Lark & Folts, Esqs. on behalf of ELLEN F. EMERY 1999 REVOCABLE TRUST requests a Wetland
Permit for the as -built 100' timber pile vinyl sheet bulkhead; as -built 80' timber pile tongue -and -groove
sheet retaining wall with two 8' returns located ±25' landward of bulkhead; as -built 80' mid -bluff timber
pile tongue -and -groove sheet retaining wall with two 8' returns located ±55' landward of bulkhead; as -
built 85' timber pile vinyl sheet retaining wall with a 12' return and a. 25' return located f10' landward
from top of bluff; as -built bluff stairs from top of bluff to beach consisting of a 4'x7' access platform
leading to a 4'x28' set of stairs with associated 75sq.ft. platform to a 4'x7' set of stairs with associated
95sq.ft. platform to a 4'x17' set of stairs leading to a 4'x13' walkway with a 4'x10' set of stairs to beach
parallel to bulkhead, supported by 8" timber pile posts and composite materials on stair treads and
decking; as -built 1,800 cubic yards clean fill spread evenly between retaining walls to replace lost bluff
material with placement of erosion control jute matting on bluff; for a proposed rear -yard drainage
system to direct roof rain and surface water away from house foundation and upland retaining wall by
providing a drainage swale with 4 PVC pipe to a drywell in the front yard area; and for a proposed
200sq.ft. deck of composite decking supported by 6"x6" posts located 10' landward from top of bluff.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the as -built structures
are INCONSISTENT with the LWRP Policies 6.3 (below) and therefore, INCONSISTENT with the
LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The actions do not comply with Wetland Permits issued.
1. The bluff stair does not conform to permitted specifications (7706, 7652 and 8222)
The 95 square foot stair landing stair was not included in approvals. Wetland Permit
8222 allows the installation of a 10x10 observation platform at the mid -bluff retaining
wall. It looks like the 75 square foot platform would comply with this condition.
2. The as built retaining walls do not conform to permitted specifications (8222).
3. The as built bulkhead does not conform to permitted specifications (8049).
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
1. ' All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a. determination of consistency. *&cept minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form. should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Watmfront Revitalization Program. A pMposed action will be evaluated as to its sianificant
3: if any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both suuuorong and non-
suaeorting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

In response to your recent inquiry concerning the stair system on
Ellen Emery's property as set forth in her wetlands application dated
January 17, 2014, be advised the stair system was built by Seacoast
Construction, Inc., as shown on the survey of John C.' Ehlers dated 11-
20-2013 (Ex G) and as also shown on the "As Built Retaining Walls" by
Dan Seligmann PE dated 12-12-13 (Ex F Item 1-A) and "As Built Retaining
Wall Details" by Dan Seligmann PE Rev. 1. 01-08-14 (Ex F Item 1-B).
Running from the top of the bluff to Little Peconic Bay (west to
east), the stair system is described as follows:
1. 4' x 7' stair access walkway, 28+ sq. ft., with 1' x 5'
composite decking by Timbertech; to
2. 4' x-2-8' set of stairs, treads 1' x 5' composite
ecking IV Timbertech; to
t 75 sq. f landing with 1' x 5' composite decking
