Box 398 Greenport, NY 11944 Re: Approval - Proposed Site Plan for 170 Moores Lane Realty Corp. 170 Moores Lane, ±130' n/w/o Moores Lane & NYS Rt. 25, Greenport SCTM#1000-45-7-3 Zoning District: LI Dear Mr. Ratsey: The following resolutions were adopted at a meeting of the Southold Town Planning Board on February 9, 2015: WHEREAS, this Site Plan is for a proposed 60' x 19' (1,140 sq. ft.) office addition to an existing 129' x 125' warehouse building on 1.2 acres in the Light Industrial Zoning District, Greenport; and WHEREAS, on September 30, 2014, the agent for the applicant, Colin Ratsey, submitted an application for Site Plan review; and WHEREAS, on October 1, 2014, a revised Notice of Disapproval was issued by the Building Department noting the proposed relocation of the office addition, effectively re-classifying the required Variances for the application; and WHEREAS, on October 15, 2014, the agent for the applicant, Colin Ratsey, submitted revised Site Plans for review; and WHEREAS, at a Work Session held on October 20, 2014, the Planning Board formally accepted the application for review with revisions and information to be submitted immediately; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), has determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(7): construction or expansion of a primary or accessory/appurtenant, non-residential structure or 170 Moore's Lane [2] ebruary 10, 2015 facility involving less than 4,000 square feet of gross floor area and not involving a change in zoning or a use variance and consistent with local land use controls, but not radio communication or microwave transmission facilities. The action is to construct a 1,140 sq. ft. building in the location of an existing concrete pad; and WHEREAS, on November 6, 2014, the agent for the applicant, Colin Ratsey, submitted the remaining application materials to the Planning Board; and WHEREAS, on November 14, 2014, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on November 20, 2014, the Zoning Board of Appeals issued a decision for File #6801, granting a non-conforming front yard variance of 26'6" and a lot coverage percentage of 33.4% (LI = 30% max) with no conditions; and WHEREAS, on December 10, 2014, the Southold Town Engineering Inspector reviewed the above-referenced application and determined that the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management and required revisions to the Site Plan so the drainage calculations and drainage depictions on the Site Plan are consistent; and WHEREAS, on December 15, 2014, a public hearing was held and closed for the above- referenced application; and WHEREAS, on December 18, 2014, the Southold Town Fire Inspector reviewed the proposed Site Plan and determined that there was adequate fire protection and emergency access for the site; and WHEREAS, on January 1, 2015, the Town of Southold LWRP Coordinator reviewed the above-referenced project and determined the proposed project to be consistent with Southold Town LWRP Policies with recommendations for additional landscaping and the practices of on-site water quality controls; and WHEREAS, on January 21, 2015, the agent to the applicant, Colin Ratsey, submitted revised Site Plans sufficiently including the revisions required by the Southold Town Engineering Inspector and the Planning Board; and WHEREAS, pursuant to §280-133 C, the Planning Board has the discretion to waive any or all of the requirements of§ 280-133 by resolution at a duly noticed public meeting, for those applications involving modifications to existing structures with no substantial change to the existing footprint, where the Planning Board determines that such modifications or any change in use will not require significant changes to existing major site design features, as well as applications involving uses strictly related to agriculture (but excepting retail winery operations), if it determines such requirements are not necessary to protect and maintain the public health, safety, or welfare and to further the objectives set forth in §280-129. The Planning Board has found that requiring the entire set of Site Plan Application requirements for this site is not necessary to further the objectives set forth in Town Code §280-129 and maintain public health, safety, and welfare for the following reasons: the application is for a small office addition (1,140 sq. ft.) being placed on an existing concrete pad; the office 170 Moore's Lane • (3] GFebruary 10, 2015 addition will not be open to the public and will not increase the amount of employees on site; and WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 B (5), has the discretion to vary or waive the parking requirements for Site Plan Applications where doing so would not have a detrimental effect on the public health, safety or general welfare, and will not have the effect of nullifying the intent and provision of the Site Plan requirements chapter of the Town Code. The Planning Board has found that this application is eligible for a waiver of parking requirements because the office space and associated office employees are being moved from inside the existing building to this new location to make more storage space inside the existing building; and WHEREAS, at their Work Session on January 28, 2014, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — 130 Site Plan Approval of the Town of Southold, have been met; and WHEREAS, on February 6, 2015, the Southold Town Chief Building Inspector reviewed and certified the proposed warehousing use as a permitted use in the Light Industrial Zoning District pursuant to ZBA File #6801; therefore, be it RESOLVED, that the Southold Town Planning Board hereby waives the following Site Plan Application requirements: §280-133 B(1)(f), B(1)(g) and B(1)(j); B(2)(d); and be it further RESOLVED, that the Southold Town Planning Board hereby waives the parking requirements as detailed above; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is a Type II Action and not subject to review under SEQRA; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board grants Approval with One (1) Condition to the survey for SCTM#1000-45-7-3, dated January 28, 2014, last revised January 20, 2015, prepared by Nathan Taft Corwin III. The Chairman is hereby authorized to endorse the Site Plan. Condition: 1. To be fulfilled prior to the issuance of a Certificate of Occupancy: submit an As- built Landscape Plan to be reviewed to the satisfaction of the Planning Board. At a minimum, the Landscape Plan must include a vegetated, landscaped buffer along Moores Lane to break up the mass of the building. Native, drought tolerant plants are required and note that any large trees planted within the buffer must be "wire-friendly" due to utility poles and wires located in the Town of Southold right-of-way. 170 Moore's Lane (4] OFebruary 10, 2015 Please also note the following requirements in the Southold Town Code relating to Site Plans: 1. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 4. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 5. Any changes from the Approved Site Plan shall require prior Planning Board approval. 6. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. If you have any questions regarding the above, please contact this office. Very truly yours, Donald J. Wilcenski Chairman Encl. Remove the 8' x 6' deep leaching pool shown on the Site Plan and provide four (4) 8' x 2' deep leaching pools on the Site Plan consistent with the drainage calculations and details pursuant to §236 of the Town Code for the proposed office addition. 2. Provide the following notation on the revised Site Plan: "Landscaping will be added to the site during the construction phase; an As-built Landscape Plan is to be submitted and reviewed to the satisfaction of the Planning Board prior to the issuance of a Certificate of Occupancy". As a condition of the Site Plan decision, an As-built Landscape Plan is to be submitted to this Department prior to the issuance of a CO. At a minimum, the Landscape Plan must include a vegetated, landscaped buffer along Moore's Lane to break up the mass of the building. Native, drought tolerant plants are required and note that any large trees planted within the buffer must be "wire friendly" due to utility poles and wires located in the Town of Southold right-of- way. 3. Add the following text on the Site Plan; these water quality standards will be a condition of the Site Plan decision: 170 Moores Lane Realt*orp. Page Two January 20, 2015 "In order to protect and preserve the quality and quantity of potable water, the Board required the following: a. Only the use of organic fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen in the mixture. b. A maximum of 1 Ib. of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 lbs. per 1,000 square feet per year. c. Prohibit the application of fertilizer products containing nitrogen, phosphorous, or potassium between November 1St and April 1St. d. Prohibit the use of phosphorous containing lawn fertilizer unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorous. Fertilizer labels have three bold numbers. Southold Town LWRP Coordinator Planning Board Date: January 7, 2015 Re: LWRP Coastal Consistency Review for 170 Moores Lane SCTM# 1000-45-7-3 This Site Plan is for a proposed 60' x 19' (1,140 sq. ft.) office addition to an existing 129' x 125' warehouse building on 1.2 acres in the Light Industrial Zoning District, Greenport. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the records available to me, the, proposed action is CONSISTENT with the LWRP provided the following is considered to meet or further the below listed policies. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. It is recommended that the Board require a vegetated, landscaped buffer along Moore's Lane to break up the mass of the building. Note that any trees in the buffer must be "wire friendly" due to utility poles and wires located in the Town of Southold right of way. 5.5. Protect and conserve the quality and quantity of potable water. A. Prevent contamination of potable waters by limiting discharges of pollutants to maintain water quality according to water quality classification, and limiting, discouraging or prohibiting land use practices that are likely to contribute to contravention of surface and groundwater quality classifications for potable water supplies, a. Require the use of native, drought-tolerant plants in landscaping. b. Require only the use of organic fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen in the mixture. c. Require a maximum of 1 Ib. of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 lbs. per 1,000 square feet per year. d. Prohibit the application of fertilizer products containing nitrogen, phosphorus, or potassium between November 13t and April 1st. e. Prohibit the use of phosphorous containing lawn fertilizer unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have three bold numbers. DEC 1 0 2014 170 Moors Lane, Greenport, NY SCTM #: 1000-45-7-3 Southold Town Dear Mr. Wilcenski: Planning Board As per a request from your office, I have reviewed the Site Plan, dated 7/28/14 for the construction of an Office Addition to an existing Facility. Please consider the following: 1. The proposed front & side yard setbacks should be reviewed and approved by the Town Building Department. 2. The drainage calculations meet the minimum requirements of Chapter 236 for Stormwater Management. However, the designs noted with the calculations are inconsistent with what has been specified on the plan. The calculations call for 4—8'diameter x 2'deep LP's and the plan calls for 1 —8'diameter x 6'deep LP. This drainage design needs to be confirmed. 3. A test hole has not been provided. This item will be required to verify thedepth to ground water and the actual design depth requirements for leaching pools at this site. (See item #2 above.) Please note that all leaching pools must maintain a minimum separation of two feet, from: ground water. If you have any questions regarding this review, ase contact my office. incer ly, ames A. Located at 170 Moores Lane N, ±130' No Rt. 25 & Moores La., Greenport SCTM#1000-45-7-3 ZBA#6801 The Planning Board has reviewed the requested variances to construct a 1,140 sq. ft. office addition at a location less than the required 100' front yard setback (±26'4") and exceeding the maximum lot coverage of 30% (33.4%) in the Light Industrial Zone; and generally has no objections to the requested variances. This site was developed long ago and prior to site plan requirements. The proposed office addition will be constructed within the footprint of an existing concrete block foundation from a previous building. The site is currently developed at 31.2% lot coverage (4% over the Code requirement). The additional lot coverage (11% over the Code requirement) is acceptable to the Planning Board in this case due to the industrial zoning, the development history of the parcel, and the fact that it will not reduce the existing landscaping or parking on site. Submitted: the revised site plan shows four (4) 8' x 2' deep leaching pools off the front of the proposed addition as required 2. Submitted: the notation above has been provided as #1 in the "general notes" section on the site plan 3. Add the following text on the Site Plan; these water quality standards will be a condition of the Site Plan decision: 1 "In order to protect and preserve the quality and quantity of potable water, the Board required the following: a. The number in the middle is the percentage of phosphorous in the product, e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary". Submitted: the above text has been provided as item #2 in the "general notes" section on the site plan V: Staff Recommendations All site plan requirements listed in §280-133 of the Town Code have been met and it is recommended that the above referenced site plan application be scheduled for determination by the Planning Board at the February 9, 2015 public meeting. 2 Southold Planning Department Staff Report Site Plan Application Work Session — Referral Review Date January 12, 2015 Prepared By: Brian Cummings I. SEQRA Type II: 617.5(c)(7) construction or expansion of a primary or accessory/appurtenant, non-residential structure or facility involving less than 4,000 square feet of gross floor area and not involving a change in zoning or a use variance and consistent with local land use controls, but not radio communication or microwave transmission facilities; 1 5. Parking: Staff: A specific parking plan has not been provided. The proposed office addition has been described as to not cause a need for additional employees or the need for public parking on site. No parking calculations have been provided or shown on the plan; however, this is an existing industrial site where historically there have not been any complaints or concerns 6. Exterior Lighting: Staff: no exterior lighting has been proposed on the site plan. Photographs of existing light fixtures on site have been submitted. (see photographs) 7. Bulk Schedule Code Requirements for LI zoning district: a. Front yard: (100' or average min), 26.6' proposed; average is 24.1 b. Side yard (N): (20'min), 25' proposed; side yard to south is sufficient c. Rear Yard: (70' min), 124.4' exists d. Lot coverage: i. 30% maximum ii. 31.2% existing iii. 33.4% proposed e. Landscape area: 25%min; existing/proposed unknown Referrals A. Fire Marshall a. No comments or concerns regarding the proposed addition B. LWRP a. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Policy (LWRP) Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department and the records available to me, the proposed action is CONSISTENT with the LWRP provided the following is considered to meet or further the below listed policies: Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. L It is recommended that the Board require a vegetated, landscaped buffer along Moore's Lane to break up the mass of the building. Note that any trees in the buffer must be "wire 2 • • friendly" due to utility poles and wires located in the Town of Southold right of way. 5.5. Protect and conserve the quality and quantity of potable water A. Prevent contamination of potable waters by limiting discharges of pollutants to maintain water quality according to water quality classification, and limiting, discouraging or prohibiting land use practices that are likely to contribute to contravention of surface and groundwater quality classifications for potable water supplies; a. Require the use of native, drought tolerant plants in landscaping b. Require only the use of organic fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen in the mixture c. Require a maximum of 1 lb. of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 lbs. per 1,000 square feet per year d. Prohibit the application of fertilizer products containing nitrogen, phosphorous, or potassium between November 1St and April 1St. e. Prohibit the use of phosphorous containing lawn fertilizer unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorous. Fertilizer labels have three bold numbers. The number in the middle is the percentage of phosphorous in the product, e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary. C. Greenport Fire District -The Commissioners have reviewed the proposed site plan and determined that there are no changes, additions, or reservations about this horse barn. Fire department access is satisfactory. D. Town Engineer a. The proposed front and side yard setbacks should be reviewed and approved by the Town Building Department b. The drainage calculations meet the minimum requirements of Chapter 236 for Stormwater Management. However, the designs noted with the calculations are inconsistent with what has been specified on the plan. The calculations call for 4 — 8'diameter x 2' deep LP's and the plan calls 3 for 1 — 8' diameter x 6' deep LP. This drainage design needs to be confirmed. c. A test hole has not been provided. This item will be required to verify the depth to groundwater and the actual design depth requirements for leaching pools at this site (see item #2 above). Please note that all leaching pools must maintain a minimum separation of two feet from ground water. E. Village of Greenport -No comment provided F. Architectural Review Committee (ARC) The Committee reviewed the proposed project on November 20, 2014 and approves the application as submitted. V: Staff Recommendations 1. With regard to the LWRP recommendations: i. Require only the use of organic fertilizers in addition to the water quality practices listed above. ii. Require a landscaped buffer along Moore's Lane to break up the mass of the building and make sure that any trees in the buffer be "wire friendly" due to utility poles and wires located in the right of way. Require the use of native, drought tolerant plants in landscaping 2. Require the applicant to clarify the proposed drainage systems for this project, as detailed above. 3. Require the applicant to provide a test hole to provide the depth to groundwater, ensuring that the proposed drainage systems will be sufficiently located. 4 Soupold Planning Department St t Report Site Plan Application Work Session — Completeness Date October 20, 2014 Prepared By: Brian Cummings I.
