THIS INDENTURE, made the 23rd day of December, Two Thousand Fourteen
BETWEEN
JON C. KERBS, residing at 430 Riley Avenue, Mattituck, New York 11952, being the owner of
99% of the fee title,
party of the first part, and
CASEY ROSE KERBS, residing at 430 Riley Avenue, Mattituck, New York 11952,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever, a one
(1%) percent interest, so that thereafter said Jon C. Kerbs shall own 98% of the fee
interest, in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Southold, Town of Southold, County of Suffolk, and State of
New York, being more particularly bounded and described as follows:
BEGINNING at a point on the southerly side of County Route 48 where the northeasterly line of
the premises herein described and the southwesterly line of lands now of Margaret A. Kerbs,
heretofore conveyed to said Margaret A. Kerbs by deed dated January 27, 1988, and recorded in
the Office of the Suffolk County Clerk in Liber 10549, Page 48, intersects said southerly line of
County Route 48, and from said point of beginning
RUNNING South 50 degrees 43 minutes East, 358.37 feet to lands now or formerly or Kruk;
RUNNING THENCE along said lands now or formerly of Kruk, South 39 degrees 17 minutes
West, 174.95 feet;
RUNNING THENCE North 50 -degrees 43 minutes West, 356.87 feet;
RUNNING THENCE along said southerly line of County Route 48, 175.00 feet to the point of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated August 28, 2007, and recorded September 14, 2007 in the Office of the Clerk of the
County of Suffolk in Liber 12522, Page 515.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof-, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
