Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: March 13, 2014 Re: Proposed Wetland Permit for MOELLER FAMILY TRUST, c/o MARGARET JESPERSEN SCTM# 1000-21-2-15 Albert Jespersen on behalf of MOELLER FAMILY TRUST, c/o MARGARET JESPERSEN requests an Administrative Permit for the as -built ±21' wide by ±16.7' long reconstructed deck with ±6' wide steps attached to dwelling; the installation of gutters to leaders to drywells onto the dwelling; and install a non -turf buffer varying in width along the top of the bluff. Located: 1155 Aquaview Avenue, East Marion. SCTM# 21-2-15 It is my recommendation that the proposed actions is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structure described was not constructed pursuant to Southold Board Trustees permit and not permissible under Chapter 275 Wetlands and Shorelines regulations. In the even the action is approved it is recommended that the Board verify the width of the proposed landscaped buffer. Pursuant to Chapter 268, the Board •of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
