SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you. I
would invite anybody that would like to address any of the agenda items to please feel free.

Leroy Heyliger, Mattituck
LEROY HEYLIGER: Good afternoon, I am Leroy Heyliger from Mattituck. On the agenda
item #150 about the Highway Department, the public service Factory Avenue, the crosswalk. I
was here this morning and you gave me this drawing and I had a couple of things I wanted to ask
as far as the schematic that we have here. It shows that there is a new 12 inch wide travel lane,
white paint divider, going on the north side to the crosswalk and I am curious as to, can a, on the
south side, there is nothing there. No 12 inch wide travel lane white paint going up to the
highway, to, on the south side.
SUPERVISOR RUSSELL: I will have to ask the engineer. It might very well be a requirement
of the highway law.

COUNCILMAN RULAND: Could you bring the diagram?
MR. HEYLIGER: Inaudible. Twelve inch pathway going down, what about this side going all
the way up? For pedestrians?
JUSTICE EVANS: Because when you cross over and then there is a path on the other side I
think.
COUNCILWOMAN DOHERTY: You cross over and then the sidewalk is on that side.
MR. HEYLIGER: Inaudible.
COUNCILMAN RULAND: No. Well, let me say this, the engineering department had said that
they want to delineate the, I think, this is going to be a 12 foot wide travel lane for the car, okay.
That is going to be stripe. This is going to be the walkway here to here, where you cross in the
crosswalk to the existing sidewalk. He did not say but it would tend to mean that this definition
of the travel lane should go all the way to Route 25. That is a minor fix.
COUNCILMAN GHOSIO: We should mention, for those watching at home, so they know
where we are talking about.
COUNCILMAN RULAND: Factory Avenue in Mattituck.
MR. HEYLIGER: Another thing I wanted to bring to your attention, I was just by there.
There's a huge mound of snow here, it is blocking any access to try to get down there.
SUPERVISOR RUSSELL: Vinnie assured us that he will go out and remove that snow. You
know, with 30 inches of snow, there is snow piled up everywhere but Vinnie had told us at the
meeting that your, that he will go out and address that.
MR. HEYLIGER: Okay. And another thing, was the fire lane. The fire lane going down to the
Cottages....
SUPERVISOR RUSSELL: Right. I am going to talk to the, I told you I would talk to the
assistant chief of the fire department to see if there is another option other than what's there.
MR. HEYLIGER: The way that gate is wrapped around with a chain, four times and then there
is a lock on that...
SUPERVISOR RUSSELL: Yes. We are going to talk to the fire chief.
MR. HEYLIGER: Inaudible. And then I don't think they could even get a truck down there, the
way the embankment is.
SUPERVISOR RUSSELL: We will talk to the chief about that.

regulations for the Orient Ice Yacht Club participants and spectators, at the following areas
effective immediately through March 31, 2015, provided that they display a placard approved by
the Police Department:
• The entrance to Hallock's Bay in Orient, to include the parking field at the launching
ramp on Narrow River Road and along Narrow River Road going South and including
the other parking area facing the Hallock's Bay
• The West end of Narrow River Road at the dead end (called Hog Pond) facing Orient
Harbor
• At the bulk head including Harbor River Road (cross road is Skipper's Lane)
• At Great Pond in Southold at the corners of Lake Drive and Lake Court areas
• At Goose Creek in Southold, which includes the parking area at Goose Creek Beach

SUPERVISOR RUSSELL: Sure.
COUNCILMAN RULAND: In working with Jeff Standish at DPW, we went through the state
contract availability of light duty vehicles for the DPW and in the end, we put this out to bid as
you know and the local vendor provided us with more for less money than we could get on state
contract, so we looked at all the options, we came up with this and delivery is six weeks or less.
It is a good thing for us.

Retirement Resolution for Elected/Appointed Officials
WHEREAS, the State of New York has set additional reporting requirements in Section 315.4 of the New
York Codes, Rules and Regulations which requires all elected and appointed officials whose terms start
on or after August 12, 2009, who are members of the New York State and Local Retirement System and
who do not participate in their employer's time keeping system to prepare a log of their work-related
activities for three consecutive months and submit their logs to the clerk or secretary of the governing
body within 150 days of the start of their term;

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 101h day of February, 2015, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 280, Zoning, in connection with Historic Preservation
District" now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the
10th day of March, 2015 at 4:32 p.m. at which time all interested persons will be given an
opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 280,
Zoning, in connection with Historic Preservation District" reads as follows:

A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280, Zoning, in
connection with Historic Preservation District".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:
Article XXXIII. Historic Preservation District (HPD)
X280-190. Purpose; applicability of amendments.
The Town Board of the Town of Southold has found that there exists within the Town certain
structures with historic or community significance that are in danger of being permanently
removed from the Town's scenic viewshed. The Town Board further finds these structures are
deserving of preservation for this and future generations. The Town Board has determined that it
is necessary to create a floating zone, which will be known as a Historic Preservation District, to
afford an opportunity to protect these structures from demolition by providing an incentive to
developers to maintain the facade of said structures, in exchange for the ability to enjoy
additional uses not currently permitted in the underlyingzoning oning district.
4280-191. Definitions.
Unless otherwise expressly stated, the following terms shall, for the purpose of this Chapter,
have the meanings as herein defined. Any word or term not noted below shall be used with a
meaning as defined in Webster's Third International Dictionary of the English Language
unabridged (or latest edition).
ARTISAN MARKET — A retail space for artists to sell their individually crafted art work
jewelry, furniture, sculpture, pottery, leather craft, hand woven articles and related items.

ARTIST STUDIO/WORKSHOP — An establishment for the preparation, display and sale of
individually crafted artwork, jewelry, furniture, sculpture, pottery leather craft, hand-woven
articles and related items.
COMMUNITY FACILITY — A structure located on a property owned, or formerly owned, by a
religious institution, governmental institution, school, fraternal organization, library district, or
fire district.
GARDEN CENTER — A place of business where retail and wholesale products are sold to the
consumer. These centers, which may include a nursery and/or greenhouse, import most of the
items sold, and may include plants, nursery and stock, potting soil, hardware, power equipment,
and machinery, hoes, rakes, shovels and other garden and farm variety tools and utensils.
SMALL BUSINESS OFFICE — Offices such as insurance agencies, real estate agencies,
computer software services, financial planning securities brokers and like -kind small business
establishments excluding retail sales of any kind or nature and limited to overall floor space of
3,000 square feet.
§280-192. Eligibility.
An application for the creation of a Historic Preservation District shall not be accepted unless the
property contains:
1. A community facility.
2. Said facility was designated as a "historic" landmark pursuant to Chapter 170 of the Code
of the Town of Southold or the Town Historic Preservation Commission recommends, in
a writing, that it should be designated as such.
§280-193. Use regulations.
In the HPD. no building or premises shall be used and no building or Dart of a buildina shall be
erected or altered which is arranged, intended or designed to be used, in whole or in part, for any
use except the following_
A. Permitted Uses. The following are permitted uses and, except for uses permitted under
subsection (A)(1), (2) and (3) hereof, are subject to site plan approval by the Planning
Board:
1. Single-family homes
2. Two-family homes
3. Bed and breakfasts, subject to the procurement of a bed and breakfast permit
4. Multiple dwelling units — apartments (for properties located within 1 mile of the
hamlet centers)
5. Educational Institutions
6. Philanthropic, eleemosynary (charitable) or religious institutions
7. Retail businesses limited to:
(i) Farmers markets;
(ii) Artisan markets;
(iii)Artist studio/workshops;
(iv)Craftsman studio/workshops;

(v) Garden centers;
(vi)Dance studios; and
(vii)Exercise studios
8. Day-care facilities
9. Small business offices
10. Professional offices
11. Museums and historical societies
12. Meeting hall and cultural centers
13. Auditorium/theatre, library, artag llery, exhibit halls
14. Buildings, structures and uses owned or ot)erated by the Town of Southold, school
districts, park districts and fire districts.
B. Accessory uses. Accessory uses shall be limited to those which are clearly incidental and
customarily accessory to the permitted principal use.
X280-194. Pre -application procedure.
Prior to submitting an application for a proposed HPD. the annlicant shall narticinate in a nre-
submission conference with Planning Department staff in order to confirm that a community
facility is located on the proposed site, discuss the nature of the proposed HPD the desired
results and submittal requirements.
4280-195. Application procedure.
A. Application and fees. The application for the HPD shall be filed with the Town Clerk in
a form approved by the Town Board and available in the office of the Town Clerk. Fees
applicable to the HPD application shall be set by resolution of the Town Board.
B. The procedure for approval of any future development in a proposed HPD shall involve a
four -stage application process as follows:
1. Submission to the Town Clerk of completed application for an HPD.
2. Confirmation that the communityfacility acility is a "historic" landmark or recommended as
such, in a writing, by the Town of Southold Historic Preservation Commission.
3. Recommendation by the Planning Board to approve the concept plan of the subject
property_
4. Public hearing on the proposed HPD by the Town Board.
C. Referral to Historic Preservation Commission. Upon receipt by the Town Clerk of a
properly completed application for the establishment of a HPD, one copy of the
application shall be referred to the Historic Preservation Commission in order to confirm
that the community facility is either a "historic" landmark or is recommended as such.
Within 45 days from the date of the Historic Preservation Commission meeting at which
such referral is received, the Historic Preservation Commission shall report its
determination to the Town Clerk.
D. Referral to Planning Board. Upon the receipt by the Town Clerk of a report by the
Historic Preservation Commission confirming that the community facility is either a
"historic" landmark or is recommended as such, one copy of the application shall be
referred to the Planning Board for its review and reportand one copy shall be referred to
the Suffolk County Planning Commission for its review and recommendation if required
by the provisions of the Suffolk County Charter. Within 60 days from the date of the
Planning Board meeting at which such referral is received the Planning Board shall

report its recommendations to the Town Board. No action shall be taken by the Town
Board until receipt of the Planning Board report or the expiration of the Planning Board
review period, whichever first occurs. Said review period may be extended by mutual
consent of the Planning Board and the applicant.
E. Planning Board report. The Planning Board in its report to the Town Board may
recommend either approval of the application for the establishment of the HPD with or
without modifications or disapproval of said application In the event that the Planning
Board recommends disapproval of said application it shall state in its report the reasons
for such disapproval. In preparing its report and recommendations the Planning Board
shall give consideration to the Town Comprehensive Plan the existing and permitted
land uses in the area, the location of buildings on the site traffic circulation both on and
off the site, the adequacy and availability of community facilities and utilities including
public water and public sewer systems to service the proposed development and other
factors as may be related to the purposes of this Article.
F. Town Board public hearing. Within 45 days from the date of the Town Board's receipt
of the Planning Board's report and recommendation or the expiration of the Planning
Board review period, whichever first occurs the Town Board shall hold a public hearing
on the matter of establishing HPD on the property described in the application Such
hearing shall be held upon the same notice as required by law for amendments to the
Town Zoning Map and/or Zoning Code.
G. Town Board action.
1. Within 45 days after the date of the close of the public hearing the Town Board
shall act either to approve approve with modifications or disapprove the proposed
HPD. A copy of the Town Board's determination shall be filed with the Planning
Board and a copy mailed to the applicant. A copy shall also be filed in the Town
Clerk's office. If such determination approves the establishment of a new HPD
the Town Clerk shall cause the Official Zoning Map to be amended accordingly.
2. If not designated already, the Town Board shall designate the subject community
facility as a "Historic" landmark prior to issuing approval and as such the said
facility shall adhere to all the requirements imposed by Chapter 170
3. Revocation; extension.
a. Upon request to the Town Board on notice to the applicant and for good
cause shown, the establishment of an HPD may be revoked 18 months
after said Town Board approval thereof if work on the site has not
commenced or the same is not being prosecuted to conclusion with
reasonable diligence.
b The Town Board upon request of the applicant and upon good cause
being shown, may, in the exercise of its discretion extend the above time
period.
C. In the event of the revocation of approval as herein provided the HPD
shall be deemed revoked, and the zoning classification of the subject
property shall revert to the zoning classification that existed on the
property immediately prior to the establishment of the HPD thereon and
the Town Clerk shall cause the Official Zoning Map to be amended
accordingly.

X280-196. Maintenance and termination.
A. The community facility and its facade shall be maintained in good repair and in
accordance with all applicable provisions of the Property Maintenance Code of the New
York State Uniform Fire Prevention and Building Code and Chapter 170.
B. Following the Town Board approval of the HPD the applicant shall file in the office of
the Suffolk County Clerk covenants and restrictions in a form approved by the Town
Attorney. The covenants and restrictions shall contain terms and conditions as the Town
Board and the Planning Board deem necessary to ensure that the community facility and
fagade are maintained inog od repair and in accordance with the Property Maintenance
Code of the New York State Uniform Fire Prevention and Building Code and Chapter
170.
C. If the community facility is demolished or otherwise destroyed, the HPD shall terminate
immediately and the zoning classification of the subject property shall revert to the
zoning classification that existed on the property immediately prior to the establishment
of the HPD thereon and the Town Clerk shall cause the Official Zoning Map to be
amended accordingly.
D. Failure to comply with this section shall be a violation punishable pursuant to §280-155.
II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
III. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

This Article is enacted pursuant to Municipal Home Rule Law § 10(1)(ii)(a)(1) and is intended to
supersede Town Law X23(1) and Public Officer's Law 0(1) relating to the qualification of
Town officers.
442.10. Eligibility Requirements for Certain Town Officers.
Every officer of the Town of Southold except elective officers, shall, at the time of his or her
appointment and throughout his or her term of office be an elector and resident of the County of
Suffolk For the purposes of this Article the term "officer" shall not be construed to include
appointed members of Town administrative boards.

Support Special Districts' Elections
WHEREAS, there are more than 900 different taxing entities comprising our local governments,
including numerous special districts such as library, fire, water, sanitation, parks, etc. with
varying election days for their elections; and
WHEREAS, it has been documented that voter turnout for school districts and fire districts
increased when a single date was established for all school district elections and a single date
was established for all fire district elections; and
WHEREAS, single date elections for special districts will focus media and voter attention on
relevant issues increasing the likelihood that the public's interest is served; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby supports attaining a unified
election date for Long Island's special districts and urges our State representatives to consider

legislation to establish a common day for special district elections in the counties of Nassau and
Suffolk; and be it further
RESOLVED that the Town Clerk is hereby directed to forward this resolution to Senator

SUPERVISOR RUSSELL: That concludes the agenda. I would invite anybody that would like
to address the Town Board on any issue to please feel free.
Robert Dunn, Peconic
ROBERT DUNN: Robert Dunn, Peconic. Last week, I got a check in the mail (inaudible), this
year's state budget provides tax relief by reimbursing homeowners for the increase in their
property taxes if their local government or school districts stayed under the 2% property tax cap.
This check reimburses the growth in your school property taxes because your school district
stayed under the state property tax cap. Do you know, is that about you guys staying under of
the school district staying under or both?
SUPERVISOR RUSSELL: It would require all jurisdictions staying under. Southold Town, the
school districts. Basically, the genesis of the legislation was to offset or to supplement the STAR
savings that are available. What they did with this component was to put pressure on the
municipalities and others to make, to ensure that we stayed under the 2% tax cap.
MR. DUNN: So then, I guess what I want to say is, thank you.

SUPERVISOR RUSSELL: You're welcome.
MR. DUNN: You did a good job. I assume I am not the only one that got this check.
SUPERVISOR RUSSELL: I think they are hitting the mailboxes now.
MR. DUNN: I will acknowledge that we got them and you deserve thanks for it. Second thing, I
just wanted to point out, we have had some discussions about the recent beach maintenance...
SUPERVISOR RUSSELL: Right.
MR. DUNN: As Peter and I predicted, that spit is back. Just where we said and did exactly what
we said. It is going further out, so I think going forward, you really should consider that being a
positive thing for us and use it, we had stated that then and I also you know, our engineers do a
good job. I think they do a great job but I think they have a lot of their plate. I heard them both
here with four balls in the air this morning, so to take input from people who are there, myself,
Peter also. Peter is an engineer. I have a background in engineering construction and we kind of
look at it full-time whereas it is just one of many things on their plate. So, just making a point on
that.
SUPERVISOR RUSSELL: It's a, we actually had, as you know, a good, productive meeting.
When we talked about the issues, maybe changing our approach there, reestablishing the profile
on that easterly side, I am quite confident we won't take any new action there until we engage
the community again.
MR. DUNN: Okay. This morning, at this morning's meeting, you were discussing the
courthouse or the courts and I have heard a number of discussions about them, I am not a big one
about courts but actually, I built one or two. As some of you know, I worked for a municipality
up west of us for 25 years and prior to that I spent 15 years building for them and I kind of find
municipal buildings are pay me now or pay me later. You are going to have to do it one way or
another, just to put my two cents in on that, I don't know about modular building in terms of
long term when you look at a building like the Peconic Lane schoolhouse, I know people that
are in their 70's that went to that school. If that had been built with a modular building, I can
assure you having had the experience of maintaining modular buildings in a municipal setting,
they don't look the same 70 years later. So while it may seem to be thrifty now, someone is
going to pay for it later, either in maintenance or replacement.
SUPERVISOR RUSSELL: Point well taken. In fact, we have one right next door that's similar.
That was, for the most part, an insulated Morton building. That was to serve as the rec center.
And you are right, it's never going to look like the school next door and the maintenance is, you
are right. Point well taken.

MATT CAMPBELL: Hi. My name is Matt Campbell, I live in the Bayview section of
Southold. I came across an article in the Newsday in January, it was in regards to double poles
in the town of North Hempstead and the fact that the North Hempstead Town Board took action
to accelerate the removal of utility poles and apparently it worked and I noticed in our town, we
seem to have a lot of double poles. On Peconic Lane, there's like five or six poles. There's a
pole right at the corner of Oaklawn and Main Street here. Is there any way we can put a little
more pressure on the utilities when they, I know they are reinforcing their grid but it just seems
to take forever to remove the pole and there's a lot of finger pointing between Verizon and PSEG
but it looks like this town took some action and it actually got results. The poles were removed,
I guess they passed an ordinance where they would fine the utility.
SUPERVISOR RUSSELL: We actually passed a similar local law.
MR. CAMPBELL: Oh, okay.
SUPERVISOR RUSSELL: Requiring a better or faster resolution to the double poles in the
town but one thing you said is 100 percent correct, which is the finger pointing between who
owns the pole and who doesn't between PSEG and Verizon.
TOWN ATTORNEY FINNEGAN: I think if you could bring it to the attention of the Highway
Superintendent, if you haven't already. He may or may not be aware of it but our code requires
him to send a notice out to the utilities and then his office usually follows up to get the
compliance.
MR. CAMPBELL: Okay. I can stop by the Highway Department. That was the first thing and
the second thing I had was to thank the town snow removal teams, they have done a great job in
these storms, under very difficult conditions however, I wanted to talk about the use of sand on
the roads. I live in the Bayview section and essentially, the residential roads kind of turn into dirt
roads for a couple of months. I own a motorcycle and I am unable to drive on the roads until the
actual sweeper comes through and I thought about it a little bit and I noticed that the sweeper
sweeps and then it stores the sand in this case at Cedar Beach parking lot, a truck comes and
picks it up, hauls it, I assume it gets screened I think for use in the following year but I notice
with the county and the state, I think they use more salt and with salt, it's like when you get that
first rain it just dissolves and you are done so it seems like there is quite a bit of expense and fuel
and labor and equipment to remove the sand. Have you done any cost analysis where maybe you
should use more salt because it pretty much just washes away?
SUPERVISOR RUSSELL: WE will take that up with the highway superintendent. The towns
are fairly consistent of using the same ratio of sand to salt. Salt is a very, you know, whenever
we have a storm like that, they talk about you must have a lot of overtime charges. The overtime
is one thing, it's the cost of the salt that's the real driving force in our budgets each year. But
certainly we will be happy to talk to the highway superintendent about that. I know he is a
member of the Superintendent of Highways Association of Suffolk County, so I am sure he can
bring something back if other towns have addressed it somehow.

BENJA SCHWARTZ: Good evening, Benja Schwartz from Cutchogue. How you all doing?
Resolution 189, I am curious, I would like to begin by asking with the language on section 42-10
is. It says that there is an exemption from the new proposed law for town administrative boards.
I think that could be interpreted in many ways. As I understand it, I don't know but I am
asking...
SUPERVISOR RUSSELL: What this local law is?
MR. SCHWARTZ: No, administrative boards. Because I would think you would want to
specify what you...
SUPERVISOR RUSSELL: Sure. What the law would do, under the current law, to appoint a
town attorney or a town engineer or etc., you need to be a resident of the town. This law would
basically allow us to expand our search to all of Suffolk County. It specifically excludes elected
officials and administrative boards such as the Planning Board and the Zoning Board of Appeals.
MR. SCHWARTZ: And the Trustees?
SUPERVISOR RUSSELL: They are excluded under the elective provisions. It says elected and
administrative.
MR. SCHWARTZ: Okay, so it's not, okay. so I would just, you know, put in there when you,
instead of just saying town administrative boards, say town boards including Planning Board and
ZBA. The other ones are elected, just to be clear. Uh, didn't hear anything about this law but I
guess there was some public discussion. I am curious why you think it would be not such a good
idea, Councilman Ghosio.
COUNCILMAN GHOSIO: I tend to feel in these positions, I think the original laws were
passed for a particular reason. My interpretation of it is you want people in these positions who
have a vested interest in the town. So, you know, I would prefer to keep these positions in town
if we can. I am not necessarily adverse to having a hearing to decide if the people would like to
open it up to the county but that's my opinion and I think that there are other folks that would
agree with me, so. I am okay being in the minority.
MR. SCHWARTZ: And I can hear your point and I hear your point and I wonder if you couldn't
come to a middle ground, where there was a preference for local individuals but in the event, I
don't know why, what the criterion would be, whether there was nobody locally that applied for
the job or if there was a candidate from outside of Southold Town and Suffolk County also is a
big place, maybe it could be limited to candidates from the East End but I....

SUPERVISOR RUSSELL: It is reflective of what we are permitted to do under state law, town
law under the State of New York.
TOWN ATTORNEY FINNEGAN: Just to be clear, though, it does not preclude hiring locally,
obviously. It is just opening up a pool of candidates obviously, the ultimate decision lies with
the Town Board and it doesn't mean that a local candidate who is qualified for the job would not
be considered.
MR. SCHWARTZ: I guess this next question is for Mr. Finnegan. Some people have been
asking me about the legal status of two-family housing in Southold Town. I know there are a lot
of houses that are shared without formal approval but people have been telling me there is no,
that you can get a permit for an accessory apartment where the principal residence is occupied by
the owner of the property but that a two family house is not within our codes, it is not available
under our codes.
TOWN ATTORNEY FINNEGAN: I don't believe we actually have two family, we have multi-
family, single-family residences and multi -family homes. We don't use the term two family.
SUPERVISOR RUSSELL: There's provisions for it in the code just, I don't believe in the
residential sections. But I would have to defer to the chief building inspector who could better
answer that question.
MR. SCHWARTZ: We might look under multi -family rather than two-family. Okay. I just
heard about that recently.
SUPERVISOR RUSSELL: There are plenty of CO two-family out there in residential zone. So
if they have the pre -CO.
MR. SCHWARTZ: Pre-existing uses. It's kind of hard to get if you don't have it already. You
know, I am looking at resolutions 155, 164 and 171 and they are related. And I apologize, it's
hard to look at all three, you have to go through the various pages, it's even harder on the
computer but you know, it brings out to the point that the agendas are created as they go, as
people go and it doesn't seem to be, well, sometimes there are specifically certain items on the
Town Board agendas are placed in positions intentionally moved up to the front of the meeting
or the end of the meeting or whatever, we don't know why but these kinds of resolutions that all
pertain to related subjects, it would be nice I don't know if maybe the Town Clerk can answer if
that is possible to do with the software that we are using, if you insert a new...
TOWN CLERK NEVILLE: No, Benjamin, the resolutions go on as they come in. if you start
trying to switch things around you kind of end up with a mess all over. It's best just to keep
them as they go on.
MR. SCHWARTZ: So the software doesn't allow it? Maybe it's time to think about improving
the software or the company or something.

TOWN CLERK NEVILLE: What would be the benefit?
MR. SCHWARTZ: Excuse me?
TOWN CLERK NEVILLE: What would be the benefit? Do you feel, grouping all the like ones
together?
MR. SCHWARTZ: The benefit would be meaningful meetings. More easily understood
meetings for the benefit of the Town Board, you know, life is confusing these days. There's a lot
of things that make it more confusing by separating them. Anyway, we look...
TOWN CLERK NEVILLE: Better left as comes on.
MR. SCHWARTZ: I mean, we have this whole agenda...
TOWN CLERK NEVILLE: If they are too combined, it might get more confusing.
MR. SCHWARTZ: I don't think so. A 46 page agenda, you know, if we could make it easier to
negotiate and navigate.
SUPERVISOR RUSSELL: The agenda is particularly long because we went I think three weeks
between meetings. So the work piled up.
MR. SCHWARTZ: But in general, would it hurt to have, for example, resolution #155 is
advertising for a computer server and I understand it's just a request for bids, request for
proposals and bid specifications to be supplied, well, when are the bid specifications going to be
supplied? I would hope that those bid specifications were developed prior to the resolution, the
authorizing of them, the resolution. Have they been, do you know if the bid specifications have
been created yet or are you voting on....
SUPERVISOR RUSSELL: The specifications, you can actually, IT has the specifications on
what they are looking for.
MR. SCHWARTZ: They do?
SUPERVISOR RUSSELL: Yes.
MR. SCHWARTZ: That would be nice if that could be understood here and I know that the
software does have the capacity to specify the potential or the financial impacts. Or the potential
financial impacts. I am just, you know, it would be nice to know what we are thinking of
spending, what area of a new computer server for the town is going to cost. Resolution # 164
takes money from the budget line allocated towards work stations/servers so it's kind of, it's
interesting that on one hand you are talking about buying a new server and on the other hand,
you are taking money out of the budget servers. That is what it seems to me. And I am not sure
about resolution 171, it seems again, extremely vague and broad and if I was a Town Board

member which thank god I am not, I would have wanted more information before advertising for
various computer equipment. You know, it looks, included but not limited to desktops and
laptops but then etc. I don't know what exactly you are thinking about advertising for bids. It is
interesting, that one doesn't even say pursuant to specifications provided by the IT, so I don't
know how you are going to advertise for bids if you don't even know what you are looking for to
buy?
COUNCILWOMAN DOHERTY: Benja, can I interrupt. I am a little confused. First you
started out talking about combining some of these resolutions and now you are talking about you
want more information on the agenda. All the information, as you know, we discuss during our
work session. And there is backup information on all of this available to everybody. So, did you
want us to, I mean, technically we don't even have to read any of this, we can just read numbers
and say I so move on resolution # 96 and we don't have to read anything. By law.
MR. SCHWARTZ: Are you advocating that?
COUNCILWOMAN DOHERTY: No, I am not. I am just...
MR. SCHWARTZ: Why not?
COUNCILWOMAN DOHERTY: Because I think the people need to know what we are talking
about and then if they are interested in it, then they can look into it further. But you are asking
for two different things right now from what I am hearing.
MR. SCHWARTZ: Well, the software provides for considering the financial impacts of various
resolutions in the agenda, so I think there is a reason the software provides that and I think that's
something that people are interested in. Whether they are interested enough to file a FOIL
request, whether they have time to file one between the Friday when the agenda usually comes
out and Tuesday of the meeting....
COUNCILMAN DINIZIO: Can I say something, Benja?
MR. SCHWARTZ: Sure, please.
COUNCILMAN DINIZIO: How many pages do you want this to be? I mean, you just told me
it was 40 some odd pages, now you want an explanation of where the money is coming from,
where it is going you know....
MR. SCHWARTZ: No, that does not necessarily have to be in the agenda, in the online version
of the agenda, I believe there is a way to make links to attachments which as a practice would
keep the public informed as to what the Town Board is doing.
SUPERVISOR RUSSELL: Okay, first let's just go back a little bit. 155 is a resolution
permitting the Town Clerk to advertise. It clearly says in the draft that the bid specs to be
provided by the IT department. Any motivated party can go and get the bid specs from the IT

department. We are locating it for you in the resolution. 164 is housekeeping, it's not actually
2015 money, it's reallocating 2014 money to button up the budget from this past year.
MR. SCHWARTZ: Okay, that's 155 and 164, 164 is 2014 budget. I see that. Okay. I
understand that. But do you understand my position on having a coherent agenda and including
detail on items including for example, resolution 171 which is more information will be needed
before this is implemented. Correct?
SUPERVISOR RUSSELL: I will take your word for it.
TOWN ATTORNEY FINNEGAN: Benja, it's a resolution authorizing an expenditure to
advertise, it's not a resolution directing a particular thing. All it is, is the Town Board has to
authorize expenditures, so that's what this is, it's saying it's okay to spend money. For Betty to
spend money to put an ad in, she will get the specs from the IT Department. It is very different
from when the bids come in and they consider the expenditure. We won't know how much
money is to be spent until the bids come in and there is something to evaluate and at that point,
there will be a resolution on with a lot of detail about what's going to be purchased.
MR. SCHWARTZ: The point was made earlier about individuals in town that have knowledge
and information that could benefit the town government and we should utilize that to the extent
possible and the way to do that is to keep the public informed. I don't understand why I am
sensing an opposition to these ideas.
SUPERVISOR RUSSELL: There is no opposition, just clarity is what we are offering to the
resolutions, so you understand what they are. But there's no opposition.
MR. SCHWARTZ: What are you, are you talking about computers here or new computers for
everybody in Town Hall or that is what is missing, is clarity.
COUNCILMAN DINIZIO: Well, that will be in the advertisement.
SUPERVISOR RUSSELL: And you can refer to the IT Department. They work for you, just
like everybody.
MR. SCHWARTZ: You know, I really, this doesn't mean anything by itself. It's like a contract
that's missing the price and then the subject of the contract.
COUNCILMAN DINIZIO: Do you want to know how much it costs to place an advertisement?
MR. SCHWARTZ: No. I want to know what you are advertising for? What you voted to
advertise for?
COUNCILMAN DINIZIO: Well, that's what we are authorizing, to advertise.
MR. SCHWARTZ: For what?

COUNCILMAN DINIZIO: You'll find out what we are advertising for when you read the
advertisement, just like everybody else. When they read that advertisement, then they are going
to go to the proper place and they are going to get the information that they need and they are
going to make a bid.
MR. SCHWARTZ: You have to know what you are going to advertise for before you place the
advertisement. You in effect are placing an advertisement...
COUNCILMAN DINIZIO: No, we are just authorizing her to place an ad in the paper, per the
IT Department.
MR. SCHWARTZ: It doesn't mention the IT Department.
COUNCILMAN DINIZIO: Yes, it does. It says IT equipment.
MR. SCHWARTZ: 171?
COUNCILMAN DINIZIO: 171. Information technology, advertise for bids, IT equipment.
MR. SCHWARTZ: Okay. IT equipment. But it doesn't say that there's going to be, that the
specifications are going to be provided or, it has no indication.
SUPERVISOR RUSSELL: We'll take everything you have to say under advisement.
MR. SCHWARTZ: What it is and how much it costs.
SUPERVISOR RUSSELL: We will certainly consider everything you have to say.
MR. SCHWARTZ: Thank you very much. Okay, I don't want to belabor the point but I am still
struggling with this stipulation of settlement for the 50 acre piece of farm land in Cutchogue. I
wrote a letter to the paper, hopefully it will be in next week and you will read it. I won't repeat
that but it just seems to me tha the purpose of the zoning and of entertaining an application to
build 130 condominiums plus a huge private community center doesn't really make sense to me.
How is it a community center if it's private. Usually I think of community as kind of a public
thing but I guess they will have their own community. Separate from the community that I
belong to which has the Cutchogue hamlet center as its center. This new community will be
equivalent in size to the hamlet center and about 15% of the population of Cutchogue will
increase and as I understand it, other town's on the east end don't permit such large scale
developments. They limit the number of units that can be built at one time and in one place.
And I just think that the goals of providing housing for elderly people that are no longer able to
maintain their own houses and take care of their own houses, they have wonderful goals but I
think we could find other ways to do it with less bad results. Even the developers own draft
environmental impact statement does recognize that this is going to have a negative, bad, adverse
impacts on our community, not just for the people who live right in Cutchogue, yes for them but
for everybody who lives on the Peconic Bays, on the North Fork, a lot of people drive through

Cutchogue if they live in Southold or Orient or Greenport and they want to go through
Riverhead. You are going to have worse traffic. It is going to affect everybody in Southold
Town. I think it is the wrong place and the wrong thing. To me it's like saying, well, Southold
Town, well, we don't have an apartment building and I know people do like to live in apartment
buildings. If they want to live in an apartment building, they can go to the city. If they want to
live in a big condo development they can go somewhere where those kinds of things fit in
without hurting everybody who is already living here, in terms of financial impacts,
environmental impacts, social and cultural impacts. Thirty years ago, when the Town Board
rezoned that property for high density residential, a lawyer from Twoomey, Latham, Shea and
Kelley wrote a letter to the Town Board and I just think it's beautiful the way his language, such
an artful attorney, unlike myself. I'd call them a bunch of liars but this is what he said and I will
end with this, `however, I would commend to your reading the original environmental
assessment form, particularly the disturbingly inadequate candor contained in the applicants
evaluation of the projects impact on open space, traffic, population, scenic vistas, farmland and
other existing ecological features of the area just north of the hamlet of Cutchogue.' I will be
trying to follow that application through the Planning Board. But I don't believe the Planning
Board has the authority or ability to eliminate all of the adverse impacts that will accrue if that
proposed development, as it is described in the stipulation is approved. Thank you for your time.
