Located: 2025 Bay Avenue, Mattituck. SCTM# 144-4-2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are .CONSISTENT with the LWRP. This recommendation is based on the following: No permits were found on file for the structures. The 1984 aerial photo set indicates that the bulkhead and boat ramp structures may be in place at the time.(Figure 1), however, due to clarity of the aerial photo, it is difficult to prove or disapprove. . In the event that the action is approved, it is recommended that the Board require a vegetated, non -turf buffer landward of the bulkhead. Further, all intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III — Policies; Page 2 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable Subject proposal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly and siting/utilization of the proposed reconstructed/reconfigured bulkhead will maintain the character of the surrounding neighborhood which currently consists of many similarly -improved residential lots with similar accessory structures (i.e. dock assemblies and bulkheading along James Creek). In addition, subject proposal will be in harmony with the "...beneficial use of a coastal location..." in that the legally created residential waterfront (i.e. coastal) lot will be enhanced by the reconstructed dock assembly in order to maintain access to the contiguous surface waters and the maintenance of existing erosion control structure (i.e., bulkheading).
