SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 12, 2014, stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a 20,419 Sq. ft. parcel in the B district. The northerly lot line measures 100.00 feet along a Town of Southold access road. The easterly lot line measures 205.00 feet along an adjacent parcel. The southerly lot line measures 100.00 feet along Main Road, and the westerly lot line measures 205.00 feet along property owned by the Town of Southold. The property is improved with an existing two story building, that is the subject of this application, and that is currently classified as a dwelling, but is proposed to be converted to an office for a plumbing contractor's business. The property also contains an existing detached garage structure that is proposed to be removed, and, in addition, the recent site plan shows a proposed 64 ft. x 40 ft. storage barn, as shown of the site plan SP -1 drawn by James Deerkoski, PE, dated Sept. 28, 2014, latest revision dated Jan. 9, 2015. BASIS OF APPLICATION: Request for Variance from Article XI Section 280-49 and the Building Inspector's January 14, 2015 Notice of Disapproval based on an application to convert dwelling to single contractor's business, at; 1) less than the code required minimum front yard setback of 100 feet. RELIEF REQUESTED: The applicant requests a variance in order to convert an existing single family dwelling located in the B Zone district into a single contractor's business, and where the structure has an existing, nonconforming front yard of 19.5 feet, when Code requires 100 feet. AMENDED APPLICATION: Originally, a Notice of Disapproval, dated March 8, 2012, and updated on Oct. 24, 2014, was issued to the applicant for a change of use to convert the dwelling to Business (office) and to construct a four bay garage with office above. The proposal constituted two Principal uses on one lot requiring 60,000 square feet where the subject lot contains 20,419 square feet. During the Jan. 8, 2015 hearing, the applicant was asked to Page 2 of 3 — February 19, 2015 ZBA#6818 — Berry & Berry, LLC SCTM# 1000-75-5-13 bring the plan into more conformity with the code. The applicant then conferred with the Building Dept., seeking clarification and a possible revision of the original NOD that had been issued. The applicant on Jan. 16, 2015 submitted a new site plan survey with only one business use and a new Notice of Disapproval dated Jan. 14, 2015. The amended application requests one variance for a front yard setback of 19.5 feet where 100 feet is required at this location in the B district. ADDITIONAL INFORMATION: The Zoning Board requested comments on the original application from the Planning Board. In a memorandum dated December 18, 2014, the Planning Board stated they do not support the application as presented. The conversion of the existing dwelling into business use and the proposed construction of the four bay garage with office space above constitutes two principal uses on one lot requiring 60,000 sq. ft.. The lot size is 20,419 sq. ft.. They further stated concerns about the intensity of the use of the parcel, parking and traffic. The Zoning Board received a letter of support from a neighbor. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 8, 2015, and February 5, 2015, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance as applied for in the amended application will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed plumbing contactor's business will be constructed in an existing building with an existing nonconforming setback, and there will be no change to this nonconforming front yard setback. The proposed storage building will be used exclusively by the single occupant of the converted office building for storage of materials and company vehicles. A plumbing contractor's business is an allowed use in the B Zone. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing building has a nonconforming front yard setback. This building cannot be feasibly reduced in size in order to achieve a conforming setback, and it is not feasible to move the building to a conforming location on the site. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 81% relief from the code. However, the existing nonconforming front yard setback will not be changed or further reduced. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the Town Planning Board site plan approval. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of operating a plumbing contactor's business, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried, to DENY, the application as applied for, and Page 3 of 3 — February 19, 2015 ZBA#6818 — Berry & Berry, LLC SCTM# 1000-75-5-13 GRANT, the variance as applied for in the amended application, and shown on the site plan SP -1 drawn by James Deerkoski, PE., dated Sept. 28, 2014, latest revision dated Jan. 9, 2015. CONDITIONS: 1. The converted dwelling to a contractor's business, shall remain a single business use only. 2. Applicant shall obtain site plan approval from the Planning Board. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The Building Department issued a Notice of Disapproval stating that the lot size required is 30,000 sq. ft. for one business use in this B Zoning District. The proposed change of use to convert the existing dwelling into business use and construct a four bay garage with office space above constitutes two principal uses on one lot requiring 60,000 sq. ft. The lot size is 20,419 sq. ft. 2. The 20,419 sq. ft. nonconforming lot is located within the General Business (B) Zone in the hamlet of Peconic. To the west and north the property is improved with multiple structures, municipal owned and zoned Residential 80 (R-80). The parcel to the east is vacant and zoned B. Across New York State 25 to the south, the parcels are improved with single-family residences and zoned Residential 40 (R-40) and R-80. It is the position of the Planning Board that the two proposed uses (office and storage) contained within two separate buildings on the property, although meeting the purpose of the B Zoning District, is too intense of use for the parcel size and location. The Variance request is greater than 100%. . BerroBerry — Page Two — December 16*14 "The purpose of the General Business (B) District is to provide for retail and wholesale commercial development and limited office and industrial development outside of the hamlet central business areas, generally along major highways. It is designed to accommodate uses that benefit from large numbers of motorists, that need fairly large parcels of land and that may involve characteristics such as heavy trucking and noise." If the Variance is granted, a more intense use could be developed on the parcel on the second floor of the new building in the future contributing to intense sprawl along State Route 25. Parking - The nonconforming lot size poses constraints on site planning of the parcel. Parking proposed on the plans (SP -1) do not meet Town Code requirements. The Parking Criteria notation on the plan calculates the total number of parking spaces at 38. A total of 19 are provided with a notation that the Applicant will provide an affidavit that no more than 11 parking spaces will be required for the operation of the business on the premises. Eight spaces are proposed to be located within the new building. There is no ability to accommodate additional parking (on street or in a municipal lot) and with inadequate parking the proposed intensification of the parcel could result in safety issues. Parking in the State Route 25 right-of-way would interrupt the line of sight for emergency vehicles exiting the Police Department property. 3. Traffic — The Board has concerns regarding the increase in traffic entering and exiting the lot and impacts to the residential properties across State Route 25. The Planning Board fully supports the creation of additional commercial opportunities and jobs on parcels that can accommodate new development to adequately support the use. Unfortunately, for the reasons stated above, the Board's position is that the parcel is too small in size for the proposed uses. The southerly building (front) was renovated and preserved. It had been the homestead of the Berry ancestors, then used as an office and storage space by the Berry Plumbing business and tenant, ChemDry. The house is presently used as a residence, however, it is included in the site plan for office use. In the event that the "number of tenants" or "buildings" is regulated necessitating an area variance, then the two buildings will not change the character of the neighborhood or a detriment to nearby properties. The southerly building was preserved, retaining the "residential" appearance of the property. The property is surrounded by the Municipal uses of a police station, municipal storage yard, animal shelter and highway department. These uses are more intrusive commercial uses then the proposed business offices. The use on the premises is proposed as a Business Office (a permitted use), together with second floor office, with the businesses' truck parking in the bays of the northerly building and storage. The Berry's plumbing office will be in part of the northerly building, with their truck and storage. The other office spaces will be rented together with the truck bay and storage. Business Zoning lists permitted uses, in one building or multiple buildings. In fact the design recommendations for commercial buildings in B zone is for separate structures, so that no one structure exceeds 601. The code anticipates more than one commercial tenant and more than one structure. The proposed site plan has the office uses in both buildings. The code does not make each tenant office a "separate use" necessitating 30,000 sq.ft. Per use, the use of both structures is "Business Office" with parking and storage. The minimum lot size applies to the lot yield and area of the lot rather than, as the building department has determined, the number of commercial tenants or buildings. The tenants and buildings are limited by site plan elements such as parking. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: RECEIVED BOARD OF APPEALS The building inspector's determination is incorrect. No variances are required if the code is properly read that the use is "business office" with their assigned truck bay and storage. The truck parking and storage is accessory to the "business office" principal use. Whether it is all one office or multiple offices, the single use is "office". The site plan will address the adequacy of parking for the offices. As a plumbing contractor, Berry & Berry, LLC need an office for their paperwork, a space for their work truck and storage for their materials. If ChemDry, by example, occupies one of the other offices, it is for paperwork, the truck bay is for their truck and storage of equipment. In leu of working at home, this space provides office, truck parking and storage. The occupants of the space rarely meet with their clients, all jobs are made by phone. A variance, if applicable, should be granted in that the lot build -out is only 17.9% when 30% is permitted. (3) The amount of relief requested is not substantial because: No variance is required. The offices with the accessory truck parking and storage are a common single use throughout the two buildings. By maintaining the front building, the proposed northerly structure is screened from view. The Berry & Berry LLC property is surrounded by intensely and heavily used commercial municipal buildings and storage. Among the surrounding uses the Town operates the Highway Department, Police Department and impound yard, and the Pet adoption center. Also an auto body shop is a neighbor. The Town maintains multiple structures with no screening and many parked, stored, and towed vehicles are visible from the street and residential properties. The proposed development will result in a significant improvement to the surrounding area. The property is zoned B, however, the proposed site plan and use is specific for the contractor's business. Berry & Berry LLC plumbing is a second generation contractor operating in the Town of Southold. Therefore, other more intensive uses, including retail uses, would be permitted but are not proposed. The Planning Board's memo disregards the "proposed" use of the property. The opinion in the memo would be applicable if the owner intended a retail use in the buildings, rather than owner occupied contractor's business. Furthermore, upon careful review of the parking regulations, "contractor's business and yard" is specifically identified. Only 1 space for each employee, plus two spaces per employer is required. The previously submitted site plan had incorrectly calculated the parking. The spaces proposed are primarily for Berry & Berry LLC (the owners are the Berry brothers), they have no employees. Family members do the book keeping and billing generally after hours. With additional space for similarly run local contractors with few if any employees. The parking which is proposed is generous and complies with the Town Code. The proposed building will provide storage space for the contractor, a small office space, and inside parking space for their work vehicle. The Zoning Code allows Contractors to run their business from their home in a residentially zoned parcel, contrary to the Planning Board's opinion, the proposed contractor's business use in a B zone is as "non -intensive" a use as could be requested. The occupants of the proposed building could run their businesses in their home in residential communities. Berry & Berry LLC wish to operate professionally away from their home. In order to assure the Planning Board and Zoning Board that the proposed use is "Contractor's Business" the site plan was revised with the corrected, and specific, parking requirement. Only 15 spaces are legally required, and 15 spaces are proposed. Moreover, the setbacks of the structures also comply with the zoning setbacks. We have appealed the Building Inspector's determination that the two buildings constitute two "uses" requiring double the lot size. This interpretation is incorrect, particularly in B zoning.
