SUPERVISOR RUSSELL: Please join in the Pledge of Allegiance to the Flag. Thank you. I
would invite anybody that would like to comment on any of the agenda items to please feel free?
Nancy Sawastynowicz, Cutchogue
NANCY SAWASTYNOWICZ: Good evening, Nancy Sawastynowicz of Cutchogue. I would
like to say that I am in support of the Southold Indian Museum, I think it is a very nice gesture
that we support them. Then I am questioning the resolution #2015-92, the Ford Escape.
SUPERVISOR RUSSELL: Yes.
MS. SAWASTYNOWICZ: I am questioning that.
SUPERVISOR RUSSELL: That's for replacement of the vehicle that I damaged the night of the
accident. It was unrepairable.
MS. SAWASTYNOWICZ: Well, I think it is a lot of money. Taxpayers are paying a lot of
money for vehicles that have been, I have a record of four accidents, so....

SUPERVISOR RUSSELL: You are incorrect and you need to read the accident reports.
MS. SAWASTYNOWICZ: I have the dates right here. Should I read them off?
SUPERVISOR RUSSELL: Every single one of them but for the last one was, in two instances it
was in a parking lot and they were hit by another party and the third instance it was traveling
from the Annex to here, I was hit by another party. In every instance, it was paid for by the
driver of the other vehicle.
MS. SAWASTYNOWICZ: But still they are accidents. My insurance company calls it no fault,
it's nobody's fault. But you were in possession, responsibility of the cars that were in these
accidents...
SUPERVISOR RUSSELL: Right.
MS. SAWASTYNOWICZ: It's costing the taxpayers a lot of money. I don't know whose fault
it was but...
SUPERVISOR RUSSELL: Well, it's an important underlying issue as to who is at fault.
MS. SAWASTYNOWICZ: Not as far as my insurance agency is concerned.
SUPERVISOR RUSSELL: Our insurance is purchased across the whole fleet. It is not
uncommon for town vehicles to be involved in fender benders on a regular basis.
MS. SAWASTYNOWICZ: Well, I disagree and I think it is costing the taxpayers a lot of money
and I think to get another new vehicle for you is out of line. What is wrong with the blue van
that is out there right now?
SUPERVISOR RUSSELL: There's nothing, actually we are going to acquire the new Escape
because we need to replace it in the fleet. I will talk to the Board as to whether we should put
that into Human Resources or another department and I can utilize one of the older ones. I don't
care...
MS. SAWASTYNOWICZ: I see the blue van out there...
SUPERVISOR RUSSELL: That's fine. Just so you are clear, I don't care what I drive. I didn't
ask for the new vehicle last year, the Town Board was buying a new vehicle, they asked me to
take that one because it was more fuel efficient than the other Escape before that. They took that
Escape and gave it to the code enforcement officer. Frankly, the van is fine. I could care less.
MS. SAWASTYNOWICZ: My next point is, why are we buying such gas guzzling expensive
cars?

SUPERVISOR RUSSELL: We actually are buying the most fuel efficient SUV's on the market.
In many instances we are trying to convert the fleet to hybrid, we bought a couple of Ford
Fusions already.
MS. SAWASTYNOWICZ: Okay.
SUPERVISOR RUSSELL: Some of the positions require the all -wheel drive which is what the
Ford Escape will be.
COUNCILMAN GHOSIO: Resolution 94 is for a C Max. And the C -Max
JUSTICE EVANS: She mentioned 92.
MS. SAWASTYNOWICZ: I'm just concerned with the taxpayers money. You know. That's
my big concern.
SUPERVISOR RUSSELL: Understood.
MS. SAWASTYNOWICZ: Okay. Thank you.

Comments regarding resolution 88
COUNCILMAN RULAND: Mr. Supervisor, I am going to recuse myself from voting on the warrant as
there is a conflict of interest between myself and one of the vendors.
JUSTICE EVANS: I have the same issue because there is a payment reimbursable to me.
SUPERVISOR RUSSELL: Then we can't, we can't approve it. I should mention at this time,
Councilman Dinizio regrettably couldn't make it tonight, he has a personal issue to attend to and I know
he wanted to be here.
JUSTICE EVANS: Can we approve it all but the one item for me and the one for Bill?
SUPERVISOR RUSSELL: Okay. Yes.
JUSTICE EVANS: It's only the one item where it's reimbursing me, I can't approve.

Hurricane Sandy Disaster Grant - Downs Farm
Financial Impact:
Grant from NYS Office of Parks, Recreation and Historic Preservation in the amount of $30, 000 for the
removal of trees damaged by Hurricane Sandy. This grant is 100% reimbursement by NYS OPRHP
RESOLVED that Scott A. Russell, as Supervisor of the Town of Southold is hereby authorized
and directed to accept grant funds from the New York State Historic Preservation Office in
accordance with the provisions of Public law 113-2 Hurricane Sandy Disaster Relief Assistance
Grant Program for Historic Properties, in an amount not to exceed $30,000 and upon approval of
said request to enter into and execute a Master Grant Agreement with the New York State Office
of Parks Recreation and Historic Preservation for such financial assistance to the Town of
Southold for the Downs Farm/Fort Corchaug Site Restoration Project and preservation covenant
to the deed of the assisted property, all in accordance with the approval of the Town Attorney.

address the Town Board to please feel free?
Benja Schwartz, Cutchogue
BENJA SCHWARTZ: Good evening. Benja Schwartz, Cutchogue. I would like to start with
quick story if I may, it's been a long week. You don't know what you've got till it's gone. A
couple of years before the Sandy storm, I lost a huge, about 40 foot tree growing on the side of
my property, fell all the way over my garden, almost hit my tractor shed. During Sandy, one of
my big maple trees came down and it was right up against my red cedar, I had to move fast
because somebody didn't want the red cedar being hurt by that. This last summer, 60 foot
Douglas fir tree became obvious it was dead, totally dead, I believe it died from salt spray from
hurricane Sandy, it's not easy to wash spray off a 60 foot high tree. It's not easy to take down a
60 foot high tree, one reason I am tired is I was working. I went up about 25 feet and I realized
how high it was and I started thinking about calling a tree company. It's hard to get hold of a tree
company these days. And then I realized that the tree was only half on my property, the other
half of the tree was on the town's property. I called the highway department, they came over and
looked at it and they could see that the trunk was right on the property line and they brought the
town's cherry picker over, took off the top of the tree, took it down. They left about a 15 foot
stump, it's still around. I guess I got inspired by that and the maple from Sandy was ready to
burn, I needed some fire wood so I hired someone to come with a big splitter and we split the
wood from the maple and at the same time I went back and split that 40 foot tree that died a
couple of years before Sandy. In splitting it, I really became curious as to what kind of tree it
was. And nobody I asked could tell me what kind of tree it was. I finally id'd it with a little help

from Google. It was a sour wood tree, also known as sorrel tree or lily of the valley tree.
Beautiful tree, I think I might try to plant another one. Anyway, I just wanted to share with you
a little, I wanted to thank the town for working together and I think that's the way it can be done,
you know, the tree was half on our property, half on the town's property. So I was very happy
that worked out that way. I am not so happy about a FOIL request that Nancy filed after
attending the code committee meeting, the most recent code committee meeting. In December,
the code committee produced draft legislation pertaining to changing residential zoning all over
town to accommodate aquaculture including shrimp farms. When questioned as to why the town
would do something like that, I think the Supervisor said, I don't know, there was a letter from
NYS Agriculture and Markets division that said that we had to allow it. We asked to see that
letter and didn't receive anything until we were at the code committee meeting. At the meeting,
we got a copy of a letter, I thought that was the letter, it was a letter from Agriculture and
Markets, it was on the same subject however, it was dated January 6th or 9th, but it was dated in
January. When I got home and we read the email from the town, we realized that our FOIL
request to see a copy of the letter had been denied, that it was being considered a private letter,
personal letter for the town, well, that's what the town attorney said during the meeting, that it
was not subject to SEQRA and it was being denied. Well, it's one thing if you deny a letter but
if you are talking about a letter and you give the letter as a reason for action that you took and
you present the letter as the authority of the town imposing it's will, of the state imposing its will
on our town then I am very curious what was in that letter. The letter that we did receive was
transmitted with a cover letter that presented it as a formal opinion letter. Now I don't know
what that meant to the person writing that but that came from the town attorney's office and in
my understanding as an attorney, a formal opinion letter from the NYS Agriculture and Markets
comes from the commissioner, not from one of the attorneys in the department and those letters
from the commission, there's a procedure under the right to farm law, the New York State right
to farm law by which a town can request or a person can request, a farmer or any resident of the
town can request a formal opinion letter. We don't have a formal opinion letter. With all due
respect, Nancy is talking about maybe she wants to appeal the denial of the FOIL request. We
would like to see what was in that original letter. Not just because we are obstinate and think
that it's significant in that singular case but it sets a precedent when the town can deny a request
to see something and then substitute something else in its place.
TOWN ATTORNEY FINNEGAN: Can I address that, Benja?
MR. SCHWARTZ: Sure.
TOWN ATTORNEY FINNEGAN: There's no precedent. It's called an inter -agency
communication between the Department of Ag and Markets and my office. It happens all the
time and it's not subject to FOIL. We understood that you wanted to know the basis for the
town's position, that aquaculture was a protected practice and we gave the letter. If we misspoke
and called it a formal opinion, I apologize for that, that may have been my office's error. But I
don't think we need to get bogged down in the semantics of it, it is what it is. It's a letter from
Ag and Markets which addressed an issue that we presented. If you feel the need to appeal it,
that's your right.

TOWN ATTORNEY FINNEGAN: I presume they said the same thing, that it was an inter-
agency communication.
MR. SCHWARTZ: Not exactly, not exactly.
TOWN ATTORNEY FINNEGAN: Thank you.
SUPERVISOR RUSSELL: Let me just correct another record, Benja. The town is not looking
at this concept because we are forced into a corner as one local person who likes to avail himself
of social media says, it's a concept. We have to look at the concept. We have to be mindful of
the fact that we cannot be too restrictive with regard to agricultural operations. We do have
certain abilities such as site locations, site design, things like that but to be candid, agriculture is
changing a great deal. Technology and economic necessity is looking at new crops and new
ways of producing crops. I think it would be extremely small minded and lack complete vision if
we are not at least willing to look at the other operations that are out there, the other concepts,
the other models. That's what we are supposed to do as a town. We also take guidance from Ag
and Markets with regard to this and all other issues. Special events legislation, you name it, site
plan requirements, that's what we do. They are an agency that's there that's meant to advise.
And we take their advice as best we can as we are looking to make our decisions locally.
MR. SCHWARTZ: I agree with everything you said except that I believe that preparation and
planning and town actions should be decided upon through proper procedure. In this case, the
agency of the town that's acting is one of the committees and I called it to the attention of this
Board last year that the organization of committees in the Town of Southold is in dismal
disarray. The irony which really has been giving me nightmares is that the Town of Southold
code committee is one of the worse violators, one of the worse is operating in conflict with the
Town of Southold code. Now that's just a little, I apologize for the play on words because the
code committee doesn't, isn't responsible for the code but it's hard to know what the code
committee is responsible for because there is not easily accessible posted the establishing
resolution. The code of the Town of Southold which maybe wasn't created by you as individuals
but it was created and written by the Town Board of the Town of Southold so one would think
that the Town Board would want to follow that. And I am sure you are familiar with chapter 13,
it fits on one page. Most of the important language is in chapter 13-3, duties. In each instance,
the Town Board must designate the purpose of the formation of the committee, its scope or task
or duration. A. B. Each committee shall be accountable to the Town Board unless otherwise
directed. Minutes shall be kept during each meeting and shall be filed with the Town Clerk
within 14 days of any meeting. Oh, come on, I didn't bring the, okay, I contacted the Town Clerk
to find out about the minutes for the, I didn't just want to know the minutes, I wanted to know
who was in the committee. Well, I was informed that there are no minutes because there is no
secretary. New York State Department of State puts out a little brochure or pamphlet on how to
run public meetings, designed to educate New York State towns that run public meetings. In it
they say if there is no secretary, then perhaps one of the members of the committee who is
competent could take the minutes but not the chairperson because that would distract the

chairperson from running the meeting. You know, I think these days anybody could do a good
job not just of taking minutes but of documenting the meeting. Now, we have been hearing a lot
for years about plans to take minutes of the work session of the Town Board but this could be
done for all the meetings. I would like to just show the Town Board this particular device here
which was purchased a couple of years ago when somebody asked me to help them document the
meetings that they were involved in, happened to be for a not-for-profit institution. It was about
a $75 digital recorder. It is capable of recording 515 hours of talk and it's designed to record a
conference or a meeting. So you can get much cheaper recorders or cameras but you might hear
one person or not another, this little thing here will pick up every person clearly, you will get a
better recording than we are getting through the Cablevision sponsored recording of this meeting.
It is sometimes hard to hear the various voices. I highly recommend a high quality digital voice
recorder and if nobody on that committee is willing to take the time and tape the meeting, I think
it wouldn't be too hard to find volunteers who could do that for the town and could work with
the town, well, could try to work with the town website. I would like to just keep moving here,
in the interests of not taking too long. You know, looking at the one committee, the code
committee, I then started looking at other committees. And the, as I said, the disarray on the
town website which I pointed out last year and there was a suggestion that something was going
to be done about it, something has been done maybe about 5-10 percent of it has been cleaned up
but not .even really that because there's fundamental problems. An intelligent person who
understands how websites work and looks at this Town Board website and understands how
town government works, would say that this website is an advertisement for the Town Board.
It's just propaganda. The first thing on the government menu is town supervisor, town board.
Unfortunately, when you click on that link, the only place it takes you to is the staff directory,
the listing of the names of who is on the Town Board. I don't think it even says when they were
elected or how long they'll be in office or anything. There is no town board web page. Then
there's a link for departments, there's a listing of supposedly the departments in the town, there's
a link for committees and a listing of supposed committees. There's problems because there's
committees here on department page, the departments might be on the committee's page, I
offered before a year ago to help you, to straighten this out and I will do it again and I have
prepared a form that can be used to clean up and fix the obvious problems but it is going to take
a commitment to make some changes and to understand issues like the difference between the
Planning Board and the Planning Department. Is there anybody here that does not understand
that there's a difference between the Planning Board and the Planning Department but on the
website they are compressed into the same webpage. The Zoning Board of Appeals has its own
webpage but the Planning Board is on the Planning Department webpage. The major difference,
the most important difference between the Planning Department and the Planning Board that I
know of as an attorney is that the Planning Department is subject to the authority of the Town
Board. The Planning Board on the other hand, has some independent authority. They are also,
some of their work is done at the behest of the Town Board and as advisory to the Town Board
but they also are enabled by a New York State law to act independently of the Town Board. In
some cases, they have had to hire their own attorneys and sue the Town Boards but the Planning
Department could never do that because they work for the Town Board. The Town Board also
assigns them to work for the Planning Department and for other departments, the Zoning Board
of Appeals etc. But to have the Planning Board underneath the Planning Department is just, it's

an abomination. So there are a lot of other problems there, if you need help or if you would like
help, I am available. You know how to contact me.
SUPERVISOR RUSSELL: Let me just address the website. We definitely need a facelift that
we are anticipating doing in 2015 but I also want to acknowledge you because when we got here,
I think most of this Board, you knew that website wasn't, just the shortcomings of that website
and you stayed on it until we updated it and I think you had a large part in helping fuel the
change. We have got a ways to go, no doubt but I think it is far better than it used to be.
MR. SCHWARTZ: I think we can do it but can I, would you make a commitment to work on it
this year? What I feel like, first of all, there's more than one website. This town has about 5
websites but in particular we have one that is hosted by the laserfiche corporation and holds
many records there and then the other one, the general purpose website that, I forget the name of
the company out in Manhattan, Kansas, but there's a listing of the committees on the laserfiche
and on the website and sometimes the same committees have different names or some
committees are on one but not on the other. That should be, they should match. Then each
committee, there should be one place you can go whether it be the website or laserfiche, the
decision has to be made. It doesn't have to be made, you could have some of them on one, some
of them on the other but the appropriate use of the internet and websites, would be to have both
of them refer to each other and it is not necessary to duplicate the information on both. It would
be a lot more convenient if people could go to one and look up the information and if they
needed to, they could be referred to the other for additional information. Information including
the official name of the committee, the establishing resolution of the committee, the agendas of
the committee, the minutes of the committee, correspondence of the committee, reports by the
committee, a listing of who the chairperson is, the secretary, the ex officio members from the
Town Board, the Town Board liaisons, ex officio members could also come from other offices.
The members at large, whether there are open positions and how to contact the committee. I
think that's a good outline. I think every committee could have almost all of those categories
populated. Okay. One other thing I would like to talk to you about tonight and I apologize
because it is something that you have expressed a desire not to talk about but this is the open
portion of the meeting and I think we are entitled to talk about the things we would like to talk
about. So there's five of you up there tonight, I have six or seven of these, would anybody like
to look at this while I read it? Do you recognize what that is there? What this is, it's a one
page...
SUPERVISOR RUSSELL: Yes.
MR. SCHWARTZ: Of a 27 page document and I have highlighted five sections on the page. To
that paragraph 31, 1 have a hard time understanding that. What that means. I will read what I
have highlighted, it's not too long, I have taken out most of the verbiage. The town and its
various boards, agencies and officials shall not object to any applications of NoCro, the Heritage,
to non -town agencies and officials including but not limited to water supply and or sewage and
waste water disposal so long as any such application is consistent with the Planning Board's
SEQRA findings. Now, I thought that we had an agreement with the Suffolk County Water
Authority and a water supply map of the Town of Southold and I thought that that was worked

out and would not be changed without public input. But here it sounds to me like the Town is
just saying to the development known as the Heritage at Cutchogue, it's not the Heritage of
Cutchogue, it's the Heritage of Nolan and Cron, the families that owned that or still own that
property or have interest in that property on which they are now being allowed to make an
expedited application for development of 130 condominiums on a 47 acre piece of farmland.
With all the money that this town has spent preserving farmland and I know this zoning has been
in place for a long time but it doesn't, it should never have been there, even when it was done, it
was immediately, what happened back in 30 years ago was after the Town Board zoned the
property without much input, the Planning Board said you have to do an environmental impact
statement and the developer said I am not doing one and sued the town and the court said if you
want to develop, you have got to do an environmental impact statement. Well now the Town
Board in my understanding of this is basically saying you don't really have to go through an
environmental impact statement, we are not going to oppose your application in connection with
water supply and waste disposal. Now does this make any difference? Well, I think it does. I
think that the fresh water supply in this town is a very important thing, it has been compromised
in many respects, it has been turned over to Suffolk County Water Authority in many ways but
many people still have wells, we still have some pretty good water in the ground, it gets
recharged. I think we need to protect it. And 130 condominiums with huge retaining pools, they
are calling open space even though they are impervious because they are closed off so the water
will not recharge back down into the ground etc, I don't want to go through the whole thing but I
don't know if it makes any sense for me to go to the Planning Board and express my objections
because the Planning Board here has agreed with the Town Board and the developer not to
oppose any application for water supply or sewage and wastewater disposal facilities, not
treatment facilities because that's basically what the town has already given up advocating for is
wastewater treatment, sewage treatment...
SUPERVISOR RUSSELL: But you are missing the key component that you highlighted, so long
as any such application is consistent with the Planning Board's SEQRA findings. So any issue
such as groundwater contamination, all those things should be raised as part of the review
process. These are the things you need to bring to the Planning Board to have the Planning
Board address.
MR. SCHWARTZ: And it continues, the Planning Board SEQRA findings and the Planning
Board's final site plan approval, both of which come at the end of the process.
SUPERVISOR RUSSELL: That's because the public is given an opportunity to participate...
TOWN ATTORNEY FINNEGAN: Inaudible.
MR. SCHWARTZ: But the town, the various boards, agencies and officials of the town
including the Planning Board itself and the Planning Department and anyone else who is
involved in the water map, planning or, you know, is agreeing not to oppose the use of
wastewater sewage disposal rather than treatment for such a high density...

SUPERVISOR RUSSELL: You are incorrect. You are incorrect. And these issues will be
addressed as part of a full environmental review. You should bring these concerns to the
Planning Board. They have retained full right to review the application and listen to public
input with regard to concerns.
MR. SCHWARTZ: If it is a full review, then it should take a full amount of time but it's not.
It's being accelerated and condensed and limited. And I think this town deserves better. I think
if you look at what is going around town here, here's another case of the town by settlement
giving up before we even lost. We have lost a couple of lawsuits, that development going in
across from the town beach up there. That wasn't approved by the Town of Southold, it was
approved by the court. I understand that. But if the town wants to do things right, then we have
a lot better chance of controlling overdevelopment and development which has negative impacts
not just on the environment but also on the human environment. I love this town, I am not going
anywhere. I am going to try to protect it, even if you're not.

GEORGE ALDCROFT: I'll be quick. George Aldcroft, Mill Lane Peconic. I am here again, I
want to thank you for being at the code meeting because you made sure that it stayed, okay, on
zoning which is the appropriate place and I also appreciate the fact that you, the draft was
changed which removed a residential, although it kept in the agriculture and also the industrial
because I have been doing as much research as I can. There is no way you can stop aquaculture
out here, I don't think there is any way you should try to stop it. There is a need in this country
for it. There are places that may be better for it than here only because when I have taken a look
across the country is that there are farms that do it but they have 500 acres, they are out in an
area that they have a tremendous amount of water. There are things that we probably have to do
on Long Island that some other places don't, I checked off Florida etc., they don't have some of
the water, it's amazing when I take a look at some of the water quality and how the state etc.
isn't worried and EPA about the water on our Long Island. We are one of the two states that
they feel they have to spend $20 billion to do something with our state water. So we deal with
some different problems than some other areas do. What I have against residential is when I take
a look at it, we have put rules in which it needs to be protect the farm but in so doing, we also
have some farms that have come in and maybe it's not like the old days, I have been here only 40
years, I am not like I have been here ever since I grew up but it seems the residents and the
agriculture and the people work together so the farmers cared about what was happening on their
property and how it was treating the residents and the residents, did we care? Yes. We wanted
farm preservation in and we also went with the right to farm, something that we needed in to
protect the farmer. But then you get some people and they come in and they don't care. We
have had one with a vineyard, we have another one that runs machines and with refrigerator
trucks all night long and because it is on an agricultural piece of property, we can't do anything.
I have against residential, not only because you put these things close to someone's house where
we are going to have 20 or 30 tanks or whatever, we also have to take a look at a lot of other
factors, I think from checking with the EPA and checking with the DEC and the agriculture and
marketing, we probably have enough stuff and regulations that can control what will happen with

the discharge, I think it only should be you know, zero discharge but whether or not we have to
put that into a law and obviously the bacteria and the shrimp and the type of fish that are allowed
to be here because there have been problems around the world but I think that they have enough
in regulations to control that but the one thing you put it in residential and you make it a piece of
farm, we cannot according to your noise code, control any noise. So these people would be able
to run generators, air conditioners, 24 hours a day because you need to do that to keep those
pools running and we would have no control over how noisy it would be in residential areas.
Now we can't stop them, maybe agricultural areas because maybe that was the way it was
designed and if you bought a piece of property next to an agricultural area, well, maybe that's
what you should know, that is what is there, that's what is called agriculture. But when people
have bought residential, I will not be affected directly by whatever decision you make, there is
nothing by my house that is five acres that somebody can do something with but I also care about
my other neighbors and people in this who have bought residential property, that should never go
there and I guess I got a little upset when all of a sudden I am finding out from the agriculture
committee are saying that we are almost denying some of the rights of agriculture if we don't
plus they are also looking at the protected land that originally we bought to protect and we paid
money to protect, they think that should be included also. I am worried about that. I wanted to
give you my opinion. Thank you.

SUPERVISOR RUSSELL: I appreciate it, George. Just as a point of information, we have
several committees here who serve in an advisory role to the Town Board but we recognize those
committees are looking at it from their particular focus, so we take everything, all the input we
can get and then we use that into factor the decision making. Thank you. Would anybody else
