and are in dire need to open for some limited periods of time
to allow us to capture some portion of the summer season that is now upon us. Therefore,
in connection with our effort to complete all improvements, it was suggested on Friday
that we apply for the Special Event Permit for our July events. We expect all other final
approvals to be completed by early August so that we can commence normal business
operations.

Since Vicki Toth is out of the office until July 2"d, I am forwarding to you for your review 4 applications to the ZBA office
for special event permits.
The first two, attached herein, required expedited review and are really just for your information. However, your
comments are certainly still welcome for our office files. The first is new Suffolk Waterfront Fund which, as a non-profit
using their own property to fundraise for their organization, is only required to have the permit because they are still
completing site plan approval and cannot park on site for their fundraising event . We have just received the letter we
requested from the New Suffolk School granting them permission to use the school owned playground for offsite
parking. Harbes was expedited because he failed to fill out an application for a wedding that McBurnie Tent is planning
for this Saturday, and failed to inform her that she should do so. McBurnie found out from Bob Fisher that this was
required. Now McBurnie knows that a permit is required for any future special events they wish to hold and so does Ed
and Monica Harbes.
Greenport Brewing Company is requesting weekend "special events" until they are able to fully open for business. They
are still completing site plan approval but have reached an agreement with the Planning Board to allow these events so
the business can have some income this season. The first event is to be held July 3'd. We are waiting for comments from
Planning confirming their agreement. The fourth is from Old Field Vineyards/Chris Baiz also requesting expedited review
for two weddings, July 12 and Sept 13`h. He does not require a permit for August 24`h (see his explanation). His 22 acres
are zoned R80 (special events like weddings that are for profit cannot be held on residential property) so legal/assessors
please look into his status as a "winery/vineyard/AC etc.

Below are the comments from the Planning Board regarding the Special Events referenced above:
Thank you for the opportunity to provide comments on the Special Event permit requests for the
Greenport Harbor Brewery site.
This site, as you know, is currently in the site plan process. Typically a series of Special Events on a
property in the site plan process would not be condoned by the Planning Board, however there are
several factors which make this situation unique.
One important factor is that this site was previously developed as a car dealership which had moved,
and the buildings sat vacant for several years. The site was verging on visual blight due to its slow
deterioration on a highly visible corner along Rt. 25, a New York State designated Scenic Corridor.
The success of the next business to occupy this site is very important to the community character of
Southold Town.
Another factor is that the business, Greenport Harbor Brewery, applying to occupy the site is an
already established and successful business with an excellent track record for conducting their
business in a responsible way. Their initial location in Greenport Village, where they have operated
for several years, is proof that they are good neighbors and take care to create an aesthetically -
pleasing site.
The brewery project in Peconic began with a building permit to refurbish the existing car dealership
building into a brewery so they could get up and running brewing more beer to meet the demand for
their product. Phase 2 of the project is to create a tasting room/brewpub in the other building on site.
During Phase 1 of the project, some of the aspects that would make Phase 2 possible, such as re-
doing the parking areas, were accomplished.
The fact that this was done as two-phase project with Phase 1 nearly complete and some of Phase 2
in place as a result of Phase 1 is another important factor leading to the Planning Board's support of
the Special Event permits.
Also important is the fact that this site plan application is very close to a determination by the
Planning Board, and the need for these Special Events should be temporary.
Other factors include that this site has plenty of space for the events away from buildings not yet
completed, including an open field of about % of an acre, the large amount of parking available on-

site (room for well over 100 cars), and the fact that the site is zoned General Business and is a
commercial site.
The Planning Board requests, however, that conditions be placed on the Special Event permits,
including the following:

2. No left turns onto Rt. 25 (Right Turn only) — control this with an attendant at that driveway
letting people know not to make a left turn out of that driveway, and a sign to this effect may
also be helpful.

areas.
4. No public access to buildings that do not have a certificate of occupancy.
5. Noise generated onsite must conform to the Southold Town noise code.
In addition, the Southold Town Police Chief should be alerted to the dates, times and conditions of
these Special Events so that the situation can be monitored. Finally, we have reviewed the proposed
dates of July 3 — 6th, and July 11 — 13th. Any future dates should be contingent on the applicant's
successful follow-through on the conditions of the permit and the overall safe operation of the site
during the events.

Since Vicki Toth is out of the office until July 2"d, I am forwarding to you for your review 4 applications to the ZBA office
for special event permits.
The first two, attached herein, required expedited review and are really just for your information. However, your
comments are certainly still welcome for our office files. The first is new Suffolk Waterfront Fund which, as a non-profit
using their own property to fundraise for their organization, is only required to have the permit because they are still
completing site plan approval and cannot park on site for their fundraising event . We have just received the letter we
requested from the New Suffolk School granting them permission to use the school owned playground for offsite
parking. Harbes was expedited because he failed to fill out an application for a wedding that McBurnie Tent is planning
for this Saturday, and failed to inform her that she should do so. McBurnie found out from Bob Fisher that this was
required. Now McBurnie knows that a permit is required for any future special events they wish to hold and so does Ed
and Monica Harbes.
Greenport Brewing Company is requesting weekend "special events" until they are able to fully open for business. They
are still completing site plan approval but have reached an agreement with the Planning Board to allow these events so
the business can have some income this season. The first event is to be held July 3`d. We are waiting for comments from
Planning confirming their agreement. The fourth is from Old Field Vineyards/Chris Baiz also requesting expedited review
for two weddings, July 12 and Sept 13th. He does not require a permit for August 24th (see his explanation). His 22 acres
are zoned R80 (special events like weddings that are for profit cannot be held on residential property) so legal/assessors
please look into his status as a "winery/vineyard/AC etc.
