Box 1179 Southold, NY 11971 Telephone: 631 765-1938 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: October 15, 2014 Re: Proposed Wetland Permit for MELANIE BELKIN SCTM# 1000-89-2-4 En -Consultants on behalf of MELANIE BELKIN requests a Wetland Permit to construct.a 12'x35' swimming pool raised approximately 1.8 feet above the adjacent concrete• patio to remain; construct approximately 83 linear feet of concrete retaining walls and place within walls approximately 30 cubic yards of on-site soil material to be derived from pool excavation and re -grading of lawn area adjacent to easterly retaining wall; install +/-5'x9' landscape steps to pool; install approximately 188 sq.ft. and 67sq.ft. concrete walkways, and 4'x5' concrete steps to grade; construct a 12'x12' shed and 5.5'x6' outdoor shower; install drywell, pool drywell, and 4' high pool enclosure fencing with self-closing gates; and establish approximately 1,677sq.ft. of plantings. Located: 1700 Cedar Beach Road, Southold. SCTM# 89-2-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessm ent is intended to supplem ent other inform ation used by a Town of Southold agency in m a k in g a d e t e r m in a t i o n o f c o n s i s t e n c y. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The proposed swimming pool is proposed to be raised to avoid interference with the water table, and the fill required to raise the pool will be contained inside proposed retaining walls to prevent the potential for altering drainage patterns or creating the increased potential for stormwater runoff. A temporary project limiting silt fence will be set in place between the work site and roadway to control and contain site disturbance and potential runoff during construction; and a new drywell and pool drywell will be permanently installed upon completion of construction to capture site runoff and pool backwash, respectively. Also upon the completion of construction, approximately 1,677 square feet of plantings are proposed to be established in place of existing lawn areas to provide additional soil stabilization and filtering capacity between the proposed structures and the roadway and wetlands, all consistent with Policv 5. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP ADDENDUM FOR MELANIE BELKIN 1700 CEDAR BEACH ROAD SOUTHOLD,NY SCTM #1000-89-2-4 Policy 6 Although the subject property contains no wetlands and is located approximately 200 feet from the nearest surface waters, there are vegetated tidal wetlands present within 100 feet of the property to the northeast and on the opposite side of a traveled roadway. The proposed swimming pool is located as far from those wetlands as practicable and more than 50 feet from the tidal wetlands boundary, as required by Chapter 275. The proposed outdoor shower and shed are located farther from wetlands and in line with the existing patio and dwelling. The pool is proposed to be raised to avoid interference with the water table, and the fill required to raise the pool will be contained inside proposed retaining walls to prevent the potential for altering drainage patterns or creating the increased potential for stormwater runoff. A temporary project limiting silt fence will be set in place between the work site and roadway to control and contain site disturbance and potential runoff during construction; and a new drywell and pool drywell will be permanently installed upon completion of construction to capture runoff and pool backwash, respectively. And although the establishment of a nonturf buffer adjacent to the offsite wetlands is not possible, approximately 1,677 square feet of plantings are proposed in place of existing lawn areas adjacent to the project area and between the pool and roadway and wetlands.
