Box 1179 Southold, NY 11971 Telephone: 631765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: September 10, 2014 Re: Proposed Wetland Permit for SHEILA PATEL SCTM# 1000-51-4-5.1 Michael Kimack on behalf of SHEILA PATEL requests a Wetland Permit to remove existing upper wood landing, gate, pergola, platform and staircase; and replace with new +/-56' long and 4' wide bluff stairs consisting of a 8'2"x48" upper landing with a 3'x3.6' gate, and a 42"x68" pergola above; a 52"x48" mid -platform; and end at an existing 3'x8' bottom landing; and for the two (2) existing 50' long by 12" diameter poles on the bluff to be left in-place. Located: 19965 Soundview Avenue, Southold. SCTM# 51-4-5.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions is INCONSISTENT with the Policy Standard (Policy 6.3) and therefore is INCONSISTENT with LWRP which states: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. Chapter 275 Wetlands and Shorelines section 275-6 (8) requires that proposed structures be certified by a registered land surveyor or registered professional engineer licensed by the State of New York. The proposed structure is located in a high energy, CEHA where severe erosion has occurred in the past and the structures located within these areas should be certified as required. Note that the stair received a Grandfather Permit (4566) in 1996, however, the proposed action does not conform to the dimensions of the permitted structure. The permitted structure includes 4'X36' stairs, east side, 3 platforms: 7'X4', 3'X4', & 4'X4' .... Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt -minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program.
