Located: 1325 Gull Pond Lane, Greenport. SCTM# 35-4-10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS item "BB" which states: BB. Additions to an existing dwelling constituting less than 25% of the existing structure where the addition is greater than 75 feet from a natural protective feature, except where the parcel is located in a coastal erosion hazard area; The proposed action is not located within a coastal erosion hazard area. Minor Exempt Actions items: Additions to an existing building or rebuilt residential structure which results in no net increase in ground area coverage, except where the parcel is located in a coastal erosion hazard area; B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (inplace), including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control structures (including, but not limited to, groins, jetties, bulkheads, filled piers) located within Great Peoonic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardiners • Bay, Long Island Sound, Fishers Island Sound and Block Island Sound (excluding all creeks); The proposals to abandon the existing septic system; install a new updated sanitary system, reconstruct and raise the existing bulkhead, stairway are CONSISTENT. It is recommended that the filled area landward of the bulkhead be stabilized with Indigenous, vegetation. In addition, all Intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Chapter 236 Stormwater, Grading and Drainage Control Law of the Southold Town Code (Amended 2012) requires that the action receive Stormwater Management Control Approval pursuantto: D. Site preparation within 100 fat of wetlands, beach, bluff or coastal erosion hazard area. A stormwater management control plan must be submitted to the Building Department. The proposed re -construction of the existing floating dock to (180 sq ft ) is not a permissible action pursuant to 275-11 Construction and operation standards, A (6) and is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (c) Regulations for the placement and configuration of docking facilities. (1 j Residential docks. [Amended 10-11-2005 by L.L. No. 17-2005] 1 [b] If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: 1i] It is no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated; or of equal square footage as determined by the Trustees; [Amended 12-18-2007 by L.L. No. 23-2007] Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
