KAYTIS SCTM# 1000-81-3-28 En -Consultants on behalf of JANE W. KAYTIS requests a Transfer of Wetland Permit #5847 from George Kaytis to Jane W. Kaytis, as issued on December 17, 2003; and for an Amendment to Wetland Permit #5847 for the in-place replacement of approximately 101 linear feet of existing timber bulkhead with vinyl bulkhead, approximately 6" higher than existing; the replacement within +/-24 of approximately 20 linear feet of existing timber bulkhead (located in front of existing shed and deck to remain) with vinyl bulkhead, approximately 6" higher than existing; the in-place replacement of existing +/-4'x4' wood landing and +/-4'x8.5' steps to beach; the construction of a +/-12' vinyl return along. the southerly property line; re -nourish the eroded embankment with approximately 200 cubic yards of clean sand fill and loam to be trucked in from an approved upland source and re -vegetate with native vegetation. SCTM# 81-3-28 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessm ent is intended to supplem ent other inform ation used by a Town of Southold agency in m a k in g a d e t e r m in a t i o n o f c o n s is t e n c y. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non - supporting facts. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The project seeks to replace an existing, previously permitted timber bulkhead damaged during Hurricane Sandy with a vinyl bulkhead in the same location (except for +/-20' section fronting permitted shed & decks) and +/-6" higher to maintain the property's historical method of shoreline stabilization and to provide a reasonable increase in protection for the upland property and existing residence against erosion and flooding caused by storm surge. The existing property has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1980, and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead, the subject and adjacent similarly bulkheaded properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon. Therefore the project is consistent with Policy 4. Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold.
