A Grandfathered Permit (4410) was issued in 1995 for a 100' long dock and 45'"L" shape dock. The
existing dock does not conform to the permit.
En -Consultants on behalf of JOHN & SARAH HENRY requests a Wetland Permit for the existing fixed
"J" shaped pier that consists of an 8'x152' shore -perpendicular section, and 10'x36' and 10'x17' shore -
parallel sections; as -built repairs consisting of the installation new 2"x10" untreated decking and the
replacement of inside pilings, caps and stringers; and proposed repairs consisting of the installation of
additional 2"x10" untreated decking and replacement of additional 10" inside pilings, 6"x6" caps and
outside stringers, and 4"x6" inside stringers. Located: 2440 Village Lane, Orient. SCTM# 26-1-17.1
The application states in the narrative submitted with the CAF dated 1/16/14 that the proposed action is
"normal maintenance" and therefore Exempt from LWRP CCR. The dock is not in conformance with
the Board of Trustees Grandfather Permit and therefore the action cannot be exempted from review.
The permit was issued for a dock length of 100', the current dock length is 152'. The "L" section of the
dock was permitted at 45', the current length is 53'.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed actions are
INCONSISTENT with the below listed LWRP policy and therefore are INCONSISTENT with the LWRP:
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws
and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
Town records indicate that the structure was constructed (in its existing configuration) without the
benefit of review of the Board of Trustees.

The dock is located in the Coastal Erosion Hazard Area (CEHA), however, aerial photos indicate that
the dock was constructed prior to enactment of the regulations and is not required to meet square
footage requirements. A CEHA permit is not on record.

Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed actions.

A. INSTRUCTIONS
1. All applicants for perm its* including Town of Southold agencies, shall com plete this CCAF for
proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law. This
assessm ent is intended to supplem ent other inform ation used by a Town of Southold agency in
m a k in g a d e t e r m in a t i o n o f c o n s is t e n c y. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
suQportine facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

Perform ordinary and usual maintenance activities on an existing fixed, "J" shaped pier,
which pre -dates 1955 and consists of an 8' x 152' shore -perpendicular section and 10' x

replacement of storm damaged inside pilings, caps, and stringers; and 2) proposed repairs
of additional storm damage caused by Hurricane Sandy, including installation of
additional 2" x 10" untreated decking and replacement of additional 10" inside pilings, 6"
x 6" caps and outside stringers, and 4" x 6" inside stringers, all as depicted on the survey
prepared by Nathan Taft Corwin III Land Surveyor, last dated November 1, 2013.
All policies are indicated as "Not Applicable" because it is our understanding pursuant to
Section 268-5 ("Review if Actions") of the Town Code and the corresponding definitions
of "action" and "minor action" set forth in Chapter 268-3 ("Definitions"), the project
meets the definition of a minor action and is thus exMFF6�;' � consistency__..____
review. Specifically, because the repairs constituteand not a
"restoration" pursuant to Chapter 111 of the Town Coden enclosed survey),
they are not subject to the requirements of a Coastal Erosion Management Permit and
thus meet the following definition of a "minor action" pursuant to Chapter 268: "B.
Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the
same site (in place)... except for structures in areas designated by the Coastal Erosion
Hazard Area (CERA) law where structures may not be replaced, rehabilitated, or
reconstructed without a permit..." That is, so long as the repair work does not re ire a
Coastal Erosion Management Permit, then the work meets this definition of a ' or
action and is exempt from review pursuant to Chapter 268.
