Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: March 17, 2014 Re: Proposed Wetland Permit for VERNI FAMILY LLC SCTM# 1000-43-5-5 Robert Barratt on behalf of VERNI FAMILY LLC requests a Wetland Permit to demolish existing dwelling and sanitary system; construct new 3,000sq.ft., two-story dwelling with attached 3 -car garage to be built no closer to the wetlands than existing footprint; a new septic system to be installed within a +/-130' retaining wall on the landward side of the dwelling; a line of staked hay bales with silt fencing to be installed prior to and maintained during construction; and a 20' non -turf buffer to be established and subsequently maintained along the landward edge of wetlands. Located: 160 Inlet Lane, Greenport. SCTM# 43-5-5 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policy standards and therefore is CONSISTENT with the LWRP provided the Board considers the following: Due to the proximity of the dwelling to ground and surface waters (Note that the surface water body shows evidence of high nutrient loading due to the amount of floating vegetation). It is recommended that the Board consider requiring the following conditions on the parcel to further Policy 5 and Policy 6 and protect water quality: 1.. Establishment of a 30' wide non -fertilized, landscaped buffer landward of the wetland line (Figure 1). Chapter 268 of the Southold Town Code defines a landscape buffer as: LANDSCAPED BUFFER - A land area of a certain length and width which is planted with indigenous, drought -tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four -foot -wide access path constructed of pervious material for access to the water body. The Board may want to re -iterate NYSDEC and SCDOH fertilizer law language which specifies that: No fertilizers containing nitrogen, phosphorus, or potassium shall be utilized between November 1 s' and April 1 St (SCDOH and NYSDEC). The application of lawn fertilizer within 20 feet of any surface water except: where there is a vegetative buffer of at least 10 feet; or where the fertilizer is applied by a device with a spreader guard, deflector shield or drop spreader at least three feet from surface water is prohibited (NYSDEC). iii. The use of phosphorous containing lawn fertilizer is prohibited unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have three bold numbers. The number in the middle is the percentage of phosphorus in the product, e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary (NYSDEC). ,• In addition it is recommended that the Board clarify the depth of the proposed drywells in relation to groundwater. No dimensions have been provided f or the drywells and groundwater was encountered at 4.5' below grade according to test hole data. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
