SCTM#1000-43-3-10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policy standards and therefore is CONSISTENT with the LWRP. The action proposes numerous Best Management Practices that further the LWPR policies. However due to the proximity of the dwelling to surface waters it is recommended that the Board consider requiring the following conditions on the parcel to further Policy 5, and protect and improve the water quality and supply in the area, and protect the water quality of surface waters: Ground application of synthetic fertilizers, herbicides or pesticides on the parcel is prohibited. ii. The use of native, drought -tolerant plants is recommended in new landscaping. iii. No fertilizers containing nitrogen, phosphorus, or potassium shall be utilized between November 1St and April 1st. iv. The application of lawn fertilizer within 20 feet of any surface water except: where there is a vegetative buffer of at least 10 feet; or where the fertilizer is applied by a device with iv. The application of lawn fertilizer within 20 feet of any surface water except: where there is a vegetative buffer of at least 10 feet; or where the fertilizer is applied by a device with a spreader guard, deflector shield or drop spreader at least three feet from surface water is prohibited. V. A maximum of 1 pound of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 pounds per 1,000 square feet per year is permitted. vi. The use of phosphorous containing lawn fertilizer is prohibited unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have three bold numbers. The number in the middle is the percentage of phosphorus in the product, e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary. Lastly, it is recommended that the driveways serving the lot shall remain pervious into perpetuity. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. An undesirable change will not be produced in the character of the neighborhood nor will there be a detriment to nearby properties as a result of the proposed work. The proposed additions requiring side -yard relief will be constructed primarily within or over the preexisting structural footprint, thus maintaining the preexisting nonconforming side -yard setbacks of the existing principal structure and remaining consistent with the scope of the existing development. The proposed garage addition requiring front -yard relief will be a single story structure, encroaching minimally on the front yard. Moreover, the style of the home will blend with the surrounding homes, using cedar shingle siding, double hung windows and a combination of sloped and flat roofs. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance, because: a. Due to the preexisting location of the house, a two car garage addition on the landward side of the house unavoidably requires relief from Article XXII Section 280-124. Because the house is located on Sterling Creek and is subject to environmental reviews, it is not possible to locate the garage in an alternate location. b. Due to the preexisting 20.5' and 11.6' side -yard setbacks of the principal structure, any additions to the principal structure unavoidably require relief from Article XXIII Section 280-124 pursuant to the interpretation that they would increase the degree of non-conformance with the minimum and total side -yard setbacks set forth by Article XXIII Section 280-124. In this case, the applicant seeks the benefit of correcting the substandard design and construction of the existing dwelling. 3. The amount of relief requested is not substantial because: a. The front yard setback relief requested from Article XXII Section 280-124 for the garage addition (2.2 feet or 5.5% relief) is not mathematically substantial. b. The relief requested from Article XXIII Section 280-124, relief to maintain an 11.6' minimum side -yard setback where 15 feet is required (3.4 feet or 12%) is not substantial because the structures requiring side -yard relief will be constructed in place of, entirely within, or over the preexisting structural ZBA Reasons for Appeal 1 Koolik Residence 12/27/2013 footprint, thus maintaining and not diminishing the preexisting nonconforming side -yard setback. Additionally, the existing structure is not parallel to the property line. 11.6 feet is the minimum dimension of the nonconformity. The side yard setback expands to approximately 14 feet on the other corner of the structure. c. The relief requested from Article XXIII Section 280-124, relief to maintain a total side -yard setback of 28.5 feet where 35 feet is required is not substantial because the structures requiring side -yard relief will be constructed in place of, entirely within, or over the preexisting structural footprint, thus maintaining and not diminishing the preexisting nonconforming side yard setbacks. Additionally, the proposed outdoor shower that encroaches the side yard beyond the existing footprint will be approximately 66" high above grade and constructed of lightweight wood slats. 4. The project will not have an adverse impact on physical or environmental conditions. The proposed dwelling renovations and expansion will be located entirely in a FEMA designated Zone X. The nearest corner of the renovated dwelling will be located approximately 93 feet from wetlands boundary, which is located along the face of a recently reconstructed bulkhead fronting Sterling Creek. Town defined lot coverage as a result of the project will increase by approximately 1,410 square feet to 16.7 percent of "buildable land," well below the allowable twenty percent. Significant mitigation measures are included in the project design to offset any potential impacts of the proposed construction activities and to improve upon existing site conditions to create a net environmental benefit upon project completion. Specifically, a drainage system of leaders, gutters, and drywells will be installed to collect roof runoff, and an existing, nonconforming septic system located approximately 85 feet from wetlands will be removed and replaced with a new, Suffolk County Department of Health Services -conforming sanitary system located more than 175 feet from wetlands and as far from the surface waters of Sterling Creek as possible. Additionally, approximately 1,515 square feet of existing concrete driveway and walkway areas will be permanently removed in favor of a proposed pervious gravel driveway, resulting in a net reduction in lot coverage by impervious surfaces. A covenanted 15' nonturf buffer located adjacent to the existing bulkhead will be maintained. Therefore, the potential quantity of both roof runoff and surface water runoff reaching the adjacent tidal waters will be decreased, and both groundwater and surface water quality will be potentially improved. Additionally, the reconstruction of the house will bring the house into compliance with current NYS Residential Building Code and NYS Energy Code 5. None of the variance relief requested is self-created due to the preexisting locations of the structure being renovated and the need for renovation.
