Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Donald Wilcenski, Chair Town of Southold Planning Board From: Mark Terry, Principal Planner LWRP Coordinator Date: November 29, 2012 NOV 3 0 2012 Re: Proposed Standard Subdivision of Bayberry Estates SCTM# 1000-55-6-35& 36 and 56-1-1 Zoning District: R-80 This proposal is for a Standard Subdivision of a 50.0609 acre parcel into 18 lots and two (2) open space parcels, where the lots range in size from 28,235 square feet to 36,400 square feet, with the open space parcels totaling 33.96 acres, including the wetlands in the R-80 Zoning District. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, the proposed action is CONSISTENT with the LWRP, provided that the below recommendations are required in the subdivision approval. The 18 lots have been clustered to minimize impacts. Greater than 60 percent of the property has been preserved as open space. To further Policy 5, and protect and improve the water quality and supply in the area, and protect the water quality of the sole source aquifer, it is recommended that the following best management practices be required: 1. Require the use of native plants, drought -tolerant plants in landscaping. 2. Prohibit the residential application and use of synthetic fertilizers and pesticides capable of entering the potable water supply. a. Require only the use of organic fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen in the mixture. b. Require a maximum of 1 Ib. of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 lbs. per 1,000 square feet per year. c. Prohibit the application of fertilizer products from December 1 and April 1. d. Prohibit the application of lawn fertilizers containing phosphorus, except for establishment of new lawns, or if data confirms that phosphorus is required. A Phase IA and Phase IB Archeological Investigation was conducted in March 2008 for the action. The Phase IB resulted in the excavation of 294 ST's between 1 to 15 meter intervals. Two prehistoric artifacts were encountered. These were proved to be isolated finds (quartz flakes). No historic artifacts or features were encountered. No further work was recommended.
