COUNCILMAN GHOSIO: The 375th Anniversary Committee of which I am the Town Board liaison to, I just want to let everybody know that these are the first of a couple of events that you will hear about over the course of the year. There is going to be a website set up for the 3751h Anniversary, there is going to be a convocation that is going to be taking place shortly down in Southampton since they are also celebrating their 3751h. I just wanted to mention it, everybody should keep an eye out for some of these events. Southold Town Board Meeting page 29 February 24, 2015 SUPERVISOR RUSSELL: I would invite anybody who would like to address the Town Board on this local law to please feel free. BENJA SCHWARTZ: Good evening. Benja Schwartz, Cutchogue. Not enough people in the Town of Southold looking for work I guess. It seems very abstract, officers except for elected officers, what, you know, the, this Town Board is here to do the public business and the public has a right I think, is the need to know what the thinking behind these ideas are. Was there a particular office that it was difficult to find a candidate for? SUPERVISOR RUSSELL: It is not a question of difficulty, it is a question of expanding our search to cast as wide a net as possible. I think it is certainly appropriate for a Town Board to look as far as we can for candidates. As you know, we are trying to fill the position of Martin Finnegan who has moved on to greener pastures and we posed the local law in case we need to expand our search beyond our borders. We, as a Board, believe that local candidates should have preference but that's not the same as exclusivity. MR. SCHWARTZ: I am sorry I missed the meeting the other day, the work session at which the new Justice Court director presented a summary of how she has been doing there in the Justice Court. I don't know how long she has been there but she doesn't live in Southold Town, does she? But there was no problem appointing her? SUPERVISOR RUSSELL: It's a civil service position, Benja. It's regulated by civil service, we are required to hire someone either who is on the list and reachable on the civil service list for the test or someone who is already serving in that capacity. MR. SCHWARTZ: I am just trying to understand, this is implying... SUPERVISOR RUSSELL: Town officers are not a competitive class positions, classified by civil service. There is no civil service position, Town Attorney, things like that are discretionary by Boards. MR. SCHWARTZ: Okay, so this applies to non -elected, non -civil service positions. It didn't say that but I am trying to understand it. I spoke last week but it wasn't at the public hearing so I think it probably bears repeating the comments that were made on this last week that maybe should be considered in connection with this proposed legislation and I didn't get any sense of how the Board felt about possibly inserting some language of expressing a preference for local people. You know, personally I think that this law is not a bad idea but that in connection with this, this law is a, it is a bad idea if it is not implemented appropriately and if there are not other measures taken to stem the brain drain that has been occurring. And you know, we need smart people, we need competent people in our local government. And if we can't find them in our local area maybe we need to look other places but also, maybe we need to look towards developing people for the future to help operate our local government and the local interest with local people. I thnk there are a lot of ways to do that but I don't see much happening. But does that make any sense... Southold Town Board Meeting February 24, 2015 SUPERVISOR RUSSELL: Sure. Absolutely. MR. SCHWARTZ: That an express stated preference for local people... page 30 SUPERVISOR RUSSELL: It doesn't need to be in the body of the proposed local law, a stated preference for locals, that would be at the discretion of this Board or any future Board. MR. SCHWARTZ: Couldn't that be put in the whereas clause or somewhere in the, you know, the law is not just cut and dry, it's.... SUPERVISOR RUSSELL: It would not enhance the local law at all. Local preference, it's the right of any Board to insist on a local preference. I don't think you need to put it in the body of the proposed code. I don't think it serves any purpose. It's adding words for words sake. MR. SCHWARTZ: I think it was Councilman Ruland this morning that said just because you can do something doesn't mean you should but to say that, you know, you should consider the local... SUPERVISOR RUSSELL: Well, it is a good proposal then. We will take it under advisement. MR. SCHWARTZ: I think would do a whole lot to negate any potential negative consequences of this law. SUPERVISOR RUSSELL: The state offers these. MR. DUNN: You meet parameters... SUPERVISOR RUSSELL: The state and the federal government have very, I don't want to say ambitious, but they are very good programs to help towns save farmland that's active. To keep it in production. MR. DUNN: And do you have to give it to them with a specific property in mind? SUPERVISOR RUSSELL: Properties have to match the criteria of the grant, so there are parameters. MR. DUNN: Okay. Thanks. SCHWARTZ: Well, to start off with, I asked one of the Town Board members but he didn't mention it, so and I know you love it when I look online. I am looking at the Google search results for the Town of Southold. First thing it says it Supervisor Scott Russell's Sixth annual State of the Town Address. The entire community is invited to attend. So I just, I noticed that the State of the Town Address, the posting on the website was dated this previous Thursday and the address is Thursday night. I don't know how many of you are going to be here Thursday night, I commend all of you for coming in late at night to work for the town but I thought maybe Southold Town Board Meeting page 32 February 24, 2015 it would be a good idea to say something about that meeting tonight especially considering the short notice... SUPERVISOR RUSSELL: Good point. Good point. MR. SCHWARTZ: It's not going to be in the paper... COUNCILMAN GHOSIO: Benja, I was going to say something after the comments. SUPERVISOR RUSSELL: Yes, please. MR. SCHWARTZ: Well, if you want to say something later... SUPERVISOR RUSSELL: The State of the Town Address will be Thursday night right here in the meeting hall. It's always nice having Jill around but I was upset last week when she said last week that it was impossible to add and subtract from the agenda. And we can do both. Speaking of mathematics, it, the agenda here about #214 about the accounting, maybe I am misunderstanding this, I don't know but if we do some simple math, 3 '/2 days a month comes out to 42 days a year. That gives them 323 days off a year. I want that job. Is that a fair statement? I hope not, I don't know, I mean... COUNCILMAN DINIZIO: Are you talking about the ZBA member? MR. SCHWARTZ: Yeah. COUNCILMAN DINIZIO: It's based on the amount of work that he does as to how much he gets towards his retirement. So he gets 3.65 days per month.... MR. SCHWARTZ: Oh, towards the retirement. Not that he only works that. Okay. I am sorry, I just, it didn't make sense to me what he 3 '/z days a month was about. Do they have an expectation of how many hours a day they work there at the ZBA. SUPERVISOR RUSSELL: They keep a log. Actually, the newer appointees, the newer elected officials keep a log of their time and then submit it to the State of New York. Actually, it is calculated by the New York State retirement system. MR. SCHWARTZ: I know some of the town employees punch time clocks and some of them come and go as they please. But resolution # 198, I heard from the grapevines that Supervisor Russell was saying that the Town Board, don't talk to the Town Board about the Heritage at Cutchogue, go talk to the Planning Board. Well, we disagree on that, we have established that. but here it is, that the Town Board is authorizing and directing an agreement, Scott, to execute an agreement. So you're all, you know, the heading of this says contracts, lease and agreements. Well, I don't know what the agreement is, to provide technical assistance. I assume they are being paid for this. I assume it's going to be a contract? SUPERVISOR RUSSELL: Yes. MR. SCHWARTZ: Not just an agreement? SUPERVISOR RUSSELL: A professional services contract. MR. SCHWARTZ: Okay, so it should be called a contract not an agreement. And it should be, the dollar amount should be here and whose pocket are those dollars coming out of. So you all voted on it tonight, can you answer those questions. How much and who's paying? COUNCILMAN DINIZIO: Sure. JUSTICE EVANS: We don't know exactly right now. Southold Town Board Meeting page 34 February 24, 2015 COUNCILMAN DINIZIO: Well, we know it's $18,000 to begin with and then they are going to charge by the hour for the rest. In other words, it's to look over the scope of the Heritage, to ensure that the roads are done right, I mean, whatever needs to be done right. We are going to hire experts from this company and they are going to look it over. MR. SCHWARTZ: They are reviewing the SEQRA document to scope the SEQRA process. COUNCILMAN DINIZIO: And in our town code, there is an agreement that the Heritage or the people that represent the Heritage will pay $20,000 towards that. SUPERVISOR RUSSELL: The one thing I will say is I completely agree with you, the dollar amount should be there. it was at the work session, that's probably an oversight from my office, we do the agenda. I will also ask Planning to make sure that number is included in the future agenda. What happens in this instance is the town pays and then gets reimbursed by the applicant. MR. SCHWARTZ: Well, in terms of whose pockets its coming out, it's still not entirely clear here because this is also impacted or affected, controlled by the agreement which is between the Town Board, the Planning Board and the Heritage developers. I really don't like calling them the Heritage developers. Okay? the Heritage at Cutchogue is I think a limited liability company or something but it is merely an assignee of the property, the property and the agreement is between the Town Board, the Planning Board and the Heritage at Cutchogue corporation and the NoCro corporation. But you know, the difference between the NoCro corporation and the Heritage corporation is I have an idea who is part of it. The man who signed it, Joseph Nolan. He was the No part of NoCro. So he was one of the original three partners who purchased that property 35 years ago for $60,000 or I don't know exactly. But it was William Carroll, Joseph Nolan and Richard Cron. And that corporation and the Heritage corporation have agreed to pay, they have already paid substantial sum of money to the town to review that development for the SEQRA analysis etc but now they have agreed that they are going to pay up to a certain amount more. There is a limit to that. So once we reach that limit, if we want consultants to protect the interests of the town, it is going to come out of our pockets. So, I just, I think it's very, well, you know what I think about that whole thing. You know, there was another speaker, there was a speaker this morning, I did manage to sneak in for an hour at the beginning of the work session this morning and I was impressed by the talk by Kevin McAllister, the leader of Defend H2O. I was disappointed by the attitude of this Board that we are not going to be leaders. Maybe after you take that leadership seminar, maybe you will be... SUPERVISOR RUSSELL: That's presumptuous. That's presumptuous. MR. SCHWARTZ: Well, excuse me... SUPERVISOR RUSSELL: That's not exactly what the Board said. We referred it to the engineers so they can take a thorough look at it and can re -present it to the Town Board. Southold Town Board Meeting page 35 February 24, 2015 MR. SCHWARTZ: Well, there were some Town Board members that did, they wanted to let Suffolk County take the lead and didn't want to see, Mr. Ruland, Councilman Ruland, is that incorrect? COUNCILMAN RULAND: No, it's not incorrect. MR. SCHWARTZ: Okay, thank you. COUNCILMAN GHOSIO: But I think your characterization that the whole Board would represent that attitude is incorrect. MR. SCHWARTZ: Okay, I think you, I agree with you there. I apologize that it was the whole Board, it wasn't the whole Board, the only one who expressed an opinion on that topic took that position and therefore, I assumed that the other Board members were in agreement and that was my mistake. I also heard one of the Board members and I don't have to name names, express an opinion that water pollution from new development wasn't really the problem. That most of the problems are being caused by existing development. And numerically, you know, the town is pretty well developed. I don't know how much development is left to go. SUPERVISOR RUSSELL: The person who made that comment and I won't mention his name either but it rhymes with Scott Russell, actually what I said was the most pressing concern right now is the retrofit of existing cesspools with the 11,200 residential properties that are out here. That's a significant contributor to the nitrogen level in the groundwater. That is a pressing issue that needs to be addressed. I talked to Kevin after the meeting, I think he has an excellent idea and certainly that's something that we need to consider very seriously, his proposal. However, we can't lose sight of the fact that we have a huge problem right here, right now. And code language isn't going to fix it. Unfortunately, the only thing that is going to fix it is money. Where t hose sources of funds come from and what type of alternative treatment systems we'll be allowed to implement. Technology and money, that's the reality. MR. SCHWARTZ: Well, yeah, we are talking about two different things. We are talking about remedying a problem and also about you know, saving what's left which I 100 percent agree with you that it's not enough, just to save what's left. That we, we need to recover some of what we have lost and are continuing to lose but the, how do you do that? How do you get current homeowners to invest in putting in new systems, it's very difficult and you want to talk about money, you know, that's a problem where that money is going to come from. We need to find a source but when you build a new house, there is a pool of money there and some of that can be devoted to at least not aggravating the problems and making it worse, so I think it is just wrong to think that we are not going to address new development because that's the low hanging fruit... SUPERVISOR RUSSELL: You are right. MR. SCHWARTZ: To at least keep us alive. Southold Town Board Meeting page 36 February 24, 2015 COUNCILMAN DINIZIO: Well, Benja, the discussion this morning wasn't about residential. You know, Mr. McAllister said himself it was about more dense building than just one house. MR. SCHWARTZ: Well, it could be multi -family residential. COUNCILMAN DINIZIO: Right. But I mean it wasn't about existing residential cesspools and... SUPERVISOR RUSSELL: Jim is right. I actually made it that conversation when I brought it up. COUNCILMAN DINIZIO: Right. SUPERVISOR RUSSELL: I think Kevin's position is that yes, you have an existing problem, maybe this legislation will help you from not exacerbating the problem by addressing what you can now. and your point is well taken, Benja. MR. SCHWARTZ: Okay. COUNCILMAN GHOSIO: And Scott brought it up and I expounded on that, that I felt that yeah, this is an issue but we also need to address the existing because that is the primary source of the problem that we have today. SUPERVISOR RUSSELL: The East End mayors and supervisors association just wrote correspondence to the Governor of the State of New York asking as part of the Peconic Estuary Program, asking for state funds to be made available to help people offset costs for improving or upgrading their on-site septic systems for homes, particularly during renovation and new construction. They would be used as grants, it's a substantial amount of money but we had to ask. MR. SCHWARTZ: Well, on the other hand in recent years, existing neighborhoods, developments, have aggravated their problems and it seems very obvious to me that water supply and sewage are both tied together. Now there's a very small community on the creek on which I live right on the other side of the creek. That community is between the harbor and the creek, on a very small peninsula of land that's only a few feet about the water. There's no freshwater table, there's no aquifer under that point of land, so for years the people who owned the properties there had got together and bought a property up on the hill and they were piping a little bit of water down there. they had their own private water supply company. And they all had small houses. Now Suffolk County water authority has come in and brought in a big pipeline with a lot of water. Now all the small houses have gotten big. Now the saltmarsh, the heart of our aquifer and our, what am I thinking, estuary and the thing that protects us from storms and that keeps our waters clean by supporting the shellfish and the oysters that filter the water, that saltmarsh behind that little peninsula in the creek is rapidly dying and decaying. It's turning into sandbars. Why? I don't know. But I have a pretty good idea, so, have we learned our lesson? Apparently not because now we are planning another development in Cutchogue Southold Town Board Meeting page 37 February 24, 2015 with 130 residences with old-fashioned sewage disposal and hooking them up to Suffolk County Water Authority so they can pipe in water, use it and dump it on top of the primary body of the aquifer of our sole source aquifer that we depend on. Including the Suffolk County Water Authority but they do and can pump water in from Riverhead and from the main land of Long Island. How long that will last, I don't know. The other end of Long Island has run out of water. We still have a lot but a couple of years ago, Shelter Island ran out of water. You know, in many cultures, a peninsula, Southold Town is a peninsula. In many cultures, a peninsula is considered the equivalent of an island. I think we ought to take care of ours. Thank you.
