Located: 2255 Wickham Avenue, Mattituck. SCTM# 114-3-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the Policy Standards and therefore are CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. There is no bathroom or other plumbing facilities proposed in association with the adjacent, enclosed changing stations, and the adjacent storage shed is designed to contain pool equipment associated with the existing swimming pool. Therefore, there are no new or additional uses proposed that would increase the volume of septic effluent on the property, and a drainage system of drywells to capture and recharge storm runoff associated with the structures is proposed to be located more than 100 feet from wetlands. Therefore, the project will be consistent with Policy 5 through its avoidance of direct or indirect discharges that would cause or contribute to contravention of groundwater or surface water quality standards. As noted above, there is no bathroom or other plumbing facilities proposed in association with the adjacent, enclosed changing stations; and the adjacent storage shed is designed as an alternative location for housing existing pool equipment associated with the existing swimming pool. Therefore, there are no new or additional uses proposed that would increase the volume of septic effluent on the property, and a drainage system of drywells to capture and recharge storm runoff associated with the structures is proposed to be located more than 100 feet from wetlands. Therefore, the project will not create direct or indirect discharges that would cause or contribute to contravention of groundwater or surface water quality standards. Nor will placement of these structures directly or indirectly result in the physical loss or degradation of the ecological components of the adjacent coastal waters or wetlands or destroy or significantly impair the function or values of the fish and wildlife habitats associated with those ecosystems. With respect to Town and State wetlands regulations, the open pool pavilion, pergola, and pool equipment storage shed are all located at their nearest points more than 50 feet from the wetlands boundary, the minimum wetlands setback required for a swimming pool pursuant to Chapter 275. Only one of the changing stations is located less than 50 feet with a proposed setback of approximately 47 feet. Because the structures will be located landward of the 10' elevation contour above mean sea level, they have been exempted from regulation by the NYSDEC pursuant to the New York State Tidal Wetlands Act. LWR CONSISTENCY ASSESSMENT FORM ADDENDUM for STRONG'S MARINE INLET, LLC 2255 WICKHAM AVENUE, MATTIUCK SCTM #1000-114-3-1 Policy 10 The proposed project is designed as part of an ongoing effort by new ownership to revitalize and enhance this existing and long neglected commercial marina facility on Mattituck Inlet, which also houses a restaurant and swimming pool. The intention of the project is thus consistent with the general policy goal of protecting Southold's water - dependent uses and with the more specific Policy Standard 10.1(a), i.e., protecting and enhancing an existing water -dependent use. The project is also specifically consistent with Policy Standard 10.2 due to the facility's location on Mattituck Inlet. As noted in the policy language, Mattituck Inlet and Creek, identified by the State as a regional maritime center, is one of the primary focus areas of maritime activity in the Town of Southold, and the intent of the policy is to promote and enhance the economic viability of existing water -dependent commercial uses at this location. One of the means of accomplishing this goal, as stated in Policy Standard 10.1(b), is to improve the economic viability of water dependent uses by allowing for non -water dependent or "water - enhanced" accessory uses that help ensure the successful financial operation and viability of the water dependent use. Here, the pool pavilion, pergolas, and changing stations are proposed specifically to make the swimming pool and outdoor facilities in general more attractive and convenient for use by its existing customers and to attract new customers by providing a shaded gathering place and private locations to change clothes. And the pool equipment shed is being located adjacent to the proposed pavilion in lieu of its existing location, which impairs the otherwise open view of the harbor from the restaurant located farther upland. For these reasons, the project is explicitly consistent with the policy goals and standards of Policy 10. Policy 10.
