NOTICE OF DISAPPROVAL DATE: August 7, 2013 TO: Frank Falino (Grella) 16 Harbor Road Port Washington, NY 11050 Please take notice that your application dated July 31, 2013 For permit to demolish and reconstruct an existing single family dwelling and to maintain as -built decks at Location of property: 1200 First Street, New Suffolk, NY County Tax Map No. 1000 - Section 117 Block 7 Lot 30 Is returned herewith and disapproved on the following grounds: The proposed construction on this non -conforming 3621 square foot lot in the Residential R-40 District, is not permitted pursuant to Article XXIII, Section 280-124, which states that lots measuring less than 20,000 square feet in total size require a minimum front yard setback of 35 feet, a minimum rear yard setback of 35 feet a single side yard setback of 10 feet, a minimum combined side yard setback is 25 feet, and a maximum lot coverage of 20 percent. The proposed and as -built construction notes a front yard setback of 3 feet, a rear yard setback of 6 feet, a single side yard setback of .4 feet, a combined side yard setback of 1 foot, and a total lot coverage of +/- 69 percent. In addition, the construction is not permitted pursuant to Article IV, Section 280-18, which states; "No building or premises shall be used and no building or part thereof shall be erected or altered in the Low -Density R-40 District unless the same conforms to the requirements of the Bulk Schedule and of the Parking Schedule with the same force and effect as if such regulations were set forth herein full." Bulk schedule allows a maximum of 2 '/z stories. Followingproposed new dwelling is designed as a three story structure. Furthermore, the construction is not permitted pursuant to Article XXII Section 280-11613which states; "All buildings located on lots upon which a bulkhead concrete wall riprap or similar structure exists and which are adjacent to tidal water bodies other than sounds shall be set back not less than seventy- five (75) feet from the bulkhead." The proposed construction notes a setback of 0 feet to the existing bulkhead. The intrusion of water from the storm has rendered the lower level 1 L1 • uninhabitable; destroying finishes, mechanical equipment, structural stability, and has also promoted the growth of mold. In order to correct the damage done by the storm, and make the home more livable for their growing family, the Owner's have asked us to redesign the home to meet the current code, and secure it from future storm damage. To this end, the following plan has been developed: • Raise the bottom of the lowest structural framing, which encloses habitable space, to not less than 10'-0" elevation (above mean sea level). • In order to accomplish this, we propose to: o Raise existing single family residence with hydraulic jacks and cribbing o Remove the existing first floor framing, concrete slab and foundation o Excavate directly below house (only) to 3'-0" below existing grade (slope excavation as required to angle of repose) o Install helical piles to PE specifications o Install concrete tie beams and piers o Re -install the fill previously removed for the new foundation work o Frame new first floor structure (bottom of structural members to exceed elevation 10'-0") o Frame new first floor bearing walls o Lower existing second floor down to meet new first floor framing o Perform minor alterations to existing second floor o Install new loft (to code) at second floor SPECIFICS OF THE CONSTRUCTION PLAN: 1. The plan as developed respects the existing setting, topography and natural features (waterways and wetlands) in the vicinity of the residence. 2. Since the home is currently "landlocked" by concrete pavers, decking over paving, bulkheads, and First Street, the construction operations will not create any unwanted storm water runoff to leave the property, or even the immediate construction site (below the existing home). 3. The earth that is going to be excavated for removal and installation of foundations systems will be reinstalled at the end of the first phase foundation work. No additional fill materials will be removed or deposited on the site. 4. All existing utilities — Water, Electric, Gas, Solar and Septic Systems will remain in effect. Because the original block portion of the septic system, which has worked more than adequately for the home since the Owner has lived there, was damaged by Sandy, it will be replaced by a precast structure, eliminating the 2 concern of future collapse. It will remain in its existing front/side yard location, away from the water, and accessible for future servicing, if necessary. The new treated wood first floor framing system, over reinforced poured concrete piers (over Piles) will be set to required Flood Zone height. In the case of a future storm event, water from the bay will wash harmlessly through the open level at grade. (Mechanical systems will be located above flood level, and there will be not be any car parking below the raised house). STATEMENT OF EFFECT: We do not believe that the proposed construction operations will have any deleterious effects on the local natural environment, and that the completed project will provide a safe and secure home for the residents, who have displayed a great respect and concern for the neighborhood. We believe the upgrading of this home is in the very best interests of the community at large. ATTACHMENTS: (1) original and (3) copies of the following: • Application • Survey • Project Plans • Photos SCHEDULE OF THE WORK: • Substantial Completion approximately (3) months from Start date DESCRIPTION OF THE WORK: The Grella Residence has sustained significant damage to its first floor level due to Hurricane Sandy. The intrusion of water from the storm has rendered the lower level 1 s �_ I uninhabitable; destroying finishes, mechanical equipment, structural stability, and has also promoted the growth of mold. In order to correct the damage done by the storm, and make the home more livable for their growing family, the Owner's have asked us to redesign the home to meet the current code, and secure it from future storm damage. To this end, the following plan has been developed: • Raise the bottom of the lowest structural framing, which encloses habitable space, to not less than 10'-0" elevation (above mean sea level). • In order to accomplish this, we propose to: o Raise existing single family residence with hydraulic jacks and cribbing o Remove the existing first floor framing, concrete slab and foundation o Excavate directly below house (only) to 3'-0" below existing grade (slope excavation as required to angle of repose) o Install helical piles to PE specifications o Install concrete tie beams and piers o Re -install the fill previously removed for the new foundation work o Frame new first floor structure (bottom of structural members to exceed elevation 10'-0") o Frame new first floor bearing walls o Lower existing second floor down to meet new first floor framing o Perform minor alterations to existing second floor o Install new loft (to code) at second floor SPECIFICS OF THE CONSTRUCTION PLAN: 1. The plan as developed respects the existing setting, topography and natural features (waterways and wetlands) in the vicinity of the residence. 2. Since the home is currently "landlocked" by concrete pavers, decking over paving, bulkheads, and First Street, the construction operations will not create any unwanted storm water runoff to leave the property, or even the immediate construction site (below the existing home). 3. The earth that is going to be excavated for removal and installation of foundations systems will be reinstalled at the end of the first phase foundation work. No additional fill materials will be removed or deposited on the site. 4. All existing utilities — Water, Electric, Gas, Solar and Septic Systems will remain in effect. Because the original block portion of the septic system, which has worked more than adequately for the home since the Owner has lived there, was damaged by Sandy, it will be replaced by a precast structure, eliminating the 2 • • concern of future collapse. It will remain in its existing front/side yard location, away from the water, and accessible for future servicing, if necessary. 5. The new treated wood first floor framing system, over reinforced poured concrete piers (over Piles) will be set to required Flood Zone height. In the case of a future storm event, water from the bay will wash harmlessly through the open level at grade. (Mechanical systems will be located above flood level, and there will be not be any car parking below the raised house). STATEMENT OF EFFECT: We do not believe that the proposed construction operations will have any deleterious effects on the local natural environment, and that the completed project will provide a safe and secure home for the residents, who have displayed a great respect and concern for the neighborhood. We believe the upgrading of this home is in the very best interests of the community at large.
