The AT&T antennas have a total elevation of thirty-eight (38) feet. The total elevation of the steeple with the top mounted cross is sixty-six feet one inch (66' 1"), see figure 1. AT&T Mobility plans to add new equipment cabinets in the current leased space located in the Church basement, see figure 2. The purpose is for AT&T Mobility to provide new high speed wireless broadband service to complement their existing cell phone service on Fisher Island in the jurisdiction of the Town of Southold. The location is Our Lady of Grace Church and is physically located at Oriental and Ettrick Avenues in the Town of Southold jurisdiction see figure 3. AT&T Mobility is in the process of upgrading their existing services by modifying their antenna and related equipment at all their sites throughout the United States. This application is one of many similar type proposed changes intended to provide new fourth generation (4G) LTE service into the general area. LTE is the Applicant's version of fourth generation technical service. LTE means long term evolution or candidly the service will require an unknown amount of time prior to substantially provide very high speed data transference. The LTE technology is for high speed wireless broadband implementation. The final configuration will consist of three (3) panel type antennas and six (6) new Remote Radio Head (RRH) units, a Raycap DC surge protection system and a microwave dish antenna for backhaul data transfer all located at generally the thirty-five (35) foot elevation level see figure 4. The antenna sections, remote radio heads and Raycap equipment vary in elevation to fit within the general area and the difference is not something that would impact the Town's application process. Interconnecting the ground equipment and the related antenna propagation equipment will be a combination of feed lines and fiber optics cable. June 14, 2013 Telecommunications Site Review Page 2 New York Concealed Facility Upgrade In this particular situation the changes being made for AT&T Mobility is within a Church steeple and will not cause an overload concern; although the applicant did submit a structural analysis. Likely because that has been the past practice but in this situation it was not necessary since the equipment is not exposed and does not have a windload impact. The only potential structural consideration would be the deadweight of the changes which is minimal, see figure S. The Applicant supplied calculations to assure compliance with all FCC standards regarding human exposure to Radio Frequency energy. The Applicant's spectrum will operate in both the 850MHz range and the 1,900MHz range but should not be an interference concern to the Town's public safety communications. The Applicant is required to state they will comply with federal interference rules and the federal rules regarding human exposure to radio frequency energy. That was not initially submitted but when requested was promptly provided, see figure 6. All designs and plans for the proposed new facilities were developed according to accepted practices of RF propagation engineering and the persons completing all work are sufficiently qualified within their disciplines. Therefore CityScape as wireless expert for the Town of Southold recommends this application be approved as submitted and including the supplemental information. Respectfully submitted, Richard L. The modification proposed is part of AT&T's "LTE" (Long Term Evolution) project which will allow AT&T to provide better, faster and more reliable service in the Town. The Middle Class Tax Relief and Job Creation Act of 2012, codified at 47 United States Code §1455 (a copy of which is enclosed) provides that "a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station." We respectfully submit that this proposal is an "eligible facilities request" pursuant to 47 U.S.C. §1455(ax2) as it proposes only to replace and collocate certain transmission equipment on the existing tower and modify equipment inside its existing equipment shelter. As such, the proposed modification will not "substantially change the physical dimensions" of the existing tower or base station. Moreover, the Telecommunications Act of 1996, codified at 47 United States Code § 332, as interpreted by the Federal Communications Commission ("FCC") in its Declaratory Ruling 09-99 and Order On Reconsideration 10-144, requires that applications such as AT&T's be processed within 90 days. We enclose the following in support of the proposed eligible facilities request: 1. Town of Southold Building Permit Application form detailing the eligible facilities request; 2. Owner's Authorization Affidavit; 3. Building Permit Application fee: Check of Bechtel Corporation (Check No. 1170) in the amount of $500.00; 4.
