The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed actions are INCONSISTENT with the Policy Standards (Policy 6.3) and therefore are
INCONSISTENT with LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The "as built" structure did not comply with Wetland Permit conditions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

DESCRIPTION OF AUTHORIZED ACTIVITY
Construct 133' of timber bulkhead, in-kind and in same location as
existing,
and a 10' return. Place approximately 10 cubic yards of 10 lb. to
750 lb.
stone rip rap seaward of 57' of bulkhead and on unbulkheaded lot corner. All
work shall be in accordance with NYSDEC approved plans (attached).
By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compli-
ance with the ECE, all applicable regulations and the conditions specified herein or attached hereto.
I f he permittee shall file in the office of the appropriate regional permit administrator, or other office designated in the special conditions, a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify him/her promptly in writing of the completion of the work.
1 The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended if
the public interest so requires pursuant to ECL §71-0301 and SAPA §401(3).
