SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 30, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 3,500 square foot parcel located in an R- 40 zone. The parcel runs 35 feet along Bay Avenue, 100 feet on the North side, 35 feet on the East side, and 100 feet on the South side. The property is improved with a one story frame dwelling with attached rear deck. All is shown on a survey by John T. Metzger L.L.S. dated January 16, 2013 and updated last September 4, 2014. BASIS OF APPLICATION: Request for Variances from Sections 280-124 and the Building Inspector's August 28, 2014 amended September 5, 2014 Notice of Disapproval based on an application for building permit to construct additions and alterations to existing single family dwelling at; 1) less than the code required front yard setback of 35 feet, 2) less than the code required rear yard setback of 35 feet, 3) less than the minimum code required side yard setback of 10 feet, 4) less than the code required total side yard setback of 25 feet, 5) more than the code permitted lot coverage of 20%. RELIEF REQUESTED: The applicant requests variances to make additions and alterations to the structure as well as bring the structure into FEMA compliance. The proposed construction will result in a front yard setback of+/- 16.8 feet where 35 feet is required. The rear yard setback will be 25.6 feet where 35 feet is required. The single side yard setback will be 5.9 feet where 10 feet is required. The combined side yard setback will be +/-16 feet where 25 feet is required. The total lot coverage will be 29.2% where the maximum allowable lot coverage is 20%. ADDITIONAL INFORMATION: The applicant's agent testified that that the applicant's home was damaged during the flood surge of Super Storm Sandy. The applicant proposes to raise and renovate the existing one story home in order to be compliant with current FEMA regulations. A home is required to meet current FEMA Page 2 of 4—February 19,2015 ZAB#6808—Cooke SCTM#1000-31-17-6 standards if the owner plans on renovating the home by more than 50% of the home's value. The proposed renovations will exceed 50% of the home's value. In order to mitigate the view of the higher elevation of the building the applicant's agent offered to install shingle siding on the outside of the concrete foundation walls. Additionally, the Office of the Southold Town Engineer reviewed the application and in a letter dated December 10, 2014, stated, inter alia, that "[d]ue to the existing grade elevations and depth to groundwater, this cesspool extends down into the water table. From an environmental standpoint, the Engineering Department highly recommends that this septic system be mitigated to the greatest extent practicable in accordance with the Suffolk County Health Department Regulations. Please note that reconstruction of this existing system as an in- kind replacement at a higher elevation may require SCHD permitting and/or approvals." Further, the applicant's agent testified that they will be repairing the existing septic system. This repair will include removing the existing septic system as well as the piping for the existing system. The applicant will then bring in fill to raise the height of the new septic system, thus relocating same and then install additional internal and external piping and a new septic tank. According to a letter from the Suffolk County Office of Waste Management dated November 3, 2003, the Office of Waste Management requires that"new applications to utilize on-site septic systems must be submitted for review when any of the following are met: 1. When any part of the existing sewage disposal system must be relocated for any reason related to renovation or addition of a single-family dwelling or additional external piping to the existing system is required. 2. When an addition or renovation is proposed at this time for a structure that has a certificate of occupancy dated prior to 1973 and any increase in the number of bedrooms is proposed. 3. When an addition or renovation is proposed at this time for a structure that has a certificate of occupancy dated after 1973 and increases the number of bedrooms to the structure greater than four.... ." Several neighbors attended the public hearings. The neighbors' expressed concerns regarding the current malfunctioning septic system, the proposed height of the new structure and the lack of on-site parking. The neighbors also testified that the property is a low lying area which is prone to flooding. Several letters were submitted by neighbors objecting to the variances requested. At the public hearing the Board asked the applicant's agent to consider re-designing the proposed entry stairs located in the front yard to permit two on-site parking spaces per Town Code, and to also identify the distance between the edge of the pavement and the front yard property line. This information was received in an amended survey dated last revised Feb. 11, 2015 with a cover letter dated and received February 19, 2015. Finally, the house has a valid certificate of occupancy to be in its non-conforming location. However, the as built rear deck was added later and is a non-conforming structure which does not have a certificate of occupancy. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 4,2014 and February 5, 2015 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes and small non-conforming lots. Many of the homes have received area variances. The applicant is proposing to continue the siding down over the raised concrete foundation to reduce the look of the height. Additionally, the applicant's amended survey shows front entry stairs now running parallel instead of perpendicular to the front elevation of the dwelling, thereby reducing the encroachment into the front yard and permitting two on-site parking spaces. About half the homes on adjoining Rabbit Lane have already been raised to comply with current FEMA regulations. It is typical for homes in this neighborhood to have decks. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The home is on a small lot and the existing set backs are non-conforming. Due to the size of the non-conforming lot it would be impossible for any structure to be built Page 3 of 4—February 19,2015 ZAB#6808—Cooke SCTM#1000-31-17-6 without the benefit of an area variance. The existing as-built deck has a non-conforming rear yard set-back. It would be impossible for the applicant to have the benefit of a deck without the benefit of variance relief. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial. The variance for the front yard setback represents 48% relief from the code. The variance for the rear yard setback represents 27% relief from the code. The variance for the side yard setback represents 59% relief from the code. The variance for the combined side yard setback represents 64% relief from the code. The variance for the total lot coverage represents 32% relief from the code. However,the existing footprint of the house is not changing and the applicant is required to raise the structure in order to meet FEMA flood regulations. 4. Town Law 4267-b(3)(b)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install flood vents and drywells as per FEMA regulations. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a FEMA compliant home with a rear yard deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to GRANT, the variances as applied for, and shown on the Survey by John T. Metzger L.L.S. dated January 16, 2013 and last updated 2/11/2015, subject to the following conditions; CONDITIONS: 1)The applicant shall have two on-site parking spaces as per town code. 2)The applicant shall install shingle siding on the outside of the foundation walls. 3) The applicant shall obtain an approved septic system design from the Suffolk County Department of Waste- water Management for the proposed construction, a copy of which shall be submitted to the Zoning Board of Appeals for review prior to the commencement of any construction activities. 4)The applicant shall submit to the ZBA, architectural drawings (elevations and plans) showing the revised front entry stairs and siding on the foundation walls. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. You stated in said letter that that you met with Mr.Lyons from the Department of Wastewater Management (hereinafter referred to as the"County")and he advised that an application for the cesspool repair was not required. However,the Office of the Town Attorney has contacted Mr. Lyons as well,and has concluded that an application is indeed necessary in this instance. As you are aware,the Board has determined that there exists in the record bona fide issues with the existing septic system servicing your client's property and as such the Board believes that a review by the County is warranted. In fact,the grant of the subject variances were subject to securing, "...an approved septic system design from the...[County]..." The County has a policy whereby if a municipality conditions an approval upon County review the County will review the system, even though arguably it would not normally trigger review. Therefore, here since the Board requires review of the subject system the County will review same, and must approve the system before any action is taken pursuant to the variances. Thereafter, a stop work order was issued by the Building Department because a gabled roof had been substituted in lieu of the previous existing shed roof. The issuance of a stop work order prompted the filing of an application for zoning relief. In response to our application,your Board granted a variance authorizing the construction of a new foundation to protect the dwelling from future flooding events. The decision granting the variance which was filed on February 26, 2015, references a letter from Suffolk County Office of Wastewater Management dated November 3, 2003 which states, in part,that new applications to utilize on-site septic systems must be submitted for review when any part of the existing sewage disposal system must be relocated for any reason related to renovation or addition of a single family dwelling or additional external piping to the existing system. Here,we are not relocating the existing septic system. We are only lifting the existing cesspool out of groundwater. In addition,we are not adding additional piping. On March 26, 2015, Mr. Fischetti and I met with Edward Lyons of Suffolk County Office of Wastewater Management on this specific issue. Mr. Lyons concurred that an application is not required in order for Ms.Cooke to elevate and reconnect her existing cesspool. By way of this correspondence, I request to meeting with you to discuss this matter in further detail. Mr. Fischetti, P. E we would participate in such meeting. I believe that such requirement could be repealed utilizing the Board's"de minimus" procedure. Kindly advise as to your availability to meet.with Joe Fischetti and I. Please keep in mind that the majority of work proposed here is for compliance with FEMA Flood Zone Regulations. Elevating this existing structure will inevitably appear to be excessive when compared to the adjacent residence to the North. Please consider the following: 1. Under Policy 3 of the LWRP(Enhance Visual Quality&Protect Scenic Resources). In the opinion of the Engineering Department,the negative visual aspects of raising this structure should be superseded when flood damage prevention is a main focus of the renovation. Other mitigation could be suggested that may require siding over the concrete foundation walls or even adding windows to this lower elevation to ease the look of this elevated residence. 2. Under Policy 5 of the LWRP (Protect & Improve Water Quality). Existing site conditions show that this residence is served by a single Cesspool as its septic system. Due to the existing grade elevations and depth to ground water,this cesspool extends down into the water table. From an environmental standpoint, the Engineering Department highly recommends that this septic system be mitigated to the greatest extent practicable in accordance with Suffolk County Health Department Regulations. Please note that reconstruction of this existing system as an in-kind replacement at a higher elevation may require SCHD permitting and/or approvals. 3. The proposed basement/foundation plan shows flood venting that may be difficult to install with the amount of fill proposed. This item will be reviewed, modified or approved by the Building Department at the time of Building Permit Review. C. last dated February 11, 2015. The revisions to the survey depict a setback from the front of the existing dwelling to the edge of pavement at Bay Avenue. That setback is 35 feet. In addition, we were able to reorient the exterior stairs so it follows the front face of the building extending to the south. In doing so, significant space was made available for an additional parking space. Thus,there is parking that can occur along the northerly property boundary within the building a setback of 10.7 feet from the northerly side lot line, and an additional space for parking in front of the building where the distance between the stairs, now reoriented, and the front lot line is 16.8 feet. Having complied with the final requests of your board as per our most recent hearing of February 5, 2015, 1 request that you close this matter for all purposes and render a determination in the affirmative for the property owner. With this in mind I still have many concerns and unanswered questions regarding this project.The first being that the letter I received to attend the meeting on Dec. 4, 2014 was the first and only notification that I received from the town stating the homeowner was asking to build such a large home at such a height with the elevated stairs/decking etc. Additionally, I would like to know exactly where on the Cooke property the test boring was done and how based on that was it determined that the ground could support the weight of such a massive foundation and structure ?Also I have numerous concerns regarding the current cesspool which has not worked properly for several years prior to Hurricane Sandy, as the homeowner would use her family's residence across the street for bathing and toiieting Issues while hers was utilized as a barracks. Secondly the engineer,architect and contractors are making the recommendations it appears,solely on the information that Mrs. Cooke has provided them.What I think was being misunderstood while we were all trying to convey our points of view,was that this homeowner told Mr, Beaury and myself that she let her insurance policies lapse for a lengthy period prior to Hurricane Sandy and was unable to,or chose not to make the necessary repairs as did everyone else effected in our community due to lack of insurance funds.As It appears now she seeks to build something other than the original structure. No other homeowner was afforded the opportunity to completely change the appearance of their home and the landscape of an environmentally sensitive area. Her request and the proposals we heard are not in keeping with other homes on Bay Ave. We all would love to see this home restored to its original condition, as all the Bay Ave. homes were, but in congruence with each other. As it currently stands the home is greater than four and a half feet above grade which is significantly higher than all of the Bay Ave. homes. It Is my understanding from FEMA,who met with myself and Mr. Beaury the day after the Hurricane,that because these were not primary residences we needed to go through our personal homeowners insurance and flood Insurance to restore them.As instructed we did so 1211812014 15:58 Mount Pleas a TAX)6313824356 P.0021002 immediately and began the claim process and restoration of our homes.We did not seek to obtain grant money or funds from FEMA or any other government agency which was so desperately needed by those who lost their year round residences. We were all able to repair our homes in a timely fashion after Sandy in keeping with their original appearance. It was Insulting to hear the comment from the Suffolk Environmental Consulting representative as to how poorly my home was repaired. I'm sure the contractor that I hired would love to hear that he was deemed an Inferior craftsman. Yet of greatest concern to myself and my family is the following:if a structure of that proposed height,with up to an 11 foot concrete and block foundation at a peak height of approximately 21 feet Is built, who will help me repair my home from damages that can ensue from water from the proposed drain system and the potential of a home of that helght,'built on wetlands,falling upon my own. Who will police Mrs. Cooke to ensure that she maintains her Insurance policies for her home and grounds and who will guarantee the work done on this property? I would like a clear and concise answer to my questions so in the event of a severe act, by man or nature, I know who to direct my insurance company and litigators too. A monolithic structure as per the site plans would be an aberration relative to the other ecologically harmonious beach homes in the area. 2. The building would be a monstrosity; an unsightly,unsuitable,and thoughtless undertaking. 3. IIome values in the area would be adversely affected together with mass requests to lower existing taxes on existing dwellings. 4. Tourists visiting wineries and produce stands in East Marion often inspect nearby areas for a possible summer home. Should a prospective buyer drive down Bay avenue toward the water's edge and gaze upon an abnormal creation in the sky,he or she would surely not wish to settle in the area. 5. As conservationists,we believe that to allow a structure such as proposed in the plans, would be an affront to all that it means to be"at one with nature". The NYS Conservationist magazine often cites areas of interest on Long Island and would certainly find that a home built on unsightly supports would be incongruous with the scenic surroundings. 6. Lastly,but not finally,a structure up in the sky like an aerie adjacent to the home on 2165 Bay Avenue would be a callous indignity as well as dangerous and rife with cause for litigation.. My family's home is the adjacent property at 2165 Bay Ave. East Marion and stands to be directly negatively impacted by any and all proposed changes. Since this is the first and only notification I have received and it contains limited information I cannot agree with the proposed changes without knowing Fully how this will impact my home,the surrounding homes and the highly sensitive natural abutments. The makeups of the properties on Bay Ave.are small seasonal summer cottages which have remained unchanged for decades due to the environmentally sensitive surrounding areas. As homeowners we have always followed the guidelines set forth by the Town of Southold to assure that we under no circumstances disrupt the careful balance set forth. Hurricane Sandy was a shock to all of us no matter how prepared and proactive we tried to be. Every home in the neighborhood sustained damage of varying degrees.As homeowners we are obliged to maintain our properties and respective insurance policies so that when an occurrence such as Hurricane Sandy happens we are able to quickly respond to the damage at hand and restore our property to maintain the integrity of the neighborhood. Each of the homes affected on Bay ave.were appropriately repaired without changing the structure of the homes other than cosmetically and all were done in a timely fashion. The property at 2205 Bay Ave. has sat in a dangerous state of disrepair for over two years without any regard for the adjacent and surrounding properties. I have spent thousands of dollars on professional landscapers to prevent the Insidious overgrowth of vegetation that has not been taken care of by the homeowner from completely overtaking my yard. The house as it stands is unsightly,falling apart and dangerous to my home. it currently stands higher than all of the other homes on the street and has always stood out as such.To attempt to raise it even higher with the thought that this will prevent any future storm damage is ridiculous to say the least.We all live in and about wetlands and have a large bay adjacent to us.One cannot predict that a certain height will prevent damage. Look at the Hamptons where homes on high footings and foundations were swept into the sea. The value of my home has significantly dropped over the past two years and I fear will completely plummet if an abnormally large structure is permitted to be erected in an area that calls for maintenance of homes not complete restructuring of the vicinity. I implore this board to keep to the high standards that it has set as past practice and do not allow any changes to the original structure of this home. In addition,you are requesting a design change in the configuration of your front steps to your home as shown in the plans prepared by Don Feiler,Architect, last revised May 14, 2019. 1 reviewed your letter in which you described the additional time and cost to lift your house in order to conform to FEMA guidelines. You explained that painting the exterior foundation walls instead of installing siding would be less costly. Furthermore,you indicated that the currently approved front entry steps are too close to your property line to the south, and that your new configuration will still leave room for off-street parking of vehicles. Based upon the information provided, I have determined that the amended front entry step design is not de minimus in nature because it would increase the degree of non-conformity. Your new design proposes additional variance relief for a front yard setback of 8 feet, 7 inches(or 8.583 feet)which would be mathematically substantial at almost 50% from the original variance relief granted of 16.8 feet, and over 75% relief from the code which requires a 35 foot setback. Therefore, if you wish to proceed,you will be required to return to the Building Department to accurately detail the proposed front yard setback in order to obtain a new Notice of Disapproval, and then apply to the ZBA with a current survey or site plan prepared and stamped by a design professional for additional variance relief. At the time of your scheduled public hearing, you may present your reasons to the entire Board for rescinding the original condition that required the use of siding on the foundation walls to mitigate adverse visual impacts. . As I was a recent widow at that time and unfamiliar with local building requirements, I hired an Engineer, an Architect,Suffolk Environmental Consulting, and a contractor to help me begin the renovation process. In 2015 when my proposal went to the Zoning Board, it was determined that the exterior walls of my cement foundation should be covered in siding in an effort to "reduce the look of the height". Now that we are in the final months of work, I would like to revisit this issue. I am requesting to use concrete paint on the exterior foundation walls of my house.The paint is extremely durable and resistant to mold, mildew, and dirt; and is cost-effective. There are many paint options available in a variety of attractive textures and color which will enhance the look of the cement foundation. My house is in a flood zone—it does not make sense for me to invest in costly siding for the foundation. It could easily come off in a storm and/or get mold under it. I spent exorbitant amounts of money to lift the house so that I could avoid damage in future storms. The other current issue is the design of the front steps. At the Zoning Board meeting in 2015, an amended survey was approved with the front entry steps running parallel to the house. While this design would allow room for the required parking spaces, it did not take into account that the bottom of the stairs would be too close to my property line on the south side. Attached are amended plans from Architect Don Feiler, showing the steps redesigned. There will still be room for the required off-street parking, but the steps are more centered on my property. My architect, contractor,and I think this is the best alternative. (Mr. Feiler will amend the plans again if you approve a painted foundation.) Through the years I have complied with every rule and change along the way, and have tried to be patient with the process. I thought it was a good idea to conform to the FEMA guidelines; however I would never have imagined that the process could take so long and be so extremely costly. In hindsight, knowing the time and cost, I would not have lifted my house. My children and I love spending time in East Marion and Greenport, and it is sad that we have been unable to use the house for 7 years. I am hoping you can look at these issues and come to a quick resolution about them.
