SCTM#10000-77-1-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policy standards and therefore is CONSISTENT with the LWRP provided that the Board: 1. Clarify the purpose of the feature marked W.H." seaward of the dwelling. Due to the proximity of the dwelling to surface waters it is recommended that the Board consider requiring the following conditions on the parcel to further Policy 5, and protect and improve the water quality and supply in the area, and protect the water quality of surface waters: Ground application of synthetic fertilizers, herbicides or pesticides on the parcel is prohibited. ii. The use of native, drought -tolerant plants is recommended in new landscaping. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: Many of the homes in this neighborhood are two story homes with similar set backs on these small lots. I.e.: pre-existing, non -conforming —cottages. 1/7/14 the lot coverage figure change is due to patio/concrete areas are not included in lot coverage despite negative environmental/run-off issues. We will be removing several solid surfaced paths and driveway areas, some to be replaced with pervious elements. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: anything we ask to do will be non -conforming to the required, waterside setback. What is being applied for has the least impact of any possible solution to the family's needs. 3. The amount of relief requested is not substantial because: we wish to go up not out and the proposed new second story is recessed from the side property lines to meet setback issues ... of 11 ft on one side, and 167' on the other with a total of 277' where 25' is required ... our only nonconformance requested is to cover the existing concrete patio with a deck that will remain at 97' from the property line or 5 inches less than code to line up with the existing side deck. We are not going any closer to the waterfront so the setback is pre-existing. As the existing side deck will need to be rebuilt for structural reasons this could be re -built 10' from the property line. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: we are seeking permits to remove the existing leaching pool from the water side of the home, installing gutters and drywells to meet code for rain water run-off and we are increasing lot coverage only by putting a deck over an existing concrete slab patio rather than cause waterside disturbance. Slab under proposed deck can be removed if a preferred solution. 5. Has the alleged difficulty been self-created?
