15015 , as Co -Executors under the Last Will and Testament of Michael Conway dated December
22, 2011, who died on the 1 st day of January 2012, as party of the first part, and
MARGARET CONWAY and EILEEN ROUNDS, as Co -Trustees of the Supplemental
Needs Trust For the Benefit of KATE CONWAY under Article Eighth of the Last Will and
Testament of Michael Conway dated December 22, 2011, with an address at 1411 N. High
Street, Bridgton, Maine 04009 and ROBIN SIMMEN, residing at 2950 Rocky Point Road, East
Marion, New York 11939 retaining a life estate interest, as parties of the second part. ...^—
WITNESSETH, that whereas Letters Testamentary were issued to the party of the first
part by the Surrogate's Court, County, New York, on April 11, 2012 and by virtue of the power
and authority given in and by said last will and testament, and/or by Article 11 of the Estates,
Powers and Trusts Law,
And in consideration of Ten ($10) Dollars, paid by the party of the second part, does
hereby grant and release unto the party of the second part, the distributees or successors and
assigns of the party of the second part forever.
All that certain plot, piece or parcel of land, situated, lying and being at East Marion,
Town of Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a monument at an angle in the easterly line of Rocky Point Road 19.87
feet northerly along said line from the northwesterly corner of land now or formerly of Pantelias;
RUNNING THENCE from said monument along the easterly side of Rocky Point Road,
North 8 degrees 59 minutes 50 seconds West 80.13 feet;
THENCE along said land now or formerly of Young, North 81 degrees 30 minutes East
210.29 feet to land now or formerly of King;
THENCE along said land now or formerly of King, South 8 degrees 57 minutes 10
seconds East 100 feet to the said land now or formerly of Pantelias;
THENCE along said land South 81 degrees 30 minutes West 210.38 feet to the easterly
side of Rocky Point Road;
THENCE along said easterly side of Rocky Point Road, North 8 degrees 30 minutes
West 19.87 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by deed dated May 29, 2001 and recorded in the Suffolk County Clerk's office in Liber
12126, Page 449 on June 26, 2001.
THE Property having an address of 2950 Rocky Point Road, East Marion, New York
11939.
EXPRESSLY RESERVING a life estate in the above described property unto the Party
of the Second Part, ROBIN SIMMEN.
ROBIN SIMMEN shall have full ownership, possession and use of the property, as well
as the rents, revenues and profits generated by the property during the term of her natural life.
Upon the expiration of ROBIN SIMMEN's natural life, the -ownership, possession, use, rents,
revenues and profits of the above described property shall pass to KATE CONWAY pursuant to
the Supplemental Needs Trust, established for her benefit pursuant to Article Eighth of the Last
Will and Testament of Michael Conway dated December 22, 2011.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose. The word
"party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
