BACCILE 2012 Q. TRUST SCTM# 1000-9-3-11 Docko, Inc. on behalf of PETER E. BACCILE 2012 Q. TRUST requests a Wetland Permit and a Coastal Erosion Permit to install +/-445 linear feet of a gabion retaining wall, which has a volume of +/-1,120 cubic yards over +/-4,200 square feet; all waterward of the apparent high water line. Located: Off Equestrian Avenue, Fishers Island. SCTM# 9-3-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS Board All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except for minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the prepares of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. See LWRP Section III — Policies; Page 2 for evaluation criteria. X Yes No Not Applicable The proposed erosion protection restoration is consistent with existing plans and programs of the Town because it helps to protect the nature of the shoreline the coastal bluff from eroding to the point where it slouahs which could cause extensive damage to existing environmental resources and the stability of the home site. Some vegetation has been lost and erosion is at the ppint of undermining mature trees along the shore. Policy 2, Protect and preserve historic and archaeological resources of the Town of Southold. See LWR.P Section .III — Policies Page 3 through G for evaluation criteria. Yes No X Not Applicable Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. See LWRP Section III — Policies Pages 6 through 7 for evaluation criteria X Yes No Not Applicable The coastal bluff on which the Baccile's home is situated is wooded and heavilKyegetated.along the shore. The shoreline has eroded almost the full length of the armored bank along the east edge of the property which make visible scars and encourages further damage environmentally as well as aesthically. This project is well justified NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III — Policies Pages 8 through 16 for evaluation criteria. X Yes No — Not Applicable _ This project is completely consistent with the policy. While the material is stone a natural product. it will be supplementing the sour protection of the existing_armor stone and recreating lost habitat and the protection of root base along the shoreline which can support vegetation including tidal wetlands Policy S. Yes No X Not Applicable This project is being built emanatingfrom private land above (landward of) public trust lands and waters of the State. The public trust lands and waters constitutes the area between the mean high water line and mean low water line and the resources are from the high tide line out These environmental resources are being protected by the design standards which are acceptable to the NYS DEC as well as the Town There is virtually no public use of the waterfront in this area and the shoreline protection landward of and above the apparent high water line are not likely to influence or change this fact WORKING COAST POLICIES Policy 14. Inc TITLE Agent DATE July 23, 2014 5 Photographs Peter Baccille Photograph 1 This photograph shows the actual location of the slough, or landslide, immediately below the Baccile home fronting on Hay Harbor. The bluff is more than 30 feet high and is almost entirely homogeneously sand, based on the geotechnical analysis conducted late in 2013. The stable slope is dependent on enhancing the stability and scour protection as well as retainage characteristics of the toe. For that reason, gabions will be assembled to form a 10 foot high retaining wall around the entire face of the bluff. Photographs Peter Baccille Photograph 2 This photograph shows the easterly end of the Baccile property looking in a southerly direction from Hay Harbor, approximately 300 feet off shore. The focus of this view is to show that there are relatively small sloughed sections of the bank all along its face. These small collapses indicate the general instabilities of the very steep sand bluff and the need to create a toe retention structure in the form of the gabion wall for the full length of the bluff owned by the Baccile family.
