Box 1179 Southold, NY 11971 Telephone: 631 765-1938 Fax: 631765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Donald Wilcenski, Chair Town of Southold Planning Board From: Mark Terry, Principal Planner LWRP Coordinator Date: January 30, 2014 Re: Proposed Standard Subdivision of William J Baxter Jr. SCTM# 1000-102.-5-9.4 Zoning District: HB This proposal is a Standard Subdivision of a 2.38 acre parcel into 4 lots where Lot 1 = 0.62 acres, Lot 2 = 0.63 acres, Lot 3 = 0.62 acres and Lot 4 = 0.52 acres, in the Hamlet Business Zoning District. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the following recommendations are implemented to further the below listed policies: Policy 2.2 Protect and preserve archaeological resources. A. Conduct a cultural resource investigation when an action is proposed on an archaeological site, fossil bed, or in an area identified for potential archaeological sensitivity on the archaeological resources inventory maps prepared by the New York State Department..... 1. Conduct a site survey to determine the presence or absence of cultural resources in the project's potential impact area. 2. If cultural resources are discovered as a result of the initial survey, conduct a detailed evaluation of the cultural resource to provide adequate data to allow a determination of the resource's archaeological significance. The parcel is included and identified as an archeo-sensitive area (MAPINFO GIS-Archeo- sensitive layer). Ground disturbance on Lots 1-4 would result from future construction. No known archeological sites have been identified on the parcel, therefore impacts to potential archeological resources are unknown. It is recommended that applicant contact the New York State Office of Parks, Recreation and Historic Preservation (518-237-8643) to determine if a Phase One Survey is recommended. Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold D. Use appropriate siting, scales, forms, and materials to ensure that structures are compatible with and add interest to existing scenic components. It is recommended that the Board require that the future vehicle parking spaces/lot on site be located in the rear of future site planned structures to further this policy. The parking area location and configuration should be memorialized during the subdivision process as a conceptual plan to facilitate traffic flow and viability of future commercial uses. The establishment of cross easements to facilitate traffic flow in the rear of the future commercial buildings is also recommended. Building envelopes for each parcel should be evaluated in context to the parking area and overall character of the Hamlet Center. E. Preserve existing vegetation and establish new indigenous vegetation to enhance scenic quality. 1. Preserve existing vegetation which contributes to the scenic quality of the landscape. It is recommended that existing, native trees greater than 2"+ caliper be identified and assessed if they could be integrated in future site plans. Existing trees should be preserved to create treed islands within the parking lot and to meet landscape requirements required in § 280-95 Landscaped parking area of the Southold Town Code. It is further recommended that existing trees be integrated in the additional landscape requirements for each lot. Trees should be surveyed and marked prior to construction. Figure 1. In addition to the front landscaped area and buffer area requirements, parking areas shall comply with the following minimum standards: A. All uses required to provide 20 or more off-street parking spaces shall have at least 10 square feet of interior landscaping within the paved portion of the parking area for each parking space and at least one tree with a two-inch caliper for every 10 parking spaces or fraction thereof. Each separate landscaped area shall contain a minimum of 100 square feet, shall have a minimum dimension of at least eight feet, shall be planted with grass or shrubs and shall include at least one tree of not less than two-inch caliper. B. A landscaped area shall be provided along the perimeter of any parking area except that portion of the parking area which provides access to a street or parking facility on an adjacent lot. Accessways to adjacent lots shall not exceed 24 feet in width and shall not exceed two in number for each purpose. The landscaped area shall have a minimum dimension of four feet, shall be planted with grass or shrubs and shall include at least one tree of not less than two-inch caliper for every 40 feet along the perimeter of the parking area. In cases where the parking area adjoins a public sidewalk, the required landscaped area shall be extended to the edge of the sidewalk. C. Trees used in parking lots shall include honey locust, pine, oak or other similar fast-growing, hardy varieties or existing trees where appropriately located. To further policies 5.1 and 5.5 below, it is recommended that the following best management practices be required: 5.1. Prohibit director indirect discharges that would cause or contribute to contravention of water quality standards, and 5.5. Protect and conserve the quality and quantity of potable water. A. Prevent contamination of potable waters by limiting discharges of pollutants to maintain water quality according to water quality classification, and limiting, discouraging or prohibiting land use practices that are likely to contribute to contravention of surface and groundwater quality classifications for potable water supplies, a. Require the use of native, drought -tolerant plants in landscaping. b. Require only the use of organic fertilizers where the water-soluble nitrogen is no more than 20% of the total nitrogen in the mixture. c. Require a maximum of 1 Ib. of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 lbs. per 1,000 square feet per year. d. Prohibit the application of fertilizer products containing nitrogen, phosphorus, or potassium between November 1St and April 1St. e. The use of phosphorous containing lawn fertilizer is prohibited unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have three bold numbers. The number in the middle is the percentage of phosphorus in the product, e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
