The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. It is
my recommendation that the proposed actions are EXEMPT from LWRP CCR pursuant too:
§ 268-3. Definitions. MINOR ACTIONS item "F" which states:
F. Granting of individual setback, lot line and lot area variances, except in relation to a regulated natural
feature or a bulkhead or other shoreline defense structure or any activity within the CEHA
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed
action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

After investigation and inspection the Board finds that the
applicant requests permission to create second dwelling unit on
lot with less than required area located on the west side of
Fourth Street, New Suffolk, New York. The findings of the Board
are that this is not a suitable purpose as cars will exit
directly on to the street. The Board also finds. that it is
more than a 50% expansion. The Board would agree with the
reasoning of the applicant (with the exception that a kitchen
could not be included in the guest facilities) if the addition
were set back 22 feet from Fourth Street and attached to the
existing building or within 5 feet of it.
The Board finds that strict application of the Ordinance
would not produce practical difficulties or unnecessary hardship;
the hardship created is not unique and would.be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will change the
character of the neighborhood, and will not observe the spirit of
the Ordinance.
