APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage -disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non -conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is
denied, the Building Inspector shall state the reasons therefor in writing to the applicant.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions, or alterations or for removal or demolition as herein described. The

Dear Mr. Verity:
I represent Jeffrey and Anca Lemler who purchased premises
at 320 Broadwaters Road, Cutchogue, New York on June 14, 2012
which contains 38,567 sq. ft.
I am enclosing a current survey of Peconic Surveyors,
P.C. dated May 9, 2012 which shows the existing structures.
The storage shed on the westerly side of the property has a
Certificate of Occupancy (No. Z-31044 dated July 18, 2005), a
copy of which is enclosed. However, subsequent to the closing
it was discovered the 8 x 20 foot shed on the easterly side of
the property did not have a specific Certificate of Occupancy.
I remember at the time of closing the Seller, Barbara Klein
(Barbara Kunen) and her attorney indicated the shed on the
easterly side had existed for many years and it was included
when the house Certificate of Occupancy was issued. However,
the Certificate of Occupancy (No. Z189 dated August 23, 1976)
issued by Howard Terry does not specifically list the storage
shed, a copy of which is enclosed. On further review. of all of
the Certificates of Occupancy, it appears this particular
accessory shed on the easterly side was overlooked at the
closing as it is not mentioned in any of them.

I recently inspected this shed and it is fairly clear from
looking at the construction it has been there for many years.
The shed itself is eight feet in height. In reviewing other
records I located a survey by Robert B. Holzman dated 9-7-88
which shows this shed in its existing location. Both of the
surveys indicate the shed is 8.2' west of the property line at
the closest point.
In reviewing the zoning ordinances that were in existence
in the 1980's, any accessory building had to be three feet from
the property line. I noted on April 10, 1990 for a lot of this
size, the setback from the property line for an accessory
building had to be five feet. In any event this accessory
storage building meets either one of these requirements.
Therefore, enclosed is an Application for Pre-existing
Certificate of Occupancy along with the fee. I would appreciate
you reviewing this application and if all is in order, issue a
Pre-existing Certificate of Occupancy for this storage shed.
