Barnes Coy Architects on behalf of LISA GRATTAN requests an Administrative Amendment to
Wetland Permit #7647 to install a F tall by 16' wide steel driveway gate with two (2) 6'-11° wide
gate leafs. Located: 11860 New Suffolk Avenue, Cutchogue. SCTM# 116-6-9
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore, CONSISTENT with the
LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form sho d review the exempt
minor action list, policies and explanations of each policy contained in th own of Southold Local
Waterfront Revitalization Program. A pEgpggpd action will be evaffiated as to its si 'cant

AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in accordan(
with the Resolution of the Board of Trustees adopted at the meeting held on SSM tember 21.2011_in consideratic
of application fee in the sum of52 0.00 raid by Lisa Grattan and subject to the Terms and Conditions as stated
the Resolution, the Southold Town Board of Trustees authorizes and permits the following:
Wetland Permit to remove the existing single-family dwelling, porches, brick patio and sanitary
system; construct new single-family dwelling, rear terrace containing a swimming pool and spa, upgraded
sanitary system surrounded by a 120' retaining wall, and a 4' wide access path constructed of pervious
materials for access to the water body, with the condition an additional bay bale Use is installed along the
Umh of moderate wave action upon completion of the demolition of the existing dwelling, a French drain ii
Installed along the limit of moderate wave action, drywells are installed to contain stormwater run-off, an(
the established buffer areas are re -vegetated, and as depicted. on the survey prepared by John T. Metzger
last revised October 11, 2011 and planting plan prepared by Suffolk Environmental Consulting, Inc. last
revised October 12, 2011.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee, Lisa Grattan Mi&g at 162 Hillcrest Ave Summit NJ as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Downs Creek is a New York State Significant Fish and Wildlife Habitat Area and a New
York State Department of Environmental Conservation Critical Environmental Area.
A site inspection was conducted on August 19, 2011.
Suffolk Environmental Consulting, Inc. on behalf of LISA GRATTAN requests a Wetland
Permit to remove the existing 2,465 sf. single-family dwelling, porches, brick patio and sanitary
system; construct new 3,250 sf. single-family dwelling, rear terrace containing a swimming
pool and spa, screened rec-room/cabana, screened terrace, and upgraded sanitary system
surrounded by a 120' retaining wall. Located: 11860 New Suffolk Ave., Cutchogue.

Location and composition of erosion controls to minimize damage to wetland
vegetation during demolition and construction are not shown on the survey. It is
recommended that the Board require that the locations of construction/erosion controls
be shown.
It is recommended that the Board require complete removal of the current structure and
have applicant specify the restoration of the area (buffer).
If the action is approved to further Policy 5: Protect and Improve Water Quality in the Town of
Southold and Policy 6; Protect and Restore the Quality and Function of the Town of Southold
Ecosystem it is recommended that a 25' landscaped buffer be required landward of the
wetlands (where possible). Fertilization and pesticide use within the buffer should be
prohibited.
LANDSCAPED BUFFER -- A land area of a certain length and width which is planted with
indigenous, drought -tolerant vegetation similar to that found within the immediate proximity of
the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover
within two years of installation. Survival of planted vegetation shall be 90% for a period of three
years. Maintenance activities within the buffer are limited to removing vegetation which is
hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain
viewsheds, replanting of vegetation and establishing a four -foot -wide access path constructed
of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009]
It is further recommended that the Board preserve the large oak tree east of the current
structure to the greatest extent practicable. The proposed terrace may need to be
redesigned to include a tree well to accomplish this.
