En -Consultants on behalf of DAVID & ELIZABETH ROSS request a Wetland Permit to reconfigure
the westerly portion of stone armor by removing from right-of-way approximately 53 linear feet of
stone armor and +/-15 cubic yards of sand backfill and placing approximately 48 linear feet of
relocated 1-2 ton stone armor (over +/-1001b. core stone and filter cloth), and reused sand backfill
outside boundaries of right-of-way; and to restore/re-vegetate relocated sand and disturbed portions
of vegetated berm landward of stone with Cape American beach grass (12"o.c.). Located: 170 Park
Avenue, Mattituck. SCTM# 123-8-24.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with
the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS

proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law, This
assessm ent is intended to supplem ent other inform ation used by a Town of Southold agency in
m a k i n g a d e t e r m in a ti o n o f c o n s i s t e n c y. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nif�nt
beneficial and adverse effects unon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non -
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions. it shall not be undertaken.

LWRP CONSISTENCY ASSESSMENT FORM
POLICY 4
The purpose of the originally proposed and permitted (Wetlands Permit 8249, 7-17-13) project was to
restore a previously existing natural protective feature, i.e., a naturally vegetated berm, which was
avulsively lost to erosion during Hurricane Sandy in November, 2012. The project sought to restore the
pre -storm site conditions and introduce stone armor along the toe of and atop a buried steel bulkhead to a)
increase the potential for the renourishment and plantings to become successfully established; and b) once
established, to provide a reasonable measure of protection for the restored berm during a severe storm
event.
The project was consistent with Policy 4 because vegetative resource enhancement was the primary
component of the design and the hard stabilization component was included for the protection and
enhancement of the vegetation where prior efforts to preserve that vegetation had proven to be inadequate.
Given the large fetch along this stretch of shoreline and the demonstrated vulnerability of the vegetated
berm at this site to be lost avulsively to erosion during a storm event, providing some form of hard
stabilization at the toe of the renourished berm was the only practicable design consideration that could
effectively provide toe protection for the restored berm. Ultimately, the goal of the project was to restore,
enhance, and stabilize the natural protective feature of the property to minimize loss of structures and
natural resources from flooding and erosion, consistent with the goal of Policy 4. The project was
successfully implemented in the spring of 2014 and received a Certificate of Compliance on May 7, 2014.
The current project is designed to remove and relocate landward the most westerly portion of the existing,
previously permitted stone armor and associated sand backfill such that no stone or backfill will be
located within the boundaries of the right-of-way over the subject property. As part of the originally
submitted plans and applications to install the stone armor, the stone was inadvertently proposed to be
located inside the boundaries of the right-of-way because the right-of-way was not depicted on the land
survey that was used as the basis of the original design plan. Therefore, the proposed reconfiguration of
the structure will remedy this situation and will otherwise remain consistent with Policy 4.

The proposed stone armor is located entirely landward of the spring high water line and thus out of the area of regular and periodic tidal
inundation and thus does not inhibit public access along the shoreline.
However, due to the omission of a private right-of-way on the land survey that was used as the basis of the original plans for the
structure, the most westerly portion of the stone and backfill were placed within the boundaries of the right-of-way, thus creating the
potential for obstructed access through the right-of-way. The reconfiguration of the structure proposed herein will remedy this situation
by relocating all stone and backfill outside the boundaries of the right-of-way, thus making the project fully consistent with Policy 9.
